DEED OF DEDICATION FOR NEW EASEMENT

pp uzpe and Lauren Erramu a,hereinafter referred to as OWNERS,and
Augusta, Georgia, a political subdivision under the laws of the State of Georgia,hereinafter
referred to as AUGUSTA;
WITNESSETH:
WHEREAS, there is a certain easement over a sanitary sewer, on the above referenced parcel of
land(see Deed recorded in the Office of the Clerk of the Superior Court of Richmond County,
Georgia,in Record Book 10-Y,Pages 482-483), said easement hereinafter referred to as
"EXISTING EASEMENT;" and
WHEREAS, OWNERS requested that the EXISTING EASEMENT be abandoned, so that the
sanitary sewer could be moved; and
WHEREAS, OWNERS have agreed to replace this EXISTING EASEMENT,with a new
easement over the new location of the relocated sanitary sewer,hereinafter referred to as "NEW
EASEMENT,"; and
WHEREAS, AUGUSTA has determined that abandonment of the EXISTING EASEMENT and
its replacement by the NEW EASEMENT will not adversely affect the utility systems of
AUGUSTA,or the future maintenance of same; and

NOW, THEREFORE:
AUGUSTA,its successors, assigns and legal representatives,does hereby abandon the
EXISTING EASEMENT, which is marked as "EXISTING SEWER EASEMENT(TO BE
ABANONDED)", on a plat prepared by the Augusta Utilities Department,dated May 9, 2019,
marked Exhibit A, and recorded with the document herein, and, to which,reference is made for a
more accurate description. Said EXISTING EASMENT is granted "AS IS" to OWNERS and
AUGUSTA will no longer have any responsibility, or liability, for the EXISTING EASEMENT,
or any issue that may arise concerning the EXISTING EASEMENT. AUGUSTA does,by this
document, convey any and all rights and privileges it has, or may have,in and to the EXISTING
EASEMENT, unto OWNERS; and
IN EXCHANGE:
OWNERS,their heirs, assigns and legal representatives,do hereby grant,bargain, sell and
convey unto AUGUSTA, its successors, assigns and legal representatives, an exclusive utility,
access and maintenance easement(NEW EASEMENT),in perpetuity, as shown on said plat and
marked as "15'SANITARY SEWER EASEMENT."
OWNERS do also grant unto AUGUSTA,its successors, assigns and legal representatives,the
right,but not the duty, to clear and keep clear all trees, undergrowth and other obstructions from
said NEW EASEMENT, for all purposes stated herein, along with the free right of ingress and
egress to and from said NEW EASEMENT, for these purposes.
OWNERS do further grant unto AUGUSTA the right to stretch communication lines,or other
lines,within the NEW EASEMENT, for the use of AUGUSTA, its assigns,representatives,
agents, and designees, along with the necessary cables, wires, apparatus, fixtures and appliances;
and with the right to assign said NEW EASEMENT, in whole, or in part.
OWNERS do agree that no other utility,pipeline, cables,wires, or other intrusions,may be
constructed within the aforesaid NEW EASEMENT in perpetuity,without the written consent of
AUGUSTA.
AUGUSTA does hereby agree that OWNERS, their heirs and assigns, shall have the right to use
said NEW EASEMENT in any manner not inconsistent, or interfering with,the rights herein
granted to AUGUSTA,EXCLUDING,however, the right to plant thereon any trees, or other
vegetation that may interfere with the laying, relaying,installing, adding, extending, operating,
repairing and maintaining of pipelines transporting and carrying the utility services of
AUGUSTA. ALSO EXCLUDED is the right to erect, construct, or maintain thereon,any
buildings, structures, or other permanent improves, such as,but not limited to,masonry fences,
or walls.
