Wall, as City Attorney, and shows: 1. This application and submission is made pursuant to Section 5 of the Voting Rights Act of 1965, as amended, 42 U.S.C. S 1973. 2. Augusta, Georgia ("Augusta") is a political subdivision of the State of Georgia, created as a result of the consolidation of The City Council of Augusta and Richmond County (1995 Ga. Laws, p. 3648, as amended by 1996 Ga. Laws, p. 3607, 1997 Ga. Laws, p. 4690, 1997 Ga. Laws, p. 4024, and 1999 Ga. Laws, p. 4143). Augusta is governed by the Augusta-Richmond County Commission, composed of ten (10) Commissioners and a Mayor. 3. The Georgia General Assembly in its 2002 Session passed legislation known as Act No. 431 (H.B. 1689) that was approved and signed by the Governor on April 8, 2002, so as to reappoliion the districts for election of members of the Augusta-Richmond County Commission; to provide for elections pursuant to such reappol1iolUnent of districts, to provide for procedures, and for other purposes. ~ t (, 4. A copy of said Act is attached hereto as Exhibit "A". 5. Act No. 431 provides that those members of the Commission who were serving as such on January 1, 2002, as well as any person 'vvho might be selected to fill a vacancy in such office, shall continue to serve as members until the regular expiration of their respective terms of office and upon the election and qualification of their respective successors. Said Act further provides that said Commission Districts 1,2,3,4,5,6,7,8,9, and 10, as they existed on January I, 2002 shall continue to be designated as Commission Districts 1,2, 3,4, 5, 6, 7, 8, 9, and 10, respectively, but as newly reapportioned under the Act. The Act further provides that on or after May 1, 2002, such members of the Commission serving from their former Commission Districts shall be deemed to be serving from and representing their respective Districts as newly reapportioned under the Act. The Act specifically provides that the sitting Commission members shall continue to serve in their respective Districts, but as newly reapportioned under the Act, until their original terms would otherwise expire. 6. The Act further provides that any vacancy in the membership of the Commission be filled on or after the effective date of the Act shall be filled from the newly reapportioned Commission District. 7. The reappOltioned Districts are as follows: Commission District 1 This Commission seat is currently held by Lee Beard, an African-American. The current Commission District has a total population of 20,993, of which 69.28% is black, with a black V oting Age Population (V AP) percentage of 64.22%, The newly :2 & reapportioned District has a total population of 25,382, with a black population of 16,597 or 65.39% (VAP 60.13%) and a Hispanic or Latino population of 359 (V AP 1.33%). Under the provision of the Act, Commissioner Lee Beard, a black member of the Augusta-Richmond County Commission representing Commission District 1 as of January 1, 2002, will continue to serve the newly reapportioned Commission District I. This Commission seat will appear on the November, 2005 General Election ballot. Commissioner Beard will continue to serve until December 31, 2005. If Commissioner Beard completes his cun-ent term, under other provisions of the Consolidation Act as it currently exists, Commissioner Beard will not be eligible for re-election, having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 2 This Commission seat is currently held by Marion F. Williams, an African-American. The current Commission District has a total population of 19,396, of which 68.56% is black, \vith a black Voting Age Population (V AP) percentage of 65.51 %. The newly reapportioned.District has a total population of 24,585, with a black population of 17,590 or 71.55% (V AP 67.80%) and a Hispanic or Latino population of 361 (V AP 1.38%). ., -' '. 0,;- Under the prOVISIOn of the Act, Commissioner Marion Williams, a black member of the Augusta-Richmond County Commission representing Commission District 2 as of January 1, 2002, will continue to serve the newly reapportioned Commission' District 2. This Commission seat will appear on the November, 2003 General Election ballot. Commissioner Williams will continue to serve until December 31, 2003. Commissioner Williams will be eligible for re-election, not having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 3 This Commission seat is currently held by Stephen E. Shepard, a Caucasian. The current Commission District has a total population of 26,685, of which 30.52% is black, with a black Voting Age Population (V AP) percentage of 28.50%. The nevvly reapportioned District has a total population of 25,195, with a black population of 7,64] or 30.33% (V AP 28.60%) and a Hispanic or Latino population of 940 (V AP 3.74%). Under the provision of the Act, Commissioner Stephen E. Shepard, a white member of the Augusta-Richmond County Commission representing Commission District 3 as of January I, 2002, will continue to serve the ne\vly reapportioned Commission District 3. 4 ~, (. This Commission seat will appear on the November, 2005 General Election ballot. Commissioner Shepard will continue to serve until December 31, 2005. If Commissioner Shepard completes his current term, under other provisions of the Consolidation Act as it currently exists, Commissioner Shepard will not be eligible for re-election, having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 4 This Commission seat is currently held by Richard Colclough, an African-American. The current Commission District has a total population of 26,700, of which 80.39% is black, with a black Voting Age Population (V AP) percentage of 77 .19%. The newly reapportioned District has a total population of 25,130, with a black population of 18.945 or 75.39% (V AP 73.50%) and a Hispanic or Latino population of 1,069 (V AP 3.89%). Under the provision of the Act. Commissioner Richard Colclough, a black member of the Augusta-Richmond County Commission representing Commission District 4 as of January 1, 2002, will continue to serve the newly reapportioned Commission District 4. This Commission seat will appear on the November. 