5339 Capital Grant

Caption:A motion to approve the Sec. 5339 Augusta Public Transit grant
application between the Federal Transit Administration (FTA)
and Augusta, Georgia.
Background:Regency Boulevard, which leads to the new Transit
Operations/Maintenance Facility in South Augusta.
Analysis:Prior to the maintenance facility being constructed at this site,
this portion of Regency Blvd was only used for patrons of a
nearby movie theater. This part of the roadway was never
designed for large, heavy vehicle traffic such as the transit buses
that will be entering the maintenance facility. This portion of
Regency Blvd will need to be completely removed and rebuilt as
a new roadway. Along with these improvements, new drainage
equipment will be added to solve the existing storm water issues.
This grant will allow Augusta Public Transit to complete this
project.
Financial Impact:FINANCIAL IMPACT: The allocated funding breakdown is:

Approval of Mr. Michael L. Roth to serve as GM for McDonald Transit

Caption:Motion to approve Mr. Michael L. Roth as the new General
Manager for McDonald Transit.
Background:McDonald Transit has notified the Transit Department that Dan
Vander Meer, the person that is serving as General Manager for
Augusta, has been resigned his position due to Family matters.
His last day at Augusta Public Transit is October 5, 2018. They
have proposed Mr. Michael L. Roth as a replacement to serve as
the new General Manager. The Augusta Transit Department has
had an opportunity to review Mr. Roth’s resume and his
qualifications. It was determined that he has the necessary
qualifications to serve in this position.
Analysis:Based on his qualifications the Transit Department has
concluded that he would be an acceptable candidate to serve in
the position of General Manager for McDonald Transit.
Financial Impact:There is no financial impact.
Alternatives:Do not approve the assignment of Mr. Roth as the McDonald
Transit General Manager. This would result in a further search
process for an acceptable candidate.
Recommendation:Approve Mr. Roth to serve in the position of General Manager
for McDonald’s Augusta operation.

Dear Sharon,
As you know our General Manager Dan Vander Meer will be leaving Augusta Public Transit as of Friday
October 5, 2018. The decision to leave did not come as an easy one for Dan but in the end, he has
decided to relocate to Atlanta to take care of family obligations. RATP Dev USA and the Augusta Public
Transit Team are very sad to see Dan go and he will be missed.
Our commitment to the city of Augusta is to provide a qualified replacement to take over for Dan and
we believe we have identified that person. I have attached the resume of Michael L. Roth. Michael
currently serves as the Paratransit Manager for the Greater Dayton Regional Transportation Authority in
Dayton, Ohio. Prior to serving as Paratransit Manager, Michael spent 1"3 years with MV Transportation
serving in various roles from Safety and Training Manager to Operations Manager, to GM and District
Manager for the state of Ohio.
Michael is enthusiastic about joining the Augusta Public Transit Team and I believe he will pick up where
Dan leaves off and continue to lead the organization in a positive direction.

INSTRUCTIONS FOR COMPLETING PROJECT DESCRIPTION
1-5. General Information – Enter the name of applicant organization, address, contact person
and telephone number - if applicant is not the agency which will provide services, please
provide an explanation in your Project Description.
6. Urban Status - An urbanized area has a population of 50,000 or more and is so designated
by the U.S. Bureau of Census. Non-urbanized, rural or small urban area - these terms are
used interchangeably to mean any area outside an urbanized area with a population of
less than 50,000.
7. County (ies) to be served - List the county(s) in which service is to be provided in.
8. Project cost – Enter the total project cost from your estimated budget.
9. Types of service - Demand responsive includes dial-a-ride and door-to-door specialized
service. Fixed route refers to service following an established route or schedule.
10. Operations - Specify the routine hours of service (example: 9:00 a.m. to 3 p.m.) and days of
service (example; Monday to Friday).

provided and demonstrate the fiscal, managerial and operational capabilities of your
organization. Describe the clientele that will be receiving the service; estimate the monthly
number of passenger trips to be provided; document your organizations' ability to provide
transportation service in an efficient and effective manner, including data such as operating
cost/mile, passenger trips/vehicle mile, operating cost/passenger trip and any other
information that reflects the quality and efficiency of your organization; list the type and
number of personnel such as, drivers, dispatchers, mechanics, etc. and if the employees are
paid or are volunteers and if they are full or part time; describe provisions made to ensure
proper maintenance of vehicles and indicate who will provide the maintenance; describe the
driver hiring process and training given to the drivers; specify the percentage and dollar
amount your organization is willing to contribute towards the total cost of your project
(this is also your certification that the local match dollars are available) Once again,
your application will be rated on your response to the elements in part I.D. of this
guide.

STANDARD ASSURANCE OF COMPLIANCE WITH
TITLE VI OF THE CIVIL RIGHTS ACT OF 1964
The _Lower Savannah Council of Government_ (hereinafter referred to as the
(Private Nonprofit or Public Body)
"Recipient") HEREBY AGREES THAT as a condition to receiving any Federal financial assistance from
the Department of Transportation it will comply with Title VI of the Civil Rights Act of 1964, 78 Stat. 252,
42 U.S.C. 2000D-42 U.S.C. 2000D-4 (hereinafter referred to as the Act) and all requirements imposed
by or pursuant to Title 49, Code of Federal Regulations, Department of Transportation, subtitle A, Office
of the Secretary, Part 21, Nondiscrimination Federally-Assisted Programs of the Department of
Transportation - Effectuation of Title VI of the Civil Rights Act of 1964 (hereinafter referred to as the
Regulations) and other pertinent directives, to the end that in accordance with Act, Regulations, and other
pertinent directives, no person in the United States shall, on the grounds of race, color, or national origin,
be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination
under any program or activity for which the Recipient receives Federal financial assistance from the
Department of Transportation, including the Federal Transit Administration (FTA), and HEREBY GIVES
ASSURANCE THAT it will promptly take any measures necessary to effectuate this agreement. This
assurance is required by subsection 21.7(a) (1) of the Regulations.
More specifically and without limiting the above general assurance, the Recipient hereby gives the
following specific assurances with respect to the project:
1. That the Recipient agrees that each "program" and each "facility" as defined in subsections
21.23(e) and 21.23(b) of the Regulations, will be (with regard to a "program") conducted, or will
be (with regard to a "facility") operated in compliance with all requirements imposed by, or
pursuant to, the Regulations.
2. That the Recipient shall insert the following notification in all solicitations for bids for work or
material subject to the Regulations and made in connection with a project under the Federal
Transit Act of 1964, (The FTA Act) and, in adapted form in all proposals for negotiated agree-
ments:
The Recipient, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42
U.S.C. 2000D to 2000D-4 and Title 49, Code of Federal Regulations, Department of
Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-
Assisted Programs of the Department of Transportation issued pursuant to such Act,
hereby notifies all bidders that it will affirmatively insure that in any contract entered into
pursuant to this advertisement, minority business enterprises will be afforded full
opportunity to submit bids in response to this invitation and will not be discriminated
against on the grounds of race, color, or national origin in consideration for an award.
3. That the Recipient shall insert the clauses of Appendix A of this assurance in every contract
subject to the Act and the Regulations.
4. That the Recipient shall insert the clauses of Appendix B of this assurance, as a covenant running
with the land, in any deed from the United States effecting a transfer of real property, structures,
or improvements thereon, or interest therein.
5. That where the Recipient receives Federal financial assistance to construct a facility, or part of a
facility, the assurance shall extend to the entire facility and facilities operated in connection
therewith.

