AS ATTORNEY FOR CHERYL BATCHELOR • RESOLUTION RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL CLAIMS BY CHERYL BATCHELOR (CLAIMANT) IN THE AGGREGATE SUM OF SEVENTY-FIVE THOUSAND DOLLARS ($75,000.00), PAYABLE AS FOLLOWS: JOHN MICHAEL BROWN, P.C., AS ATTORNEY FOR CHERYL BATCHELOR; FURTHER AUTHORIZING THE ADMINISTRATOR TO DISBURSE THE AMOUNT OF SEVENTY-FIVE THOUSAND DOLLARS ($75,000.00); WAIVING AUGUSTA, GEORGIA CODE OF ORDINANCES SECTIONS IN CONFLICT FOR THIS INSTANCE ONLY; AND FOR OTHER PURPOSES. WHEREAS, Cheryl Batchelor filed suit alleging sexual harassment, sexual discrimination, and disability discrimination in the Superior Court of Richmond County, Case No. 2015-RCCV-610, and she filed a workers' compensation claim for a knee injury before the State Board of Workers' Compensation, Claim No. 2014-013781; WHEREAS, all parties to said claims desire to settle all claims; and WHEREAS, Claimant has agreed to settle all claims against Augusta-Richmond County,Augusta-Richmond County Commission,and the Sheriff of Richmond County for the sum of seventy-five thousand dollars ($75,000.00), payable to John Michael Brown, P.C., as Attorney for Cheryl Batchelor. WHEREAS,it is in the best interests of Augusta, Georgia to resolve this matter and pay the amount of seventy-five thousand dollars ($75,000.00) to Claimant as set out above to settle all claims of Claimant, including civil claims and workers' compensation claims, against Augusta-Richmond County,Augusta-Richmond County Commission, the Sheriff of Richmond County, and their employees and agents arising out of the facts alleged in said claim: Claimant, a former deputy with the Richmond County Sheriff's Office, alleges that P Y her supervisors participated in and condoned sexual harassment such that she was exposed to a hostile work environment. Claimant also alleges that she was denied a transfer from road patrol after being injured in a training exercise. After said training, Claimant was diagnosed with a meniscus tear and osteoarthritis in her left knee. WHEREAS,Augusta,Georgia acknowledges that the payment set forth herein does not constitute any admission of liability on the part of Augusta, Georgia, the Sheriff of Richmond County, or any of their deputies or employees and liability is expressly denied; NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Commission, Settlement Resolution Batchelor v. Sheriff Richard Roundtree,Case No.2015-RCCV-610 Batchelor v.Richmond County Sheriff et al.,Claim No.2014-013781 Page 1 of 2 .. Section 1: The Augusta, Georgia Commission will settle the claims set forth above for the sum of seventy-five thousand dollars($75,000.00),payable to John Michael Brown, P.C., as Attorney for Cheryl Batchelor. Section 2: The County Administrator is authorized to pay a total sum of seventy-five thousand dollars ($75,000.00), payable to John Michael Brown, P.C., as Attorney for Cheryl Batchelor. Section 3: To the extent that any section of the AUGUSTA,GA.CODE is in conflict herewith, that subsection is waived for this instance only.
