CALLED MEETING COMMISSION CHAMBER
February 4, 2014
Augusta Richmond County Commission convened at 1:15 p.m., Tuesday, February 4,
2014, the Honorable Deke Copenhaver, Mayor, presiding.
PRESENT: Hons. Lockett, Guilfoyle, Mason, D. Smith, Williams, Fennoy, Johnson,
Jackson, Davis and G. Smith, members of Augusta Richmond County Commission.
Mr. Mayor: I’ll go ahead and call this special called legal meeting to order. Ms. Allen,
what do you have first?
Ms. Allen: Yes, sir, Mr. Mayor and members of the Commission. We’re all aware

of the inclement weather situation that we had around the 29, 28, 29 of January and
according to our administrative regulations that we utilize and compensate the employees,
I’ve provided each one of you a copy of that, Section 42 would require Commission
approval in order to actually compensate the staff, Group 1 emergency personnel and
Group 2 non-emergency personnel who actually worked through that event.
It’s the same
process that we went in before and I’m just asking for your approval so that we can actually
compensate the people because I must say I think they did a tremendous job in handling the
inclement weather and I’m so very proud of each and every one of those various departments
who contributed to the success of what we did during that time.
Mr. Mayor: Can I get a motion to approve?
Mr. D. Smith: So move.
Mr. Mason: Second.
Mr. Mayor: We have a motion that’s been made and properly seconded. If there’s no
further discussion, commissioners will now vote by the usual sign. And I would just on a
personal note I know I speak on behalf of the body and say thank you to the, Madam Clerk, you
want to record the vote.
Motion carries 10-0.
Mr. Mayor: -- say thank you to you, Ms. Allen, and the rest to team, to everybody in the
way that you guys handled it. It was amazing. Citizens noticed, they were so proud and I just
want to say thank you.
Ms. Allen: Thank you.
Mr. Mayor: Mr. MacKenzie.

Mr. MacKenzie: I would entertain a motion to go into a closed meeting to discuss
pending and potential litigation, real estate and personnel.
Mr. G. Smith: So move.
Mr. Mayor: We have a motion that’s been made. Is there a second?
Ms. Davis: Second.
Mr. Mayor: We have a motion that’s been made and properly seconded. Commissioner
Williams.
Mr. Williams: Thank you, Mr. Mayor. I have no problem going into legal to discuss
personnel. Can we find out or can you share what it is we talked about because if we’re not
naming any names, I think I talked to Mr. MacKenzie a few minutes ago and if it’s not any
names being named we should handle that here on the floor if I’m not mistaken. But if it’s going
to be a name situation –
Mr. Mayor: Mr. MacKenzie, do you want to –
Mr. MacKenzie: Sure, if I can, I think you’re referring to the interim appointment
positions and Commissioner Williams and I had a discussion before the meeting and I agree that
if there’s no specific individual being discussed with respect to those that those can remain on
the regular agenda.
Mr. Mayor: Okay, we have a motion that’s been made and properly seconded.
Commissioners will now vote by the usual sign.
Motion carries 10-0.
Mr. Mayor: We are in legal.
[LEGAL MEETING]
Mr. Mayor: In the interest of time and as we have a quorum established, I’ll go ahead
and call the legal meeting back to order. Mr. MacKenzie.
2.Motion to authorize execution by the Mayor of the affidavit of compliance with
Georgia’s Open Meeting Act.
Mr. MacKenzie: I would entertain a motion to execute the closed meeting affidavit.
Mr. Lockett: So move.

Mr. Mayor: We have a motion that’s been made and properly seconded. Commissioners
will now vote by the usual sign.
Mr. G. Smith out.
Motion carries 9-0.
Mr. Mayor: Mr. MacKenzie.
Mr. MacKenzie: I would entertain a motion to approve the acquisition of the
property of Nicholas John Deyoe, commonly known as 3389 Tanglewood Drive, Augusta,
Georgia (Tax Map/Parcel 041-1-067) consisting of 0.549 acres for a purchase price of
$60,000.00, in connection with the Marks Church Road Reconstruction Project, and to pay
Mr. Deyoe relocation assistance in the amount of $49,900.00 and his closing costs in
connection with the acquisition of replacement housing as determined at the time of the
closing on the replacement housing and moving expenses.
Mr. Mayor: Can I get a motion to that effect?
Mr. Lockett: So move.
Mr. Johnson: Second.
Mr. Mayor: We have a motion that’s been made and properly seconded. Commissioners
will now vote by the usual sign.
Mr. G. Smith out.
Motion carries 9-0.
Mr. Mayor: Mr. MacKenzie.
Mr. MacKenzie: I would entertain a motion with respect to the Monitor
Manufacturing versus Augusta case.
Mr. Mayor: Commissioner Smith.
Mr. D. Smith: I’d like to make a motion that this body not appeal Judge
Blanchard’s ruling against the government.
Mr. Mayor: Is there a second?
Mr. Jackson: Second.

Mr. Mayor: We have a motion that’s been made and properly seconded. Commissioner
Lockett.
Mr. Lockett: I’d like to make a substitute motion that we deny the appeal, that we fully
comply with the recommendation made by the Board of Assessors because they’re the ones with
the expertise and certification.
Mr. Mayor: And, Commissioner Lockett, just to clarify, the initial motion was made not
to appeal the case. You made a motion to deny the appeal which I think would be actually to
move forward with the appeal, Commissioner Lockett.
Mr. Lockett: Mr. Chairman, let me restate that if I may, please.
Mr. Mayor: Please, if you’d like to amend your motion to say –
Mr. Lockett: Well, first of all, if I may, I would like to get Commissioner Smith’s motion
read by the Clerk, please.
Mr. Mayor: Madam Clerk.
The Deputy Clerk: Mr. Smith’s motion was to not appeal the ruling from Judge
Blanchard.
Mr. Mayor: Okay.
Mr. Lockett: My substitute motion is to appeal based on those facts and those statements
that I made.
Mr. Mayor: Do we have a second for that?
Mr. Williams: Second.
Mr. Mayor: Okay, we have a motion that’s been made and property seconded. If there’s
no further discussion, commissioners will now vote on the substitute motion.
Mr. Guilfoyle, Mr. D. Smith, Mr. Fennoy, Mr. Johnson, Mr. Jackson, Ms. Davis and Mr. G.
Smith vote No.
Motion fails 3-7.
Mr. Mayor: We have a primary motion on the floor. If there’s no further discussion,
commissioners will now vote by the usual sign.
Mr. Lockett votes No.
Motion carries 9-1.
Mr. Mayor: Mr. MacKenzie.

Mr. MacKenzie: That’s all I have, Mr. Mayor, thank you.
Mr. Mayor: With nothing further to come before the body, we stand adjourned.