6. That where the Recipient receives Federal financial assistance in the form, or for the acquisition

as a covenant running with the land, in any future deeds, leases, permits, licenses, and similar
agreements entered into by the Recipient with other parties; (a) for the subsequent transfer of
real property acquired or improved under this project, and (b) for the construction or use of or
access to space on, over or under real property acquired, or improved under this project.
8. That this assurance obligates the Recipient for the period during which Federal financial
assistance is extended to the project, except where the Federal financial assistance is to provide,
or is in the form of, personal property, or real property or interest therein or structures or
improvements thereon, in which case the assurance obligates the Recipient or any transferee for
the longer of the following periods: (a) the period during which the property is used for a purpose
for which the Federal financial assistance is extended, or for another purpose involving the
provision of similar services or benefits; or (b) the period during which the Recipient retains
ownership or possession of the property.
9. The Recipient shall provide for such methods of administration for the program as are found by
the Secretary of Transportation or the official to whom he/she delegates specific authority to give
reasonable guarantee that it, other recipients, sub grantees, contractors, subcontractors,
transferees, successors in interest, and other participants of Federal financial assistance under
such program will comply with all requirements imposed or pursuant to the Act, the Regulations
and this assurance.
10. The Recipient agrees that the United States has a right to seek judicial enforcement with regard
to any matter arising under the Act, and Regulations, and this assurance.
THIS ASSURANCE is given in consideration of and for the purpose of obtaining any and all Federal
grants, loans, contracts, property, discounts or other Federal financial assistance extended after the date
hereof to the Recipient by the Department of Transportation under Federal Transit Programs and is
binding on it, other recipients, sub grantees, contractors, subcontractors, transferees, successors in

(Appendix A to Title VI Assurance)
During the performance of this contract, the contractor, for itself, its assignees and successors in interest
(hereinafter referred to as the "contractor") agrees as follows:
1. Compliance with Regulations: The contractor shall comply with the Regulations relative to
nondiscrimination in federally assisted programs of the Department of Transportation (hereinafter
"DOT") Title 49, Code of Federal Regulations, Part 21, as they may be amended from time to time
(hereinafter, referred to as the Regulations), which are herein incorporated by reference and made a
part of this contract.
2. Nondiscrimination: The contractor, with regard to the work performed by it during the contract, shall
not discriminate on the grounds of race, color, sex or national origin in the selection and retention of
subcontractors, including procurement of materials and leases of equipment. The contractor shall
not participate either directly or indirectly in the discrimination prohibited by Section 21.5 of the
Regulations, including employment practices when the contract covers a program set forth in
Appendix B of the Regulations.
3. Solicitations for Subcontracts, Including Procurement of Materials and Equipment: In all
solicitations either by competitive bidding or negotiation made by the contractor for work to be
performed under a subcontract, including procurement of materials or leases of equipment, each
potential subcontractor or supplier shall be notified by the contractor of the contractor's obligations
under this contract and the Regulations relative to nondiscrimination on the grounds of race, color, or
national origin.
4. Information and Reports: The contractor shall provide all information and reports required by the
Regulations or directives issued pursuant thereto, and shall permit access to its books, records,
accounts, other sources of information, and its facilities as may be determined by the Recipient or the
Federal Transit Administration (FTA) to be pertinent to ascertain compliance with such Regulations,
orders and instructions. Where any information is required or a contractor is in the exclusive
possession of another who fails or refuses to furnish this information, the contractor shall so certify to
the Recipient, or the Federal Transit Administration, as appropriate, and shall set forth what efforts it
has made to obtain the information.
5. Sanctions for Noncompliance: In the event of the contractor's noncompliance with the
nondiscrimination provisions of this contract, the Recipient shall impose such contract sanctions as it
or the Federal Transit Administration may determine to be appropriate, including, but not limited to:
a. Withholding of payments to the contractor under the contract until the contractor complies, and/or
b. Cancellation, termination or suspension of the contract in whole or in part.
6. Incorporation of Provisions: The contractor shall include provisions of paragraphs (1) through (5)
in every subcontract, including procurement of materials and leases of equipment, unless exempt by
the regulations, or directives issued pursuant thereto. The contractor shall take such action with
respect to any subcontract or procurement as the Recipient or the Urban Mass Transportation
Administration may direct as a means of enforcing such provisions including sanctions for non-
compliance: Provided, however, that, in the event a contractor becomes involved in, or is threatened
with litigation with a subcontractor or supplier as a result of such direction, the contractor may request
the Recipient to enter into such litigation to protect the interests of the Recipient, and, in addition, the
contractor may request the United States to enter into such litigation to protect the interests of the
United States.

The following clauses shall be included in any and all deeds effecting or recording the transfer of real
property, structures or improvements thereon, or interest therein from the United States.
(GRANTING CLAUSE)
NOW, THEREFORE, the Department of Transportation, as authorized by law, and upon the condition
that the Recipient will accept title to the lands and maintain the project constructed thereon, in accordance
with the Federal Transit Act and the policies and procedures prescribed by the Federal Transit
Administration of the Department of Transportation and, also in compliance with all requirements imposed
by or pursuant to Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office
of Secretary, Part 21, Nondiscrimination in federally-assisted programs of the Department of
Transportation (hereinafter referred to as to the Regulations) pertaining to and effectuating the provisions
of Title VI of the Civil Rights Act of 1964 (78 Stat. 252; 42 U.S.C. 2000D TO 2000D-4), does hereby
remise, release, quitclaim and convey unto the
______Augusta Metropolitan Planning Organization_ (hereinafter referred to as the
(Name of Applicant)
"Recipient") all the right, title, and interest of the Department of Transportation in and to said lands
described in Exhibit "A" attached hereto and made a part hereof.
(HABENDUM CLAUSE)
TO HAVE AND TO HOLD said lands and interests therein unto the Recipient and its successors forever,
subject, however, to the covenants, conditions, restrictions and reservations herein contained as follows,
which will remain in effect for the period during which the real property or structures are used for a purpose
for which Federal financial assistance is extended or for another purpose involving the provision of similar
services or benefits and shall be binding on the Recipient, its successors and assigns.
The Recipient, in consideration of the conveyance of said lands and interests in lands, does hereby
covenant and agree as a covenant running with the land for itself, it successors and assigns, that (1) no
person shall on the grounds of race, color, or national origin, be excluded from participation in, be denied
the benefits of, or be otherwise subjected to discrimination with regard to any facility located wholly or in
part on, over and under such land hereby conveyed (,) (and)* (2) that the Recipient shall use the lands
and interests in lands so conveyed, in compliance with all requirements imposed or pursuant to Title 49,
Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21,
Nondiscrimination in federally-assisted programs of the Department of Transportation - Effectuation of
Title VI of the Civil Rights Act of 1964, and as said Regulations may be amended (,) and (3) that in the
event of breach of any of the above-mentioned nondiscrimination conditions, the Department shall have
a right to re-enter said lands and facilities on said land, and the above described land and facilities shall
thereon revert to and vest in and become the absolute property of the Department of Transportation and
its assigns as such interest existed prior to this instruction.*
*Reverter clause and related language to be used only when it is determined that such a clause is

