Revocation of Business License, Dance License and Alcohol License

Caption:Discussion: consider suspension or revocation of the Alcohol
License and Business License for Mr. Keion S. Taylor, d/b/a: Last
Call Upscale Restaurant & Lounge, 1721 Gordon Hwy, for failure
to comply with the Augusta-Richmond County Alcohol
Ordinance, Dance Ordinance and Occupation Tax Ordinance.
Background:The owner of Last Call has a business license to operate a lounge,
to include dance license, alcohol license to serve liquor, beer and
wine and alcohol catering license. The Augusta Commission at
their regular meeting on April 18, 2017 took action and approved
six-month probation of the Alcohol License, Dance License and
Business License for Keion S. Taylor, d/b/a Last Call Upscale
Restaurant and Lounge …. Sheriff’s Office letters are attached.
Analysis:ANALYSIS: The Sheriff’s Office is requesting that the
Commission take action against the license holder. The Alcohol
Licenses and the Business License are currently under a 6-month
probation that ends October 19, 2017. The licenses can be
suspended or revoked pursuant to the following Codes:
OCCUPATION TAX CODE Sec. 2-1-38. Right to deny, suspend,
or revoke a business tax certificate. (a) A Business Tax Certificate
under this Chapter may be denied, suspended, or revoked if one or
more of the following exists: (3) The applicant or holder of the
certificate intends to violate or has violated any federal or state
law, or local ordinance or any ordinance or resolution regulating
such business or intends to violate any regulation made pursuant
to authority granted for regulating such business. (6) The applicant
or holder of the certificate fails to adequately supervise and
monitor the conduct of the employees, patrons and others on the
subject premises, or on any property owned or leased by the
applicant or holder, including but not limited to parking lots and
parking areas, or on any parking lots or areas which may be
lawfully used by patrons of the establishment of the applicant or
holder, in order to protect the safety and well-being of the general

public and of those using the properties. Sec. 6-2-74. Probation,
Suspension & Revocation (Alcohol License). Any license issued
under this Ordinance may be put on probation, suspended and/or
revoked by the Augusta-Richmond County Commission after a
finding of due cause. Due cause for the probation, suspension or
revocation of a license shall include but shall not be limited to, the
following: (a) A violation of this Ordinance or any State or federal
law governing the manufacture, transport, or sale of alcoholic
beverages by the licensee or any person in his employ or in the
employ of the establishment for which the license was issued. (d)
The revocation of the license or permit of the business to operate
by any State, County, City or other government authority due to a
violation of any law applicable to the business including, but not
limited to, building codes and health codes. Sec. 6-2-21. Premises
to be kept in orderly manner, with outside gatherings of patrons
restricted. (a) Owners and/or applicant, managers and employees
shall be responsible for keeping an orderly place, and no patron
shall cause a disturbance of any kind; nor shall any patron be
allowed to stand, sit, mingle or assemble outside the building, in
parking lots or autos, and drink alcoholic beverages except as
provided in subparagraph (b) hereof. ALCOHOL CODE Sec. 6-2-
32. Violations; unlawful activities. (a) Any person holding any
license issued pursuant to this Ordinance or any employee or
agent of such person who violates any provision of this
Ordinance, or directs, consents to, permits, or acquiesces in such
violation, either directly or indirectly shall, by such conduct,
subject the license to suspension or revocation. For purposes of
administering and enforcing this Ordinance, any act committed by
an employee, agent or representative of a licensee shall be deemed
to be an act of such licensee. (b) It shall be a violation of this
Ordinance for any licensee to permit any person to engage in any
activity on the premises for which the license is issued or within
the place of business, which is in violation of the laws or
regulations of any federal, state, county or municipal governing
authority or regulatory agency. With respect to any such activity,
it shall be rebuttably presumed that the same was done with the
knowledge or consent of the licensee; provided however, that such
presumption may be rebutted only by evidence which precludes
every other reasonable hypothesis save that such licensee did not
know, assist or aid in such occurrence, or in the exercise of full
diligence could not have discovered or prevented such activity.
DANCE CODE Sec. 6-6-43. Dance. (g) Right of suspension by
Planning & Development Department. The Planning &
Development Department shall have the right to suspend any
business tax certificate issued under this chapter whenever a
person, firm or corporation doing business shall deviate from the
normal operation for which the business tax certificate was
obtained or fails in performance to meet the required regulations
and code as set forth by the Planning & Development Department,
Augusta-Richmond County Sheriff’s Department or Augusta-
Richmond County Health Department, or violates any law or

ordinance of the United States, or the State or Augusta-Richmond
County, in pursuance of such business conducted under such
business tax certificate…..

