HomeMy WebLinkAboutCalled Commission Meeting October 11, 2016 CALLED MEETING COMMISSION CHAMBER October 11, 2016 Augusta Richmond County Commission convened at 11:00 a.m., Tuesday, October 11, 2016, the Honorable Hardie Davis, Jr., Mayor, presiding. PRESENT: Hons. Lockett, Guilfoyle, Sias, Frantom, M. Williams, Fennoy, D. Williams, Hasan and Davis, members of Augusta Richmond County Commission. ABSENT: Hon. Smith, member of Augusta Richmond County Commission. Mr. Mayor: We’ll call this meeting to order. The Chair recognizes Attorney MacKenzie. 1.LEGAL MEETING A.Pending and potential litigation B.Real estate C.Personnel Mr. MacKenzie: I would entertain a motion to go into an executive session to discuss litigation. Mr. Lockett: So move. Mr. Fennoy: Second. Mr. Mayor: We’ve got a motion and a second. Voting. Mr. Hasan: That’s the only thing we’re discussing? Just litigation. I’m just asking. Mr. MacKenzie: Litigation. If there are any personnel matters or real estate those will be discussed as well. Mr. M. Williams: Well, if you don’t state all that, you’re following your own rules. Is that right, Mr. Mayor? Mr. Mayor: No, sir. Mr. M. Williams: It’s not? Mr. Mayor: Um. No. No, again, I think the attorney is just indicating there’s a specific measure that he wants to talk about regarding litigation but in executive session you’re open to talk about litigation, personnel or real estate. Mr. M. Williams: I need to have (inaudible). I’ve got a personnel matter that I want to discuss in legal so I need to have Ms. Irving to come into that meeting so I can get an update on it. 1 Mr. Mayor: Well, all right. Are you going to vote? Mr. M. Williams: Yeah, I’m voting. Ms. Davis and Mr. Frantom out. Motion carries 7-0. [LEGAL MEETING] Mr. Mayor: Okay, we’ll come back to order. Ms. Bonner, I’m going to in the words of Commissioner Sias I’m going to take a point of personal privilege now and just take a moment to thank Ms. Jackson, EMA Director, Fire Chief Chris James, our staff, our citizens from the great city of Augusta, Georgia and want to let everybody know how proud I am of this city because of their incredible generosity. We were able to serve over 2,600 evacuees from Savannah, Chatham and because of the volunteer efforts of our community, our neighboring communities, we were able to able to not only minister and meet their needs at a critical time in their life but do it in a way that is representative of our city and what it means to be a member of the garden city of Augusta, Georgia and one Augusta. So I want to ask the members of this body if you will just thank everybody for the great work they’ve done. (APPLAUSE) The Chair recognizes Attorney MacKenzie. 2.Motion to authorize execution by the Mayor of the affidavit of compliance with Georgia’s Open Meeting Act. Mr. MacKenzie: I would entertain a motion to execute the closed meeting affidavit. Mr. Lockett: So move. Mr. Fennoy: Second. Mr. Mayor: A motion and a second. Voting. Motion carries 9-0. Mr. Mayor: Attorney MacKenzie. Mr. MacKenzie: I would entertain a motion to approve settlement of the case titled Augusta, Georgia vs. 6613 square feet of right-of-way and 271.45 square feet of temporary construction easement at the property located at 1551 Laney Walker Blvd., case number 2016-RCCV-179 in the aggregate amount of $25,000 which will result in an additional amount of $24,050 to be deposited into the registry of the court. Mr. Lockett: So move. Mr. Fennoy: Second. 2 Mr. Mayor: A motion and a second. Voting. Mr. M. Williams out. Motion carries 8-0. Mr. Mayor: Attorney MacKenzie. Mr. MacKenzie: I would entertain a motion to approve a settlement of all claims of Rocky Thomas in the aggregate amount of $75,000 and authorizing Corvell, the third party administrator for the Workers Compensation program, to disburse this amount. Mr. Lockett: So move. Mr. Fennoy: Second. Mr. Mayor: A motion and a second. Voting. Mr. M. Williams out. Motion carries 8-0. Mr. Mayor: Attorney MacKenzie. Mr. MacKenzie: I would entertain a motion to authorize Bank of America to sell the property located at 2548 Winterville Drive in a short sale and for the remaining proceeds to be provided to Augusta, Georgia. Mr. Lockett: So move. Mr. Fennoy: Second. Mr. Mayor: A motion and a second. Voting. Mr. M. Williams out. Motion carries 8-0. Mr. Mayor: Attorney MacKenzie. Mr. MacKenzie: And finally I would entertain a motion to authorize staff to proceed with foreclosure proceedings with respect to the property located at 3209 Sylvan Court, Augusta, Georgia. Mr. Lockett: So move. Mr. Mayor: A motion and a second. Mr. Fennoy: Second. 3 Mr. Mayor: Voting. Mr. M. Williams out. Motion carries 8-0. Mr. Mayor: Attorney MacKenzie, any other business before us?