and agree (in the case of deeds and leases add "as a covenant running with the land") that (1) no person on the
ground of race, color, or national origin shall be excluded from participation in, be denied the benefits of, or be
otherwise subjected to discrimination in the use of said facilities, (2) that in the construction of any improvements
on, over, or under such land and the furnishing of services thereon, no person on the ground of race, color, or
national origin shall be excluded from participation in, be denied the benefits of, or be otherwise subjected to
discrimination and (3) that the (grantee, licensee, lessee, permittee, etc.) shall use the premises in compliance
with all other requirements imposed by or pursuant to Title 49, Code of Federal Regulations, Department of
Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-Assisted Programs of
the Department of Transportation - Effectuation of Title VI of the Civil Rights Act of 1964), and as said Regulations
may be amended.

DEFINITIONS
Applicant - A private nonprofit organization or public body which applies to the department for
financial assistance under the Section 16 capital assistance program.
Capital Equipment - Vehicles and ancillary support equipment with a multi-year usable life. For
the purpose of this program this includes, but is not limited to vehicles, radios, passenger shelters,
etc.
Elderly Person - All persons age 60 and over.
Eligible Services - Transportation services intended for regular non-emergency passenger use
with priority given to the elderly and disabled. Other services (e.g., special charters) are allowed,
however, these must be incidental and not in conflict with regular schedules or services.
Disabled Person - Individuals who, by reason of illness, injury, age, congenital malfunction, or
other permanent or temporary incapacity or disability, including those who are non-ambulatory
wheelchair bound and those with semi-ambulatory capabilities are unable, without special
facilities or special planning or design, to utilize mass transportation facilities and services
effectively.
Incidental Use - The use of equipment or facilities purchased under this grant program for other
than principle grant related purposes.
Metropolitan Planning Organization (MPO) - Organizations designated by the Governor which,
together with the state, are responsible for transportation planning in urbanized areas.
Program of Projects means a list of projects to be funded in the grant application submitted to
FTA by a State. The program of projects (POP) lists the sub recipients and indicates whether
they are private non-profit agencies or local government authorities, designates the areas served
(including rural areas), and identifies any tribal entities. In addition, the POP includes a brief
description of the projects, total project cost and Federal share for each project, and the amount
of funds used for program administration from the 10 percent allowed.
Human Service Transportation means transportation services provided by or on behalf of a
human service agency to provide access to agency services and/or to meet the basic, day-to-day
mobility needs of transportation-disadvantaged populations, especially individuals with
disabilities, older adults, and people with low incomes.
Locally Developed Coordinated Public Transit-Human Services Transportation Plan means a plan
that identifies the transportation needs of individuals with disabilities, older adults, and people with
low incomes, provides strategies for meeting those local needs, and prioritizes transportation
services for funding and implementation.
Minority Communities – A community that has a percentage of minority population greater than
the percentage of minority population in the state.

Minority Individual – A person whose origins are in any of the black racial groups of Africa; a
person of Mexican, Puerto Rican, Cuban, Central or South American, or other Spanish or
Portuguese culture or origin regardless of race; a person who is an American Indian, Eskimo,
Aleut, or Native Hawaiian; a person whose origins are from Japan, China, Taiwan, Korea,
Vietnam, Laos, Cambodia, the Philippines, Samoa, Guam, the US Trust Territories of the Pacific,
or the Northern Marianas; or a person whose origins are from India, Pakistan, or Bangladesh.
Minority Organization – A small business concern which is at least 51 percent owned by one or
more minority individuals or, in the case of a publicly owned business, at least 51 percent of the
stock of which is owned by one or more minority individuals, and whose management and daily
business operations are controlled by one or more of the minority owners.
Nonprofit Organization - A corporation or association determined by the Secretary of the Treasury
to be an organization described by 26 USC Section 501(C) which is exempt from taxation under
Section 501(a) or 101 or one which has been determined under state law to be nonprofit and for
which the department has received documentation certifying the status of nonprofit organization.
Non-Urbanized Areas - Areas with a population of less than 50,000.
Private - means nonpublic, to wit: bodies which are not municipalities or other political
subdivisions of states; are not public agencies or instrumentalities of one or more states; are not
Indian tribes; are not public corporations, boards, or commissions established under the law of
any state; or are not subject to control by public authority, state or municipal.
Recipient - An applicant which has been awarded financial assistance under the Section
5310/5317 capital assistance program.
Sub-Recipient – means a private non-profit organization, if the public transportation service
provided is unavailable, insufficient, or inappropriate; or a governmental authority that is approved
by the State to coordinate services for elderly individuals and individuals with disabilities or
certifies that there is not any non-profit organizations readily available in the area to provide
services.
Service Area – Is the geographic area which elderly and disabled clients will be served using
funds from this grant.
Transportation Improvement Program (TIP) - A list of transportation projects for which funding will
be sought over a three to five year period prepared by the MPO representing an urbanized area.
Urbanized Areas - Areas designated by the Bureau of Census, with a population of 50,000 or
more.

between the Georgia Department of Transportation and the

Background:This grant is allocated each fiscal year and assists in funding
several planning aspects within the Metropolitan Planning
Agency (MPO) such as: Augusta Regional Transportation Study,
Congestion Management Plan, Long Range Transportation Plan
and local roadway construction…. The grant requires a 20 %
local match.
Analysis:Under the supervision of the Georgia Department of
Transportation, the APDD must provide planning services to
accomplish the work as stated in the Work Program.
Financial Impact:This contract is an 80/20 match with the local match share of
$39,440.96 for a total allocated amount of $197,204.96…. At
this time, we are also requesting a 2018 Budget Amendment to
increase the current local match of $20,910 by an additional
$20,000 for a total local match of $40,910.
Alternatives:Not executing this grant would result in the loss of funding for
future roadway development and key studies for the areas that
the MPO services which include: City of Blythe, City of
Hephzibah, Augusta,GA., City of Grovetown, Augusta Public
Transit, City of North Augusta, SC City of Aiken, SC, Aiken
County, SC, Town of Burnsettown, SC, Town of New Ellenton,
Edgefield County, SC Best Friends Express, and Lower
Savannah Council of Government.