2003 General Election ballot. Commissioner Colclough \vill continue to 5 J. t' serve until December 31, 2003. If Commissioner Colclough completes his current term, under other provisions of the Consolidation Act as it currently exists, Commissioner Colclough \vill be eligible for re-election, not having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 5 This Commission seat is currently held by Bobby Hankerson, an African-American. The current Commission District has a total population of 21,909, of which 70.48% is black, with a black Voting Age Population (V AP) percentage of 66.54%. The newly reapPOliioned District has a total population of 24,546, with a black population of 17,112 or 69.71% (VAP 65.38%) and a Hispanic or Latino population of 638 (V AP 2.53%). Under the provision of the Act. Commissioner Bobby Hankerson, a black member of the Augusta-Richmond County Commission representing Commission District 5 as of January 1, 2002, will continue to serve the newly reapportioned Commission District 5. This Commission seat wijJ appear on the November. 2005 General Election ballot. Commissioner Hankerson will continue to serve until December 31, 2005. Commissioner Hankerson will be 6 eligible for re-election, not having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 6 This Commission seat is cUITently held by Andy Cheek, a Caucasian. The current Commission District has a total population of 28,255, of which 46.46% is black, with a black Voting Age Population (V AP) percentage of 41.76%. The newly reapportioned District has a total population of 24,423, with a black population of 9,922 or 40.63% (V AP 36.39%) and Hispanic or Latino population of710 (VAP 2.64%). Under the provision of the Act, Commissioner Andy Cheek, a white member of the Augusta-Richmond County Commission representing Commission District 6 as of January 1, 2002, will continue to serve the newly reapportioned Commission District 6. This Commission seat will appear on the November, 2003 General Election ballot. Commissioner Cheek will continue to serve until December 31, 2003. Commissioner Cheek wi II be eligible for re-election, not having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 7 This Commission seat is currently held by Tommy Boyles. a Caucasian. The current Commission District has a total 7 L population of 24,86 L of which 19.24% is black, with a black Voting Age Population (V AP) percentage of 17.59%. The newly reapportioned District has a total population of 25,471, with a black population of 5,228 or 20.53% (V AP 18.82%) and a Hispanic or Latino population 01'741 (V AP 2.58%). Under the provision of the Act, Commissioner Tommy Boyles, a white member of the Augusta-Riclunond County Commission representing Commission District 7 as of January I, 2002, will continue to serve the newly reapportioned Commission District 7. This Commission seat will appear on the November, 2005 General Election ballot. Conunissioner Boyles will continue to serve until December 31, 2005. Commissioner Boyles will be eligible for re-election, not having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 8 This Commission seat is currently held by Ulmer Bridges, a Caucasian. The current Commission District has a total population of 30,976, of \,vhich 27.73% is black, with a black Voting Age Population (V AP) percentage of 25.80%. The newly reapportioned District has a total population of 25.043, with a black population of 6,356 or 25.38% (V AP 23.93%) and a Hispanic or Latino population of 727 (V AP 2.71 %). 8 Under the prOVISIOn of the Act, Commissioner Ulmer Bridges, a white member of the Augusta-Richmond County Commission representing Commission District 8 as of January 1, 2002, will continue to serve the newly reapportioned Commission District 8. This Commission seat will appear on the November, 2003 General Election ballot. Commissioner Bridges will continue to serve until December 31, 2003. If Commissioner Bridges completes his current term, under other provisions of the Consolidation Act as it currently exists, Commissioner Bridges will not be eligible for re-election, having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 9 This Commission seat is currently held by Willie H. Mays, III, an African-American. This District is a District composed of Districts 1, 2, 4 and 5, all of which are majority black Districts. . The current Commission District has a total population of 88,998, of which 72.75% is black, with a black Voting Age Population (V AP) percentage of 68.69%. The newly reapportioned District has a total population of 99,643. with a black population of 70,244 or 70.50% (V AP 66.41 %) and a Hispanic or Latino population of 2427 (V AP 2.22%). 