CALLED MEETING COMMISSION CHAMBER
September 28, 2016
Augusta Richmond County Commission convened at 11:00 a.m., Wednesday, September
28, 2016, the Honorable Hardie Davis, Jr., Mayor, presiding.
PRESENT: Hons. Lockett, Guilfoyle, Sias, Frantom, M. Williams, Smith, Fennoy, D.
Williams, Hasan and Davis, members of Augusta Richmond County Commission.
ABSENT: Hon. Smith, member of Augusta Richmond County Commission.
Mr. Mayor: Good morning, everybody. We’ll call this meeting to order. The Chair
recognizes Attorney MacKenzie.
1.LEGAL MEETING

Mr. MacKenzie: I would entertain a motion to go into an executive session to
discuss pending and potential litigation and real estate.
Mr. Fennoy: So move.
Mr. Sias: Second.
Mr. Mayor: Voting.
Mr. M. Williams: I heard potending litigation and real estate but they’ve got personnel on
the agenda and I’m just trying to figure out are we going, we’re not allowed to bring up personnel
when we get there?
Mr. MacKenzie: You can mention personnel if there’s personnel. I didn’t have that in my
–
Mr. M. Williams: It’s on the agenda and I’m figuring out we shorten it and then we vote
on that. That’s why I was confused, Ms. Bonner. Write that down.
The Clerk: You’re confused?
Mr. M. Williams: Yeah, I’m confused. I mean it’s on the agenda, it’s three things. When
he read it out, it was just potential litigation and real estate. So do the agenda mean anything, or
what? I’m tired of these rules changing back and forth every day. So what are we doing?
Somebody tell me, please.
Mr. Fennoy: Won’t know til we get there.

Mr. M. Williams: I can talk about it on the floor. Ain’t (inaudible).
The Clerk: Are you not voting, sir, so I can publish the vote.
Ms. Davis and Mr. Frantom out.
Mr. M. Williams not voting.
Motion carries 7-0.
[EXECUTIVE SESSION]
Mr. Mayor: The Chair recognizes Attorney MacKenzie.
2.Motion to authorize execution by the Mayor of the affidavit of compliance with
Georgia’s Open Meeting Act.
Mr. MacKenzie: I would entertain a motion to execute the closed meeting affidavit.
Mr. Lockett: So move.
Mr. Fennoy: Second.
Mr. Mayor: Voting.
Mr. D. Williams out.
Motion carries 8-0.
Mr. Mayor: Thank you, Ms. Bonner. Attorney MacKenzie.
Mr. MacKenzie: I would entertain a motion to determine that the alley south of
th
Broad Street, east of 12 Street and north of Ellis Street ceased to be used by the public to
extend that no substantial public purpose is served by it and/or it is removed from our
roadway system and it’s in the best interest of the government pursuant to O.C.G.A. 32-7-2
to abandon such property and for it to be quit-claimed to the appropriate parties.
Mr. Lockett: So move.
Mr. Fennoy: Second.
Mr. Mayor: A motion and a second. Voting.
Motion carries 9-0.
Mr. Mayor: Attorney MacKenzie.

Mr. MacKenzie: I would entertain a motion to renew of the lease of the property
known as 925 Laney Walker such that the following suite numbers are included in the lease:
200, 307, 308, 309, 310, 318, 311 and 323 and that the lease remains a month-to-month lease.
Mr. Lockett: So move.
Mr. Fennoy: Second.
Mr. Mayor: A motion and a second. Voting.
Motion carries 9-0.
Mr. Mayor: Thank you, Ms. Bonner. Attorney MacKenzie.
Mr. MacKenzie: And finally we’d entertain a motion to approve acceptance of
$50,000 of insurance proceeds paid on behalf of Ted and Mary Lewis Collins as a result of
an accident which resulted in damage to a fire truck.
Mr. Sias: So move.
Mr. Lockett: Second.
Mr. MacKenzie: -- and to authorize full release executions.
Mr. Mayor: We’ve got a motion and a second. Voting.
Motion carries 9-0.
Mr. Mayor: Attorney MacKenzie, I believe that’s all the business before us. Thank you.