INTRODUCTION
1. Purpose of the Unified Planning Work Program
The Unified Planning Work Program (UPWP) is the annual work program for transportation and transit
planning activities in the Augusta Regional Transportation Study (ARTS) area. The UPWP includes an
overview of the ARTS transportation planning process and a description of each work element for Fiscal
Year FY-2019 (July 1 – June 30).
Work elements, tasks, activities, programs and projects are categorized in the following functional areas:
Program Administration, Public Involvement, Transportation Data Collection and Analysis,
Transportation System Planning, Public Transit and Paratransit, Performance Based Planning, and
Transportation Improvement Program. Special emphasis will be placed on the following areas:
· Congestion Management Process Update (CMP);
· Performance Based Planning relating to CMP Update and 2045 LRTP; ,
· Stakeholder involvement for freight, safety and security coordination and participation in CMP
Update and 2045 LRTP including Freight Plan Update;
· Annual demographic and growth trends report – update regional transportation system
database that includes monitoring and updating socio-economic and land use data;
· Updating the regional transportation geographic information system (GIS) database and
mapping;
· Corridor/Area planning;
· Coordinated Human Services Plan - framework to identify needs and coordinate stakeholders;
· Enhance public transit planning for fixed route bus, paratransit demand response and enhance
mobility for seniors and persons with disabilities;
· Regional Special Transportation Studies – Complete CMP Update, Initiate 2045 LRTP including
Freight Plan and Bicycle and Pedestrian Plan Update , Central Martinez Area Access Management
Plan for Columbia County, and Corridor Planning in Richmond and Columbia Counties;
· Implementing local and regional air quality initiatives for Aiken Co., SC;
2. ARTS MPO Overview
The Augusta Regional Transportation Study (ARTS) is the transportation planning process established for
the Augusta – Richmond, GA – Aiken SC urbanized area. The Federal-Aid Highway Act of 1962 established
the requirement for transportation planning in urban areas throughout the country. On July 6, 2012,
Moving Ahead for Progress in the 21st Century (MAP-21) was enacted reauthorizing federal-aid surface
transportation programs through fiscal year 2014. Subsequently, the Fixing America’s Surface
Transportation (FAST) Act passed on December 4, 2015 (Pub. L. No. 114-94) reauthorized federal- aid
funding, and regulations for the metropolitan transportation planning process.
The FAST Act establishes the Nationally Significant Freight and Highway Projects (NSFHP) to provide
financial assistance – competitive grants, known as Infrastructure for Rebuilding America Program
(INFRA) grants, or credit assistance – to nationally and regionally significant freight and highway projects
that align with the program goals to:

· Improve the safety, efficiency, and reliability of the movement of freight and people;
· Generate national or regional economic benefits and an increase in global economic
competitiveness of the U.S.;
· Reduce highway congestion and bottlenecks;
· Improve connectivity between modes of freight transportation;
· Enhance the resiliency of critical highway infrastructure and help protect the environment;
· Improve roadways vital to national energy security;
· Address the impact of population growth on the movement of people and freight.
In keeping with the original federal mandate, the ARTS metropolitan transportation planning process is
cooperative, continuous, and comprehensive. The ARTS MPO planning process is cooperative because it
brings together local elected officials, state and federal transportation personnel, citizens, and other
interested parties to plan and program transportation projects. ARTS participants continuously evaluate
transportation needs and plan for long-term improvements. The ARTS process is comprehensive because
it considers all modes of transportation, including cars, trucks, buses, airplanes, railroads, public transit,
bicycles, and pedestrians.
The ARTS metropolitan planning area includes the urbanized area of the Augusta Richmond County
Georgia – Aiken County South Carolina Metropolitan Statistical Area (MSA), as defined by the U. S.
Bureau of Census, and the area expected to be urbanized over the next twenty years. The study area
includes Richmond Co. and the urbanized area of Columbia Co. in Georgia, Fort Gordon; and the
urbanized area of Aiken and Edgefield Counties in South Carolina. Incorporated places within the study
area include four (4) cities in Georgia; Augusta, Hephzibah, Blythe and Grovetown; and four (4) cities in
South Carolina: Aiken, North Augusta, Burnettown and New Ellenton. The study area boundaries
reflecting regional growth based on the 2010 Decennial Census were modified and adopted by the Policy
Committee on March 7, 2013 (Figure 1).
3. Organizational Structure
The ARTS MPO consists of several committees that review and approve all amendments to the TIP/LRTP.
The current structure of the meetings is quarterly, with each committee meeting a month before the
subsequent committee. The role of each committee is described below.
Test Network Subcommittee (TNS) – made up of planners and engineers from the two states, local
governments in the study area and regional planning agencies. The TNS committee is the first to discuss
the merits of a project and associated phasing and costs. Any technical considerations not previously
identified by ARTS staff is brought up at the meeting. This is also an opportunity for project sponsors to
ask questions related to the project moving through the amendment process.
Technical Coordinating Committee (TCC) – made up of planners and engineers from the two states, the
local governments in the study area and two regional planning agencies. The final draft detailed
information on a project is presented to the committee for recommended approval to the Citizens
Advisory Committee.
Citizens Advisory Committee (CAC) – made up of citizens representing the jurisdictions and communities
in the study area. The CAC provides local knowledge and citizen input on the projects and makes
recommendations on the same to the Policy Committee.

Citizens Advisory Committee (CAC) Subcommittee – made up of citizens representing veterans, persons
with disabilities, rural transportation, and private transportation providers. The CAC Standing
Subcommittee provides local knowledge and citizen input on the transportation planning process and
transportation improvement program.
South Carolina Technical Coordinating Committee – subcommittee for the South Carolina portion of the
ARTS area made up of planners and engineers from the SCDOT and local governments. Final draft
detailed information on a project is presented to the committee for recommended approval to the other
ARTS MPO committees and the South Carolina Policy Subcommittee.
South Carolina Bicycle and Pedestrian Advocacy Committee (BPAC) – subcommittee for the South
Carolina portion of ARTS made up of citizens, SC ARTS staff (ex-officio members), and other local officials
(ex-officio members) advocating for bicycle and pedestrian transportation. This committee considers
standalone projects as well as the bicycle and pedestrian or other multimodal transportation projects.
South Carolina Policy Subcommittee – includes local elected and appointed officials from the South
Carolina portion of the ARTS area. The committee endorses projects for inclusion in the TIP and LRTP.
Policy Committee - voting members include elected officials from each local government in the study
area, representatives from the Georgia and South Carolina Departments of Transportation, the Fort
Gordon Garrison Commander and representatives of providers of public transportation. The Policy
Committee is responsible for making the final decision on ARTS planning and programming issues,
including amendments to the LRTP and TIP.

