CALLED MEETING COMMISSION CHAMBER
January 26, 2015
Augusta Richmond County Commission convened at 4:40 p.m., Monday, January 26,
2015, the Honorable Hardie Davis, Jr., Mayor, presiding.
PRESENT: Hons. Lockett, Guilfoyle, Sias, Harris, M. Williams, Fennoy, D. Williams,
Hasan, Davis and Smith, members of Augusta Richmond County Commission.
Mr. Mayor: We’re ready at this time.
1.LEGAL MEETING
A.Pending and potential litigation
B.Real estate
C.Personnel
Mr. MacKenzie: If it is the will of the Commission, I would entertain a motion to go
into a closed legal meeting to discuss pending and potential litigation, real estate and
personnel.
Mr. Hasan: Can I also add to that executive session? Discuss personnel as well?
Mr. MacKenzie: I did include personnel.
Mr. Hasan: Executive?
Mr. M. Williams: But does that include the executive session? We’re going to talk about
personnel in legal but there’s some other issues in personnel that we need an executive session
on and we might have to exclude the attorney on so want to make sure that executive session is a
part of this motion and not just legal to talk about personnel.
Mr. Mayor: So, Commissioner, members of the Commission, I don’t know of a situation
where if we’re talking about personnel matters that we would not want to involve the attorney.
Mr. M. Williams: Well, when you go into executive session, Mr. Mayor, we can as a
Commission talk about personnel among ourselves. We can’t make any motion or can’t vote or
anything like that but the attorney will address those legal issues that he has but we may have
some issues that we can talk about in executive session. Now I can get the attorney to give me a
ruling on what the executive session actually states that we can do or cannot do.
Mr. MacKenzie: Personnel is one of the matters for which the Commission can discuss
in a closed legal meeting and that’s one of the ones that is anticipated to be discussed.
Mr. Mayor: Right.
Mr. M. Williams: With or without?

Mr. Mayor: Well, I think again I think in any moment that we want to ask the attorney to
excuse himself or herself we have the liberty to do that as the Commission.
Mr. M. Williams: And, Mr. Mayor, I’m just trying to be clear because I don’t want to
get, I’d rather get an understanding than get a misunderstanding so if the attorney could tell us
from the procedure he has before him what does executive session say and I think you’re right. I
think we can but I’d like to hear from our legal aspect as to what we can do.
Mr. MacKenzie: One of the proper reasons to close a public meeting is to discuss
personnel. It could be personnel that’s in the Law Department, it could be personnel in any other
department.
Mr. Mayor: We have a motion.
The Clerk: I need one.
Mr. Hasan: Second.
Mr. Mayor: And a second.
The Clerk: Who made the motion?
Mr. Mayor: We had a motion from this side and a second from Commissioner Davis.
The Clerk: Can you identify who? Mr. Harris?
Mr. Harris: I don’t know who did but let’s get it going. Either that or ya’ll are going to
have to bring a pillow out here.
The Clerk: Okay and second, Ms. Davis. Thank you.
Mr. Mayor: We’ll vote by the usual sign. Those in favor will vote yea and those
opposed will vote nay. Commissioner from the fifth, commissioner from the seventh,
commissioner from the tenth, we’re waiting on you to vote.
The Clerk: Mr. Harris.
Mr. Harris: I’m sorry.
Mr. Hasan: Commissioner Lockett’s not here.
Mr. Mayor: Okay. All right.
Mr. Lockett out.
Motion carries 9-0.

2.Motion to authorize execution by the Mayor of the affidavit of compliance with
Georgia’s Open Meeting Act.
Mr. MacKenzie: I would entertain a motion to execute the closed meeting affidavit.
Mr. Sias: So move.
Ms. Davis: Second.
Mr. Mayor: We have a motion and proper second. All those in favor will vote with the
normal sign. Voting.
Mr. Lockett, Mr. Harris and Mr. Smith out.
Motion carries 7-0.
Mr. Mayor: IT staff. We’ve got a problem on my screen and on the other screen. The
individual responses notes Corey Johnson as voting yes. Corey Johnson is no longer a
commissioner. Alvin Mason.
Mr. M. Williams: We’ve got to vote again then. We’ve got to vote again.
The Clerk: No, Mr. Sias. They had corrected it, apparently there was a glitch in this
thing.
Mr. Sias: How did it get to be me?
The Clerk: No, I said, Mr., when you hit your –
Mr. Mayor: For the record, Madam Clerk –
The Clerk: Voting yes, hold on just a minute. Ms. Davis, Mr. Hasan, Mr. Dennis
Williams, Mr. Bill Fennoy, Mr. Marion Williams, Mr. Wayne Guilfoyle, Mr. Sammie Sias. Do
you want to vote, Mr. Harris?
Mr. Harris: I did but I didn’t –
The Clerk: Mr. Harris and Mr. Grady Smith. Mr. Lockett out.

Motion carries 9-0.
Mr. Smith: Did you get my vote?

The Clerk: Yes, I did.
Mr. Smith: Thank you, ma’am.
The Clerk: All right.
Mr. Mayor: Madam Clerk, we can move on to -- we’ve got two more matters before us.
Mr. MacKenzie: I would entertain a motion related to the Airport Director.
Mr. Mayor: The Chair recognizes the Commissioner from the first.
Mr. Fennoy: I’d like to make a motion to approve the agreement to hire Roy
Williams as the Airport Director of the Augusta Regional Airport.
Mr. Mayor: And the second.
Mr. Sias: Second.
Mr. Mayor: All those in favor vote yea and all those opposed vote nay.
Mr. Lockett out.
Motion carries 9-0.
Mr. Mayor: And one more item before us. Thank you, Madam Clerk.
Mr. MacKenzie: I’d entertain a motion related to Evan Joseph.
Mr. Mayor: The Chair recognizes the Commissioner from the third.
Ms. Davis: I’d like to make a motion to approve an increase in salary of Evan
Joseph to $100,500 effective January 31, 2015.
Mr. M. Williams: Second.
Mr. Mayor: Motion and a second. All those in favor will vote yea. All those opposed
vote nay.
Mr. Lockett out.
Motion carries 9-0.
Mr. Mayor: Thank you, Madam Clerk. Members of the commission, this meeting is
hereby adjourned if there be no further business.
