CALLED MEETING COMMISSION CHAMBER
November 27, 2018
Augusta Richmond County Commission convened at 11:00 a.m., Tuesday, November 27,
2018, the Honorable Hardie Davis, Jr., Mayor, presiding.
PRESENT: Hons. Guilfoyle, Sias, Frantom, M. Williams, Davis, Fennoy, D. Williams and
Hasan, members of Augusta Richmond County Commission.
ABSENT: Hon. Clarke, member of Augusta Richmond County Commission.
Mr. Mayor: I’ll call this meeting to order. The Chair recognizes Attorney MacKenzie.
1. LEGAL MEETING
A. Pending and potential litigation
B. Real estate
C. Personnel
Mr. MacKenzie: I would entertain a motion to go into an executive session to
discuss pending and potential litigation, real estate and personnel.
Ms. Davis: So move.
Mr. D. Williams: Second.

Mr. Mayor: The Chair recognizes the commissioner from the 9.
Mr. M. Williams: Thank you, Mr. Mayor. I’ve got no problem going into executive
session but I wanted this session to be with just the attorney and the Commission. I don’t need the
Administrator in this morning unless there’s something that we need to bring her in too to witness
to and to leave after that but this is just for the Commission and the attorney.
Mr. Hasan: Excuse me, Mr. Mayor. Can I ask a question?
Mr. Mayor: Well, you can but you can raise your hand and I’ll recognize you. Okay, direct
your question to the Chair.
Mr. Hasan: Do you mean for the whole process or you mean for a particular item?
Mr. M. Williams: For the whole process.
Mr. Hasan: I’m not sure about that.
Mr. M. Williams: You ain’t got to be sure about it. Check the rules.

Mr. Hasan: I’m not sure about that one. Mr. Mayor, can we get a ruling from the attorney
on that one? Because you’re talking about the whole process. I don’t know; I’m asking.
Mr. Mayor: The Chair recognizes the attorney.
Mr. MacKenzie: Well, the Commission can decide by majority vote who is in and out of
legal.
Mr. M. Williams: I stand to correct that, Mr. Mayor, if I can.
Mr. Mayor: Okay, here’s what we’re going to do. We’re going to, let’s vote. Everybody
vote. What you’re voting on is going into executive session. That’s all you’re voting on. That’s
all you’re voting on.
The Clerk: Oh, you’re just voting on going into legal.
Mr. Mayor: That’s correct. That is all you’re voting on. I mean, finish voting. I’m waiting

Motion carries 8-0.
Mr. Mayor: All right. I’ll see everybody in the executive room.
Mr. M. Williams: Now the executive session don’t include everybody, Mr. Mayor.
Mr. Mayor: (inaudible).
Mr. M. Williams: No, no, we need to talk about that now before we go into legal. I asked
that question here.

2. Motion to authorize execution by the Mayor of the affidavit of compliance with
Georgia’s Open Meeting Act.
Mr. Frantom: I so move.
Ms. Davis: Second.

Mr. Mayor: Voting. All right, commissioner from the 9.
Motion carries 8-0.
Mr. Mayor: Attorney MacKenzie, any other business before us?
Mr. MacKenzie: That’s all I have.