6. Transportation Planning Priorities
The 2040 LRTP identified specific priorities for the regional transportation priorities. These priorities
were identified through Travel Behavior Surveys conducted during the planning process and reflects the
plan’s goals and FHWA Planning Emphasis Areas. As a result, the following priorities are important to
improving the study area’s transportation system and relate to the 2040 LRTP Goals and FHWA Planning
Emphasis Areas:
Congestion Management Process (CMP) – Monitoring traffic congestion and improving the efficiency of
the existing transportation network is important to regional travel in the study area. During FY 2018,
ARTS staff procured professional consultant(s) to update the CMP to align with federal guidelines for
congestion management and performance based planning. This work will be completed in in FY 2019
(See Work Element 4.4.1). ARTS staff will work with regional planners, engineers, other transportation
interest groups in ongoing efforts in preparing the annual CMP monitoring report and data collection
related to traffic safety, accidents, traffic counts and travel time data and GIS spatial analysis; and
enhance efforts to move towards advance corridor planning on regional congested corridors prior to
projects moving from the LRTP into the TIP. Additionally, the MPO staff continuously monitor congestion
in this region and produce an annual report. These activities can and will factor in monitoring the CMP
and for future updates. By updating the Congestion Management Process, more defined information
will be available from the CMP and LRTP allowing for better concept sketching before a project moves
into engineering.
2045 Long-Range Transportation Plan Update – the 2045 Long-Range Transportation Plan update is due
in September 2020. This update will begin during the FY 2019 and will contain updates that are necessary
in response to changing transportation needs and priorities, and conform to transportation planning
regulations. The MPO will procure a consultant to complete the update and its various components
including the following areas: Freight Plan Update, Bicycle and Pedestrian Plan Update, Project
Prioritization and Performance Measures as required by the FAST Act.
Corridor Planning - The purpose of corridor planning is to analyze traffic and travel conditions along
major transportation corridors and sub-areas, development impact and land use patterns on existing
and future transportation system. In addition to determining the potential growth, traffic flow, safety,
multimodal mobility and transportation infrastructure needs for short and long-term improvements. The
important study themes are reducing/mitigating congestion and improve traffic safety; increased
mobility during peak travel times; optimizing the relationship between land use and transportation;
access management, complete streets, enhance multimodal systems and connectivity; evaluate existing
and future travel; and analyze the need and location for intersection improvements.
ARTS staff will continue to work with county planning and engineering departments in Richmond and
Columbia Counties to integrate of land use and transportation planning. Additionally, the ARTS MPO
will complete the Central Martinez Area Access Management Plan – Columbia County Corridor Planning.
In Richmond County, two corridors, Peach Orchard Road and Gordon Highway, have been identified for
funding as Unfunded Priority to address multimodal transportation access, land development, road
maintenance and traffic safety.

Public Transportation – The MPO and local transit providers are challenged to increase the use of public
transportation in an era with land use patterns that encourage strip development, mandates for new
services, increasing elderly, retiree and veteran population groups, compounded with tight operating
budgets. Providing transportation services for the disabled and the environmental justice population to
meet demand of medical trips and workforce development was a priority in FY 2018 through the
development of a Coordinated Human Services Plan. During FY 2019, the ARTS transportation planning
staff will continue to strive to provide access to essential services for Low-income, Minorities,
Environmental Justice, Seniors and Individuals with Disabilities through better utilization of FTA Section
5310 funds to support mobility management and enhance transit service for seniors and disabled
persons provided by APT and LSCOG. Additionally, the continued use of paratransit services within the
¾ mile buffer along fixed routes will be expanded by the new GIS address database. Both programs
support regional transit improvements and the regional model of cooperation.
During FY 2019, ARTS staff will continue ongoing FTA grant administration for Section 5310, provide
technical support to the TCA, and assist APT with developing an implementation strategy for transit
service improvements identified in their current COA, transit asset management, monitor transit
ridership and service operation data to develop performance measures and target setting. ARTS will
also work with APT, LSCOG, Central Savannah River Area – Agency on Aging, Aiken County Agency on
Aging and other social service agencies to address transit issues for the elderly and persons with
disabilities through the implementation of the recently completed Coordinated Human Services
Transportation Plan.
Performance Based Planning Programming – The integration of performance management concepts
into the existing federally required transportation planning and programming processes involves using
data to support long-range and short-range investment decision-making. For the FHWA, FAST Act
establishes the following National Performance Goals for Federal highway programs: safety,
infrastructure condition, congestion reduction, system reliability, freight movement and economic
vitality, environmental sustainability and reducing project delivery delays.
In the ARTS MPO, the Safety Performance measures provided by GDOT and SCDOT will be adopted by
the MPO every year by the end of February. Additionally, the ARTS MPO is working with GDOT, SCDOT,
FHWA and FTA on the further development of future performance measures for roads and bridges,
highway asset management, system performance and MPO coordination. The PBPP will be added to the
2040 Long-Range Transportation Plan and the 2017-2022 Transportation Improvement Plan as more
information on the other Performance Measures are received from GDOT and SCDOT.
Coordinating Land Use and Transportation – Coordinating land use and transportation improvements
is important given expected regional development patterns. In FY 2019, ARTS continued to collect
certificate of occupancy for residential and commercial development to track land development and
update the GIS spatial analysis and map. ARTS will continue these tasks and work with Aiken County,
Edgefield County and Columbia County and other cities to improve data collection, analysis and
reporting. This data analysis is part of the Regional Transportation System GIS Database. ARTS will
continue efforts to develop an Annual Growth Trends Report to update socio-economic demographic
data and location of new businesses and employment centers by TAZ for the regional travel model.

In FY 2019, the MPO will work closely with local planning and development organizations to monitor
updates to land use plans; reviewing site plans for regional model for existing or future traffic generators;
utilize area zoning maps to update the existing regional land use map; develop a future regional land use
GIS map and spatial analysis; develop and promote best land use practices that support sustainable
development; reduce transportation impacts and enhance land use and transportation integration near
employment/retail/commercial activity nodes along regional transportation corridors. ARTS will identify
feasible redevelopment alternatives to strip development that enhance opportunity for redevelopment
along regional corridors and other highway improvements included in the TIP. Coordinating Land Use
and Transportation is an important component of the Long-Range Transportation Plan since it provides
an opportunity to analysis the effects of growth, develop policy responses to regional issues, and
determine the demand for public facilities. Additionally, Coordinating Land Use and Transportation
enables local, regional and federal agencies to address access management, right-of-way concerns,
utilities and stormwater issues using common expectations about future growth and development.
Intermodal Connections and Safety – Due to the presence of at-grade railroad crossings on roads
throughout the study area there are many opportunities for conflicts between trains, vehicles and
alternative modes of transportation. Cooperation between the railroads, transportation agencies and
local governments are pertinent in resolving this long-term problem and improve traffic safety. ARTS
staff will continue to work with the Technical Coordinating Committee (TCC), Policy Committee, and the
Chambers of Commerce to identify key stakeholders from railroad companies, trucking, other freight
interest groups and large industries to encourage participation in the metropolitan planning process.

TASK 1.3 - Unified Planning Work Program (44.21.00)
Purpose: The Unified Planning Work Program (UPWP) defines all ARTS planning activities, which will be
undertaken in any given fiscal year. The UPWP, which identifies the various agencies that will perform
each activity and determines sources of funding for study activities, will be prepared in conformance
with Federal regulations.
Activities involved in preparing the UPWP include a review of planning issues, development of goals and
objectives to address those issues, and development of a planning program, which meets the stated
goals and objectives. The planning program must be assigned to the proper study participants and
funding for the program must be secured.