9 ~. Under the prOVISIOn of the Act, Commissioner Mays, a black member of the Augusta-Richmond County Commission representing Commission District 9 as of January 1, 2002, will continue to serve the newly reappOliioned Commission District 9. This Commission seat will appear on the November, 2005 General Election ballot. Commissioner Mays will continue to serve until December 31, 2003. If Commissioner Mays completes his current term, under other provisions of the Consolidation Act as it currently exists, Commissioner Mays will not be eligible for re-election, having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). Commission District 10 This Commission seat is currently held by Bill Kuhlke. This District is a District composed of Districts 3, 6, 7 and 8, all of . which are majority Caucasian Districts. The current Commission District has a total population of 110,777, of which 31.27% is black, with a black Voting Age Population (V AP) percentage of 28.43%. The newly reapportioned District has a total population of 100,132, \vith a black population of 29,147 or 29.11 % (V AP 26.68%) and a Hispanic or Latino population of 3118 (V AP 2.94%). Under the provision of the Act, Commissioner Bill Kuh1ke, a white member of the Augusta-Richmond County Commission 10 J' representing Commission District 10 as of January 1, 2002, will continue to serve the newly reappOliioned Commission District 10. This Commission seat will appear on the November, 2003 General Election ballot. Commissioner Kuhlke will continue to serve until December 31, 2003. If Commissioner Kuhlke completes his current term, under other provisions of the Consolidation Act as it currently exists, Commissioner Kuhlke will not be eligible for re-election, having served two consecutive four year terms of office. See 1995 Ga. Laws, p. 3648, Section 2 (c). 8. The proposed Redistricting Plan set forth in the Act was unanimously approved by all members of the Augusta-Richmond County Commission, which consists of five (5) black members and five (5) Caucasian members. 9. Said Act was unanimously approved by the Richmond County Legislative Delegation, which consists of four (4) black members (3 state representatives and 1 .state senator) out of a delegation of eight (8). 10. The Commission Districts are the same as the Districts for the election of the members of the Board of Education of Richmond County, as newly reapportioned, by Act No. 430, also approved by the Governor on April 8,2002. 12. A map sho\-ving the existing Commission District is attached to this Submission as Exhibit "B", and a map showing the reappoliioned Commission Districts is attached to this Submission and marked as Exhibit "C". Statistical analysis of the existing Commission Districts is attached as Exhibit "D" and the newly reapportioned districts is attached as Exhibit "E", and a diskette containing Block Equivalency files is attached as Exhibit "F". L. 1995, p. 3648), as amended, so as to reapportion the districts for election4 members of the Augusta-Richmond County Commission; to provide for elections pursuant to such reapportionment of districts; to provide for definitions and inclusions; to provide for continuation in office of current members; to provide for terms of office; to provide for procedures; to change the provisions relating to vacancies; to provide for submission of this Act for approval under the federal Voting Rights Act of 1965, as amended; to provide for the automatic repeal of this Act if its implementation is not permissible under the fedenil Voting Rights Acts of 1965, as amended, as of a certain date; to provide an effective date; to repeal conflicting laws; and for other purposes. BE IT ENACTED BY TIffi GENERAL ASSEMBLY OF GEORGIA: SECTION 1. An Act providing for the consolidation of Richmond County and the City of Augusta, approved March 27, ]995 (Ga. L. 1995, p. 3648), as amended, is amended by striking subsection (a) of Section 2 of said Act and inserting in lieu thereof the following: '(a)(I) For the purpose of electing members of the Augusta-Richmond County Commission, Richmond County is divided into 10 commission districts. One membe:- of the board shall be elected from each such district. Commissio~ Districts 1,2,3,4,5, 6, 7, and 8 shall be and correspond to those eight numbered districts described in and attached to and made a part of this Act and further identified as Plan Name: richrev3 Plan Type: Local User: Gina Administrator: Richmond Co. Commission District 9 shall . be composed ofa combination ufCommission Districts 1,2,4, and 5 as each is described in such plan. Commission District 10 shall be composed of a combination of Commission Districts 3, 6, 7, and 8 as each is described in such plan. (2) When used in such attachment, the terms 'Tract' and 'BG'(Block Group) shall mean and describe the same geographical boundaries as provided in the report' of the Bureau of the Census for the Uriited States deCennial census of2000 for the State ofGe6rgia. . . The separate nwneric designations in a Tract description which are underneath a 'BG' heading shall mean and describe individual Blocks within a Block Group as provided in . the report of the Bureau of the Census for the United States decennial census of2000 for the State of Georgia. Any part of Richmond County which is not included in any such district described in that attachment shall be included Within that district contiguous to H. Any part of Richmond County which is described in that attachment as being in a particular district shall nevertheless not be included within such district if such part is not contiguous to such district. Such noncontiguous part ;;n- instead be included within that district conti~ous to such part which contains the least population according to the United States deceMial census of 2000 for the State of Georgia. Except as otherwise provided in the description of any commission district, whenever the description of such district refers to a named city, it shall mean the geographical boundaries of that city as shown on the census map for the United States decennial census of 2000 for the State of Georgia: SECTION 2. Said Act