HomeMy WebLinkAboutMEMORANDUM OF UNDERSTANDING BETWEEN AUGUSTA, GEORGIA AND TRANSPORTATION SECURITY ADMINISTRATION MEMORANDUM OF AGREEMENT BETWEEN THE TRANSPORTATION SECURITY ADMINISTRATION AND AUGUSTA, GEORGIA SECTION 1. PARTIES The parties to this MEMORANDUM OF AGREEMENT are the TRANSPORTATION SECURITY ADMINISTRATION (hereinafter referred to as the "TSA") acting by and through the Federal Security Director (hereinafter referred to as "FSD") at the Augusta Regional Airport (AGS), and AUGUSTA, GEORGIA, by and through its Augusta Regional Airport Management (Airport). SECTION 2. AUTHORITY TSA enters into this Memorandum of Agreement (hereinafter referred to as "Agreement") under the provisions of: the Aviation and Transportation Security Act (hereinafter referred to as "ATSA"), Public Law 107-71, in particular 49 U.S.C. §§ 106(1) and (m); and TSA Management Directive No. 1000.2, Interagency Agreements. SECTION 3. PURPOSE The purpose of this Agreement is to set forth terms by which Augusta will provide access,viewing, described on the attached Exhibit A("Covered Equipment")in furtherance of TSA's transportation security mission. SECTION 4. RESPONSIBILITIES RELATED TO PRODUCTION OF VIDEO: 4.1 TSA 4.1.1 Agrees that the Airport will be the owner and custodian of any video media generated from the Covered Equipment, and if TSA receives any third party requests for CCTV video, TSA will forward such requests to the Airport and will not provide a copy of the CCTV video to any third party without the express written permission of the Airport. 4.1.2 Agrees to maintain workstations in a secure location that is not accessible to the public. 4.1.3 Agrees not to disseminate user names and passwords used for accessing the system and prohibit access to unauthorized users. 4.1.4 Agrees to lock workstations when not in use. 4.1.5 Agrees workstations will be used for monitoring only and will remain on a closed network without access to the interne or other unauthorized networks. 4.1.6 Agrees to allow the Airport's IT staff to manage local user accounts and have exclusive administrator privileges to protect the integrity of the Airport network. 4.2 Augusta (Airport): 4.2.1. Agrees to provide TSA 24-hour access to video feeds from Covered Equipment including without limitation from designated CCTV cameras and will provide TSA with access to up to twenty-eight days (28) days of stored images from CCTV cameras, unless prohibited or disrupted by events beyond the Augusta's control. Augusta will monitor the CCTV .J system and increase available disk space when the system is not routinely capturing at least 28 days of video. 4.2.2 Agrees to, where possible, to give TSA courtesy notice before the CCTV system is disabled or other rendered inoperable. 4.2.3 Agrees that CCTV video may contain Sensitive Security Information and will handle, store, and secure all media at all times pursuant to applicable federal, state, and local laws, including without limitation 49 CFR 1520 and 1542. 4.2.4 Agrees to provide routine maintenance,repair,troubleshooting, and service of the system, as needed, and replace cameras, recording and monitoring equipment if needed. SECTION 5. OTHER PROVISIONS The Agreement does not obligate any funds or other fiscal obligations by either party. SECTION 7. EFFECTIVE DATE The terms of this Agreement will become effective on the date the last party signs the Agreement. SECTION 8. MODIFICATION Any modification of this Agreement is invalid unless the modifications are first reviewed and approved by the written mutual consent of TSA and Augusta. SECTION 9. SEVERABILITY Nothing in this Agreement is intended to conflict with current laws or regulations or the directives of the Department of Homeland Security, TSA, or any other Executive Department. If any term of this Agreement is inconsistent with such authority, then that term shall be invalid, but the remaining terms and conditions shall remain in full force and effect. SECTION 10. RIGHTS AND BENEFITS Nothing in this Agreement is intended to diminish or other affect the authority of either TSA or Augusta to carry out their respective statutory, regulatory, or other official functions, nor is intended to create any right or benefit, substantive or procedural, enforceable at law by any party against the United States, its agencies or officers, state agencies, or officers carrying out programs authorized under federal, state, or local law, or any other person. SECTION 11. TERMINATION Any party may terminate the instrument in whole, or in part, at any time by providing thirty (30) days written notice.