WORK ELEMENT 2 – PUBLIC INVOLVEMENT
TASK 2.1 - Community Outreach/Education (44.21.00)
Purpose: To provide information to ARTS participants and the general public about the transportation
planning process, to respond to requests for information from the public, and to foster meaningful public
input into all transportation plans, programs and projects.
Public involvement is integral to the success of the regional transportation planning process. The ARTS
Participation Plan, adopted by the Policy Committee on June 4, 2007 and amended on September 6,
2012 and December 7, 2017. The Plan guides community outreach, education and public input into the
regional transportation planning process. It also includes the steps to be taken to consult with other

TASK 3.1 - Socioeconomic Data/Environmental Justice (EJ) (44.22)
Purpose: Maintain a comprehensive, up-to-date socioeconomic database for the transportation
planning process. Activity under this work element will focus on maintaining and updating the
socioeconomic data needed for the ARTS travel demand model and the provision of Essential Services
to all under-served populations
The socioeconomic characteristics used in the ARTS travel demand model will be updated and major
land use data is analyzed to track changes to TAZ centroids. The EJ data is used to assess the impact of
transportation projects on all under-served populations. The basic socioeconomic data is aggregated at
the traffic zone level. EJ data will be aggregated at the Census Tract level. The MPO, with assistance from
Columbia County, Georgia, will continue to maintain the data for the Georgia portion of the study area.
Aiken County and the Lower Savannah COG, with assistance from ARTS staff, will maintain the data for
the South Carolina portion of the ARTS area. The Georgia Department of Transportation will continue to
maintain the ARTS travel demand model.

Purpose: Identify residential, employment, and transportation patterns for access to Essential Services
for all under-served populations, as defined under Executive Order 12898 and Title VI of the 1964 Civil
Rights Act, and address those needs by increasing the partnerships with the organizations that serve
them. Title VI complaint process has been adopted by ARTS and APT to ensure all individuals the rights
and opportunities wishing to participate in the department’s programs are given an equal chance to
participate and/or receive departmental services or benefits. ARTS and APT jointly updated the Title VI
Program for Augusta Georgia to comply with FTA regulations and guidance of (49 CFR part 21) in
accordance with Circular FTA C4702.1 B issued October 1, 2012.

Purpose: To implement existing congestion mitigation strategies and projects identified in the 2040 Long
Range Plan; and travel data collection. This work element will be integrated with Performance Based
Planning. These work activities are included in Work Element 4.5.1 Special Transportation Studies –
Congestion Management Process Update.
A Congestion Management Process (CMP) an integral transportation planning process in the ARTS area.
The purpose of the ARTS CMP is to document traffic congestion on major transportation corridors in the
study area, identify and implement strategies for reducing or eliminating the congestion, and track
and/or program the implementation of congestion mitigation projects. Activities under this work
element will include completing the annual traffic congestion data collection and spatial analysis of travel

TASK 4.2.1 - Air Quality Issues
Purpose: To monitor relevant air quality data and regulations, coordinate the work of the CSRA Air
Quality Alliance, help implement local and regional air quality initiatives, keep local stakeholders
informed about air quality issues and participate in air quality training.
ARTS will focus work on efforts to improve Air Quality by increasing access to public transit, connecting
public transit to bicycle path and installing bicycle racks in activity centers, and linking public transit to
park and ride lots throughout the region. Rideshare and carpool programs are being researched to
promote and market to regional businesses and universities.
Previous Work:
ARTS staff continue to monitor and dialogue with industry leaders, regional, state and local government
officials, local school officials, the Bureau of Air Quality with South Carolina Department of Health and
Environmental Control, local Chambers of Commerce, Economic Development agencies, and local
citizens in order to stay abreast of and disseminate pertinent information regarding air quality and
regional initiatives. Other types of activities undertaken by ARTS staff include:
1. Maintained ARTS web site and updated information pertaining to Air Quality from the Bureau
of Air Quality with South Carolina Department of Health and Environmental Control.
2. Distributed Air quality information at special events in the Augusta-Aiken area.
3. Attended, coordinated and hosted periodic meetings of the Air Quality Alliance.
4. Continued to monitor air quality data and changes in federal air quality regulations.
5. Provided ARTS committees and other stakeholders with regular updates on the Air Quality
Alliance and air quality issues and initiatives.
6. Disseminated information on air quality issues and tips for improving air quality through the
ARTS newsletter and the website.
ARTS staff attends state Air Quality Summits conducted by South Carolina Department of Health and
Environmental Control and shares best practices with other Air Quality Alliances. These best practices
include ways to promote alternative transportation options and energy conservation:
1. Carpooling, ridesharing, and combining trips and limit unnecessary ones
2. Keep your vehicle properly maintained and saving electricity

TASK 4.3 - Intermodal Planning (44.23.01)
Purpose: To incorporate bicycle, pedestrian, public transit, freight and non-motorized transportation
planning activities into the overall ARTS transportation planning process. To implement projects that
resolve conflicts between modes of transportation, such as rail / highway conflicts, and projects that
improve connections and travel alternatives among modes of transportation.
This work element will be used to foster a transportation system that accommodates bicycle, pedestrian,
public transit, freight and other non-motorized means of transportation. Activity under this work
element will focus on evaluating the highway and rail conflicts in the ARTS area, to address the efficient
movement of freight, to identify possible solutions to problem locations as they are related to intermodal
connections, and to improve safety for non-motorized travel.
To make the ARTS transportation system more intermodal through implementing the regional Bicycle
and Pedestrian Plan. This plan prioritized proposed projects based on numerous factors identified by
local stakeholders. The plan recommends local governments strengthen policies related to:
1. Bicycle paths and parking
2. Pedestrian facilities
3. Regional connectivity
4. Bicycle and Pedestrian Safety and Education Outreach
The implementation of the Bicycle and Pedestrian Plan will be pursued by ARTS MPO committees as
projects in the Transportation Improvement Program progress preliminary engineering and all
subsequent phases of work during the project implementation.

1. The 2040 LRTP and FY 2018-2022 TIP update includes future transportation projects on

TASK 4.4.2 - Special Transportation Studies – Central Martinez Area Access
Management Plan – Columbia County Corridor Planning
Purpose: The purpose of corridor planning is to analyze traffic and travel conditions along major
transportation corridors and sub-areas, the impact of development and land use patterns on existing
and future transportation system. In addition to determining the potential growth, traffic flow, safety,
multimodal mobility and transportation infrastructure needs for short and long-term improvements,
important study themes include the following:
1. Reduce/mitigate congestion and improve traffic safety
2. Increase mobility during peak travel times
3. Optimize the relationship between land use and transportation
4. Determine the location and feasibility of other multimodal systems
5. Evaluate existing and future travel
6. Analyze the need and location for intersection improvements
This work task proposes to hire consultants to conduct the Central Martinez Area Access Management
Plan for Columbia County, GA. The project will included but not limited to: land use development
policies, identify access management practices, traffic analysis, capacity analyses, micro-simulation
modeling, signal warrants, and concept drawings suitable for presentations to stakeholders, business
and property owners, local and state elected officials and the public, to implement infrastructure
improvements in the Central Martinez commercial area. This study will produce recommendations of
transportation improvements projects to present to the ARTS MPO committees and Georgia Department
of Transportation to amend the 2040 LRTP.
Study Area: The study area includes the 1.2-mile stretch of Washington Road (SR 104) between Flowing
Wells Road and Davis Road; 0.45 mile of Columbia Road (SR 232) between Flowing Wells Road and
Washington Road; 0.2 miles of Old Evans Road from Martinez Boulevard to Washington Road; and a 0.75
mile of Bobby Jones Expressway (SR 232) from Washington Road to Old Trail Road. This area includes
three (3) regional CMP corridors as defined in the ARTS MPO 2040 LRTP and Congestion Management
System and Monitoring Report -2014: Washington Road (SR 104), Columbia Road (SR 232) and I-
520/Bobby Jones Expressway.
FY 2019 Work Activities and Schedule: The Augusta Planning and Development Department with
assistance from the Procurement Department will lead the procurement process to secure professional
consultants to conduct thorough analysis and plan for major corridors and sub-area in the Martinez Area
of Columbia County. The Columbia County Engineering Division and Planning Division staff will assist
APDD with Project Management and Technical oversight. This project will be integrated with the 2045
LRTP Performance Based Multimodal Plan.