is further amended by striking subsections (a) and (b) of Section 3 of said Act and inserting in lieu thereof the following: '(a) Those members of the commission who were serving as such on January 1,2002, and any person selected to fill a vacancy in any such office shall continue to serve as such members until the regular expiration of their respective tenns of office and upon the- election and qualification of their respective successors. Commission Districts 1,2,3,4, 5,6,7,8,9, and 10, as they existed on January 1,2002, shall continue to be designated as Commissioner Districts 1,2,3,4,5,6, 7,8,9, and 10, respectively, but as newly described under this Act., and on and after May I, 2002, such members of the board serving from those fonner commission districts shall be deemed to be serving from and representing their respective districts as newly described under this Act. (b)(t) Those members.ofthe commission who, under subsection (a) of this section, are deemed to be serving out their tenns in Commission Districts 2,.4, 6, 8, and 10 shall serve \IDtil December 31, 2003, and their respective successors shall be elected from Commission Districts 2, 4, 6, 8, and 10 in the November, 2003, general election, shall take office on January 1,2004, and shall have tenns of office of four years each and until their respective successors are elected and qualified. Those members of the commission who, under subsection (a) of this section. are deemed to be serving out.~eir t~ in Commission Districts 1, ~, 5, 7, and 9 sh~! serve until DecemDer 31, 2005, aild until their respective successors are elected and qualified. (2) At the November, 2005, general election, successors to those members of the c:ommission from Commission Districts 1, 3, 5, 7, and 9, all of whose terms expire December 31, 2005, shall be elected to serve, beginning Januiuy 1. 2006, from . (3) Successors to members of the commission shall be elected at a general election to be held on the Tuesday following the fIrst Monday in November immediately preceding the expiration of their respective terms of office, shall be nominated and elected by plurality vote as provided in this section, shall take office on the first day of January immediately following the date of their election, and shall have terms of office offour years and until ---., their respective successors are elected and qualifIed. Each member of the commission shall be elected by the electors residing within such.member's commission district. (4) The mayor pro tempore shall be a member of the commission.' SECTION 3. Said Act is further amended by striking subsection (a) of Section 5 of said Act and inserting in its place the following: '(a) A vacancy which occurs in the office of the mayor or in the membership of the commission by death, resignation, removal from the commission district, or for any other reason shalI be fIlIed by the remaining members of the commission appointing a qualifIed person to serve for the unexpired term, unless the unexpired term exceeds 12 calendar rr.onths, in which event, the commission shall appoint a qualifIed person to serve until a -. - - .- . , ....- - '. -. .. successor is elected to serve for the unexpired tenns as provided in this sub~ection. When the unexpired tenns exceeds 12 calendar months, a special election shall be held in the county in the ~e of the mayor or in the commission district in which the vacancy occurred to elect a successor for the unexpired tenn. Any such special election shaH be called, held, and conducted in accordance with the applicable provisions of Chapter 2 of Title 21 of the O.C.GA., the 'Georgia Election Code.' Any vacancy in the membership of the commission to be fIlled on or after the date this subsection becomes effective in 2002 shall be ftI1ed from the newly reapportioned commission district.' . SECTION 4. (a) It shall be the duty of the attorney for Augusta, Georgia. to submit this Act for approval pursuant to Section 5 of the federal Voting Rights Act of 1965, as amended; and it shall be the du~' of the Augusta-Richmond County Commission to direct and. ens~e that such submission is made by the commission' 5 attom.ey orsome other attorney ifthe~ission' s attorney fails to act. Each member of the commission shall be elected by the electors residing within such member' s commission district. (4) The mayor pro tempore shall be 8 member of the commission.' SECTION 3. Said Act is further amended by striking subsection (a) of Section 5 of said Act and inserting in its place the following: '(a) A vacancy which occurs in the office of the mayor or in the membership of the commission by death, resignation, removal from the commission district, or for any other reason shall be fIlled by the remaining members of the commission appointing a qualifIed person to serve for the unexpired term, unless the unexpired term exceeds 12 calendar rr.ontbs, in which event, the commission shall appoint a qualifIed per-iOn to serve until 8 . . -. successor is elected to serve for the unexpired tenns as provided in this subsection. When the unexpired tenns exceeds 12 calendar months, 8 special election shall be held in the county in the ~e of the mayor or in the commission district in which the vacancy occurred to elect 8 su~essor for the unexpired term. Any such special election shall be called, held, and conducted in accordance with the applicable provisions of Chapter 2 of Title 21 of the O.C.G.A., the 'Georgia Election Code.' Any vacancy in the membership of the commission to be fIlled on or after the date this subsection becomes effective in 2002 shall be fIlied from the newly reapportiOned commission district,' ~ SECTION 4.
