An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the
Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960)
together with all amendments which have been approved by either the Augusta
Commission as authorized under the Home Rule Provisions of the Comprehensive
Zoning Map from Constitution of the State of Georgia" by changing the zoning from
Zone LI (Light Industry) to Zone R-3C (Multiple-family Residential) for senior
apartments affecting property located at the southwest intersection of Walton Way
and Fifth Street; and for the repeal of ordinances in conflict herewith and for other
purposes:
THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS:
SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of
Richmond County on the 15th day of November, 1983, the caption of which is set out above, is
amended by changing the Comprehensive Zoning Map by changing the zoning from of zoning from
Zone LI (Light Industry) to Zone R-3C (Multiple-family Residential) for senior apartments as
follows:
Beginning at a point located at the southwest intersection of Walton Way and Fifth
Street;thence,in a northwesterly direction along the south right-of-way line of Walton
Way a distance of 216.77 feet,more or less,to a point;thence,in a southerly direction
a distance of 71.07 feet, more or less, to a point; thence, in a westerly direction a
distance of 14.03 feet, more or less, to a point; thence, in a southerly direction a
distance of 91.80 feet, more or less, to a point; thence, in a southeasterly direction a
distance of 90.82 feet, more or less to a point; thence, in southeasterly direction a
distance of 48.33 feet, more or less, to a point; thence, in an easterly direction along
the north right-of-way line of Taylor Street a distance of 194.37 feet,more or less,to
a point;thence,in a northerly direction along the west right-of-way line of Fifth Street
a distance of 336.78 feet, more or less, to the point of beginning. This property
containing approximately 1.82 acres and known as 811 Fifth Street. Tax Map 047-3-

SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia is
subject to the following stipulations:
1. The site plan must meet all zoning requirements for the Section 18-1 for development of
multifamily residential development in an R-3C zone which includes a maximum of 54
apartments which coincides with the 29 units per acres allowed in this district.
2. The proposed development must substantially comply with the presented plan and
drawings including the number of parking spaces drawn(80).
3. A deed restriction shall be placed on this property to allow only those tenants that are 55
and over. Any change in this designation requires the applicant/owner to return to the
Planning Commission.
4. If the application is not acted upon within 18 months the zoning shall revert to the current
LI (Light Industry) zone.
SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are
hereby
repealed.
