HomeMy WebLinkAboutLANEY WALKER DEVELOPMENT CORPORATION_ 2016 HOME AGREEMENT_ 1ST AMENDMENT_ 1017 AND 1019 SUMMER STREET FIRST AMENDMENT TO AGREEMENT BETWEEN AUGUSTA, GEORGIA LANEY WALKER DEVELOPMENT CORPORATION FOR 2016 HOME INVESTMENT PARTNERSHIPS PROGRAM This First Amendment to the agreement executed by and between the Parties on January 5, 2017, is made and entered into on the day of March, 2017, by and between AUGUSTA, GEORGIA, (hereafter referred to as "Augusta"), and LANEY WALKER DEVELOPMENT CORPORATION. (herein after referred to as the "LWDC"). WHEREAS, AUGUSTA desires to amend the original agreement to allow Laney Walker Development Corporation to effectively administer its HOME eligible affordable housing development activities; WHEREAS, Laney Walker Development Corporation has determined that this Amendment is in its best interest and has agreed to the said Amendment; NOW THEREFORE, in exchange for their mutual good and valuable consideration, the receipt and sufficiency of which each PARTY acknowledges, and intending to be legally bound, AUGUSTA and LWDC agree to amend said agreement as follows: (1) Article I Section A (a). Project Description. Project addresses shall be amended to delete 1025 Summer Street and add 1017 Summer Street as project specific. B. Use of Funds HOME Program funds shall be used by LWDC for the purposes and objectives stated in Article I, Scope of Services, and Exhibit"A" of the original Agreement. There will be no additional HOME funding for this project. The budget remains as stated in the original agreement. Only change is to the Summer Street addresses: change from 1025Summer Street to 1017 Summer Street. Except for the modifications made by this Amendment, the terms and conditions of the Agreement, as previously amended, shall remain in full force and effect.