TASK 6.1 - Performance Based Planning (44.24.00)
Purpose: Performance-based planning and programming (PBPP) refers to the application of performance
management principles within the planning and programming processes of transportation agencies to
achieve desired performance outcomes for the multimodal transportation system. PBPP attempts to
ensure that transportation investment decisions are made – in both long term LRTP planning and short-
term TIP programming of projects – based on MPO goals and objectives for improving the overall
transportation system. The work activities and products in this work element will be coordinated with
Work Elements: 2.1 Community Outreach, 3.3 Transportation Surveys, Model and Analysis, 3.5- GIS
Development and Applications, 4.1- Long Range Plan, 4.2- Congestion Management Process, 4.3-Public
Transit and 5.1 Transportation Improvement Program.
The FAST Act requires the Department of Transportation (DOT) to establish performance measures in
seven areas:

PROGRAM
TASK 7.1 - Transportation Improvement Program (44.25.00)
Purpose: Update the ARTS Transportation Improvement Program (TIP) in conformance with Federal
regulations.
This work element involves the annual update of the Transportation Improvement Program (TIP). The TIP
covers a four-year programming period in the Georgia part of the study area and six years on the South
Carolina side. Updates involve the removal of projects that have advanced to construction, the
development, or update of project descriptions or cost estimates, and the prioritization of projects. The
TIP is developed with public input and is coordinated with other transportation providers. Documentation
of the effort is submitted for review and adoption by ARTS committees and goes through a public
involvement process.
Previous Work:
1. The ARTS Transportation Improvement Program (TIP) was updated based on amendments and
administrative modifications during the previous fiscal year.
2. ARTS staff updated the funding application process for the Transportation Alternatives Program
(TAP) to include changes in funding requirements in the FAST Act.
3. ARTS staff released a solicitation for new Transportation Alternatives – Set-aside Projects for FY
2019-2020 funds for Richmond and Columbia Co., GA. Project implementation is ongoing for
existing projects.

Purpose: The purpose of corridor planning is to analyze traffic and travel conditions along major
transportation corridors, impact on development and land use patterns. In addition to
determining the potential growth and transportation needs for short and long-term
improvements, important study themes include the following:

2. Increasing mobility during peak travel times
3. Optimizing the relationship between land use and transportation

One of ARTS 2040 Long Range Transportation Plan objectives (Goal 2.2.1.6 Land Use and

centers along existing and planned major travel corridors. Corridor Planning helps ARTS achieve
this objective by integrating land use decisions in the transportation planning process. Corridor
planning also plays in important role in congestion management, a vital component of the 2040
Long Range Transportation Plan.

application during the fiscal year as local matching funds are budgeted by Augusta Richmond

APPENDIX A
The text below, in its entirety, is in all contracts entered into by AUGUSTA GEORGIA. All of the
text except the final section, entitled “Incorporation of Provisions,” should be included in any
contract entered into by any AUGUSTA GEORGIA contractor.
During the performance of this contract, the contractor, for itself, its assignees, and successors
in interest (hereinafter referred to as the “Contractor”), agree as follows:
1. Compliance with Regulations
The Contractor shall comply with the Regulations relative to nondiscrimination in federally-
assisted programs of the Department of Transportation (hereinafter referred to as DOT),
Title 49, Code of Federal Regulations, part 21, as they may be amended from time to time,
(hereinafter referred to as the Regulations), which are herein incorporated by reference and
made a part of this contract.
2. Nondiscrimination
The Contractor, with regard to the work performed by it during the contract, shall not
discriminate on the grounds of race, color, sex, or national origin in the selection and
retention of subcontractors, including procurement of materials and leases of equipment.
The Contractor shall not participate either directly or indirectly in discrimination prohibited
by Section 21.5 of the Regulations, including employment practices when the contract
covers a program set forth in Appendix B of the Regulations.
3. Solicitations for Subcontracts, Including Procurement of Materials and Equipment
In all solicitations either by competitive bidding or negotiations made by the Contractor for
work to be performed under a subcontract, including procurement of materials or leases of
equipment, each potential subcontractor or supplier shall be notified by the Contractor of
the Contractor’s obligations under this contract and the Regulations relative to
nondiscrimination on the ground of race, color, sex, or national origin.
4. Information and Reports
The Contractor shall provide all information and reports required by the Regulations or
directives issued pursuant thereto, and shall permit access to its books, records, accounts,
other sources of information and its facilities as may be determined by Augusta Georgia or
the Federal Highway Administration to be pertinent to ascertain compliance with such
Regulations, orders, and instructions. Where any information required of a contractor is in
the exclusive possession of another who fails or refuses to furnish this information, the
Contractor shall so certify to Augusta Georgia, or the Federal Highway Administration as
appropriate, and shall set forth what efforts it has made to obtain the information.
5. Sanctions for Noncompliance
In the event of the Contractor’s noncompliance with the nondiscrimination provisions of this
contract, Augusta Georgia shall impose such contract sanctions as it or the Federal Highway
Administration may determine to be appropriate, including, but not limited to:

a. Withholding of payments to the Contractor under the contract until the Contractor
complies; and/or
b. Cancellation, termination, or suspension of the contract, in whole or in part.
6. Incorporation of Provisions
The Contractor shall include the provisions of paragraphs (1) through (5) in every
subcontract, including procurement of materials and leases of equipment, unless exempt by
the Regulations, or directives issued pursuant thereto.
The Contractor shall take such action with respect to any subcontractor or procurement as
Augusta Georgia or the Federal Highway Administration may direct as a means of enforcing
such provisions including sanctions for noncompliance: Provided, however, that in the event
a Contractor becomes involved in, or is threatened with, litigation with a subcontractor or
supplier as a result of such direction, the Contractor may request Augusta Georgia enter into
such litigation to protect the interests of the state and, in addition, the Contractor may
request the United States to enter into such litigation to protect the interests of the United
States.

