(Requested by Commissioner Williams) Background: Analysis: Financial Impact: Alternatives: Recommendation: Funds are Available in the Following Accounts: REVIEWED AND APPROVED BY: Cover Memo Item # 2 Public Safety Committee Meeting 5/13/2013 12:45 PM Emergency Request to employ Conflict Defender(s) for misdemeanor courts Department:Public Defender Caption:Approve motion to employ a conflict defender(s) for the misdemeanor courts beginning Monday, May 6, 2013, as required by the recent opinion of the Georgia Supreme Court. Background:To employ a conflict defender(s) for the misdemeanor courts beginning Monday, May 6, 2013, as required by the recent opinion of the Georgia Supreme Court which prohibits the public defender’s office from representing co defendants except in unusual circumstances. On this emergency basis, we can pay them by the hour (s) or put an attorney on contract until the balance of the funds requested for this constitutionally required representation can be presented to the Commission. We have cases in our office at the moment which require immediate assignment. If payment is on an hourly basis, it would be $60.00 per hour for in court time and $45.00 per hour out of court time. Since court time would be daily for the attorney until additional arrangements can be made, hourly may be more expensive than letting one or two contracts at this point in time to assure that the misdemeanor courts are covered every day. Eventually, there should be five misdemeanor contracts, one for each day of the week, to assure complete coverage in the Richmond County State and Magistrate Courts. I anticipate the annual amount of each contract to be between $15,000 and $18,000. I would also request an amount of $30,000 to pay for investigators and experts as needed and requested by the attorneys as these expenses are required to meet the 6th Amendment effective assistance of counsel. Analysis:Approve employing conflict defender(s). (Bid item 13- 142) Background:On April 21, 2013 Aerial Truck 1, assigned to Station 3, caught fire, rendering it inoperable. This unit covers most of downtown and some surrounding areas. These trucks execute tasks such as, but not limited to, search and rescue, forcible entry, elevated water streams, high rise access, and vehicle extrication. Analysis:Presently, the Fire Department is using our last reseve apparatus to cover AT-1's territory. If any of the other aerial trucks are placed out of service or require repair, the Fire Department will be unable to deliver adequate service to the citizens of Augusta. To ensure the health and safety of the community, it has become necessary to aquire a new aerial truck as an emergency purchase. NAFECO has a KME 109' Rear Mount Aerialcat Ladder available for immediate delivery. Financial Impact:Total cost quoted is $774,371 and funds are available in SPLOST accounts already committed to pump and aerial truck purchases. Alternatives:There are no adequate alternatives. Out of all the specifications presented to our office, the KME 109' Aerialcat Ladder best meets our operational requirements. Recommendation:Emergency purchase of KME 109' Aerialcat Ladder to replace AT-1 that was damaged by fire on April 21, 2013.