Mr. Sherman,
In recent months this office has had contact with the ownership of Last Call, as it relates to
operation of the business as well as the conduct that is allowed to exist within and surrounding it.
The clubs ownership has been counseled and advised about correct operations by the Sheriff’s
Office and the Richmond County Board of Commissions. Also in recent months an undercover
narcotics investigation has been on going in which Last Call was included. The investigation
revealed narcotics were being sold and stored inside Last Call by management. The Sheriff’s Office
is concerned with the illegal activity and with the safety of the patrons attending Last Call.
Please consider this a formal request to bring Last Call located at 1721 Gordon Hwy before the
Augusta Richmond County Commission to have their Alcohol license considered for revocation.

Mr Sherman,
In recent months this office has had contact with the ownership of Last Call, as it relates to
operation of the business as well as the conduct that is allowed to exist within and surrounding it.
The clubs ownership has been counseled and advised about the pervasive use of marijuana being
smoked inside the club. Members of the Sheriff’s Office has inspected this location on several
occasions and it was found to have a heavy presence of what is believed to be a marijuana odor in
the business. In the last month there have been three shootings that resulted from patrons
attending Last Call. The first originated from a dispute inside the club and the shooting happened
on Gordon Hwy at Sibley Rd. The second occurred inside the club where a person was shot in the
face. The third occurred in the parking lot where a person was shot in the back along with a vehicle.
The club and parking lot were full of patrons when the shootings occurred. The Sheriff’s Office is
concerned with the safety of the patrons attending Last Call along with using needed resources
that should be elsewhere.
Please consider this a formal request to bring Last Call located at 1721 Gordon Hwy before the
Augusta Richmond County Commission to have their Alcohol license considered for suspension or
probation.

Sunday Sales New's Year's Eve

Caption:Motion to change the one Sunday during the year bars can remain
open to New Year's Eve per the Augusta Alcohol ordinance.

Background:Under the terms of a state law passed in 2015 that allows local
governments to designate one Sunday during the year when bars
can remain open, Augusta amended the Alcohol ordinance to
designate St. Patrick’s Day holiday period (16th – 18th) as the
Sunday….At this time we’re using the designated ‘one Sunday a
year pass’ for St. Patrick’s day that will not be on Sunday again
until 2019. However, the St. Patrick’s Day period (16th, 17th, and
18th ) will land the 18th on Sunday in 2018…. The Alcohol
ordinance could be amended to delete the St. Patrick’s Day period
to this year’s New Year’s Eve Sunday, and maybe change the
designated Sunday each year according to demand. The State
hours for operation for the Sunday pass are 12:30 PM to
midnight. Monday sales can start at 8:00 AM.

Tentative Allocation of Federal Funding Assistance for Obstruction Mitigation (Runway 23 Approach)
Phase 1

Caption:Approve acceptance of Daniel Field Airport's tentative allocation
of Federal funding for Fiscal Year 2018.
Background:The Daniel Field Airport receives federal money in the form of
grants to maintain the integrity of the airfield. The process starts
with a tentative allocation letter (TA) to inform the airport of the
amount of money that is allocated for the next grant. The TA
for the Fiscal Year 2018 grant is for the design phase of
obstruction mitigation on the Runway 23 Approach. The
obstructions include trees on city property and private property.
Analysis:WK Dickson is the civil engineer consultant of record for Daniel
Field. The design project will not require going out for bid as the
consultant of record, WK Dickson, will be awarded the design
phase of this project. The project includes identifying the
obstructions penetrating the airspace, appraising the property
where the penetrations occur and establishing fair market value for
easements of these properties.
Financial Impact:The FAA will fund 90% of the project, the State of Georgia will
fund 3 to 4% of the project with a local match of 6 to 7%. Note:
The local match will come from the Daniel Field Enterprise Fund.
Alternatives:Deny the recommendation.
Recommendation:
The Daniel Field General Aviation Commission recommends
approval of the FY2018 tentative allocation for Daniel Field
Airport in the amount of $162,000. The Daniel Field General
Aviation Commission also recommends generating a letter on
Augusta, GA letterhead confirming the intent to proceed with and
fund Obstruction Mitigation (Runway 23 Approach) Design Phase