APPENDIX B
The following clauses shall be included in any and all deeds affecting or recording the transfer
of real property, structures, or improvements thereon, or interest therein from the United
States.
Granting Clause
NOW, THEREFORE, Augusta Georgia—as authorized by law, and upon the condition that the state
of Georgia will accept title to the lands and maintain the project constructed thereon, in
accordance with and in compliance with Title 23, United States Code, the Regulations for the
Administration of Federal Aid for Highways; the policies and procedures prescribed by the
Federal Highway Administration of the Department of Transportation; and all requirements
imposed by or pursuant to Title 49, Code of Federal Regulations, Department of Transportation,
Subtitle A, Office of the Secretary, part 21, Nondiscrimination in Federally Assisted Programs of
the Department of Transportation (hereinafter referred to as the Regulations) pertaining to and
effectuating the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252: 42 USC 2000d
to 2000d-4)—does hereby remise, release, quitclaim, and convey unto the state of Georgia all
the right, title, and interest of AUGUSTA GEORGIA in and to said land described in Exhibit A
attached hereto and made a part thereof.
Habendum Clause
TO HAVE AND TO HOLD said lands and interests therein unto the state of Georgia, and its
successors forever, subject, however, to the covenants, conditions, restrictions and reservations
herein contained as follows, which will remain in effect for the period during which the real
property or structures are used for a purpose for which the federal financial assistance is
extended or for another purpose involving the provision of similar services or benefits and shall
be binding on the state of Georgia, its successors, and assigns.
The state of Georgia , in consideration of the conveyance of said lands and interests in lands,
does hereby covenant and agree, as a covenant running with the land for itself, its successors
and assigns, that (1) no person shall, on the grounds of race, color, sex, disability, national origin,
age, or religion, be excluded from participation in, be denied the benefits of, or be otherwise
subjected to discrimination with regard to any facility located wholly or in part on, over, or under
such lands hereby conveyed*, (2) that the state of Georgia shall use the lands, and interests in
lands so conveyed, in compliance with all requirements imposed by or pursuant to Title 49, Code
of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, part
21, Nondiscrimination of Federally Assisted Programs of the Department of Transportation—
Effectuation of Title VI of the Civil Rights Act of 1964, and as said Regulations may be amended,
(3) that in the event of breach of any of the above mentioned nondiscrimination conditions, the
agency shall have a right to reenter said lands and facilities on said land, and the above described
land and facilities shall thereon revert to and vest in, and become the absolute property of,
AUGUSTA GEORGIA and its assigns as such interest existed prior to this instruction.¹

The LESSEE, for himself or herself, his or her heirs, personal representatives, successors in

covenant running with the land, that in the event facilities are constructed, maintained, or
otherwise operated on the said property described in this lease, for a purpose for which
AUGUSTA GEORGIA program or activity is extended, or for another purpose involving the
provision of similar services or benefits, the LESSEE shall maintain and operate such facilities and
services in compliance with all other requirements imposed pursuant to Title 49, Code of Federal
Regulations, Department of Transportation, Subtitle A, Office of the Secretary, part 21,
Nondiscrimination in Federally Assisted Programs of the Department of Transportation—
Effectuation of Title VI of the Civil Rights Act of 1964, as said Regulations may be amended.
That in the event of breach of any of the above nondiscrimination covenants, the STATE shall
have the right to terminate the lease, and to reenter and repossess said land and the facilities
thereon, and hold the same as if said lease had never been made or issued.
The following shall be included in all deeds, licenses, leases, permits, or similar agreements
entered into by AUGUSTA GEORGIA pursuant to the provisions of Assurance 7.
The LESSEE, for himself or herself, his or her personal representatives, successors in interest, and

Effectuation of Title VI of the Civil Rights Act of 1964, and as said Regulations may be amended.

MPO Certification
CERTIFICATION OF THE
AUGUSTA REGIONAL TRANSPORTATION STUDY
Be it known to all, the below signees do hereby endorse and certify the Metropolitan Planning Process for
the Augusta Regional Transportation Study (ARTS), and further certify that the Metropolitan Planning
Process is being conducted in accordance with all applicable requirements of:
I. 23 U.S.C. 134, 49 U.S.C. 5305, and this subpart
o Agreements are in place to address responsibilities of each MPO for its share of the overall
Metropolitan Planning Area (MPA), where multiple Metropolitan Planning Organizations
share geographic portions of a Transportation Management Area (TMA).
o All major modes of transportation are members of the MPO
o Any changes to the MPA boundaries were reflected in the Policy Board representation.
o Agreements or memorandums are signed and in place for identification of planning
responsibilities among the MPO, GDOT, public transit operator(s), air quality agency(ies), or
other agencies involved in the planning process.
o Roles and responsibilities are defined for the development of the Long Range Transportation
Plan (LRTP), Transportation Improvement Program (TIP), Unified Planning Work Program
(UPWP) and other related planning documents.
UPWP
o The UPWP documents in detail the activities to be performed with Title 23 and the Federal
Transit Act.
o The UPWP activities are developed, selected and prioritized with input from the State and
public transit agency(ies).
o The UPWP provides funding for the professional development of MPO staff.
o The final UPWP is submitted in a timely manner to GDOT with authorization occurring by
before the MPO’s fiscal year begins.
o Amendments to the UPWP are developed and processed in accordance with procedures

o Each project included in the TIP is consistent with the LRTP.
o The MPO, GDOT and the transit operator collaborate on the development of the TIP.
o The TIP contains all projects to be funded under Title 23 U.S.C. and Title 49 U.S.C. Chapter 53.
o The TIP is financially constrained by year and revenue estimates reflect reasonable
assumptions.
o The MPO TIP is included in the STIP by reference, without modification.
o Amendments to the LRTP/STIP/TIP follow the approved Amendment Process.

VIII. The Older Americans Act, as amended (42 U.S.C. 6101), prohibiting discrimination on the basis
of age in programs or activities receiving Federal financial assistance
o The MPO has identified strategies and services to meet the needs of older persons’ needs for
transportation planning and programming.
IX. Section 324 of title 23 U.S.C. regarding the prohibition of discrimination based on gender
o The MPO adheres to the Act on Equality between women and men and prohibits both direct
and indirect discrimination based on gender.
o The MPO adheres to the Equal Pay Act of 1963 (EPA), which protects men and women who
perform substantially equal work in the same establishment from sex-based wage

Caption: Execute Metropolitan Transportation Planning Services Contract between the Georgia
Department of Transportation and the Augusta Planning and Development Department
Background: This grant is allocated each fiscal year and assists in funding several planning aspects
within the Metropolitan Planning Agency (MPO) such as: Augusta Regional
Transportation Study, Congestion Management Plan, Long Range Transportation Plan
and local roadway construction.
Financial Impact: This contract is an 80/20 match with the local match share of $ 39,440.96 for a total
allocated amount of $197,204. 96.
Alternatives: Not executing this grant would result in the loss of funding for future roadway
development and key studies for the areas that the MPO services which include: City of
Blythe, City of Hephzibah, Richmond County GA, City of Grovetown, Augusta Public
Transit, City of North Augusta, SC City of Aiken, SC, Aiken County, SC, Town of
Burnsettown, SC, Town of New Ellenton, Edgefield County, SC Best Friends Express, and
Lower Savannah Council of Government.
Recommendation: To sign and execute the contract between Augusta Planning and Development
Department and Georgia Department of Transportation.
