2. Z-19-32 – A request for concurrence with the Augusta Georgia
Planning Commission to approve with the conditions below a
petition by Annette Pierce Hooks requesting a Special Exception
to expand an established Family Personal Care Home up to 6
residents per Section 26-1(H) of the Comprehensive Zoning
Ordinance for Augusta, Georgia affecting property containing
3.66 acres on property known as 921 C Hephzibah McBean
Road. Tax Map 354-0-147-00-0 DISTRICT 8 1. The home
shall be staffed on a 7-day, 24-hour basis. 2. T he home shall be
limited to 6 residents total with staff coming in shifts. Any live-in
staff will be counted towards the maximum occupancy of 6
residents. 3. A directional sign with the address clearly
labeled with reflective lettering will be placed at the entrance to
the common driveway at Hephzibah McBean Road and at the
entrance to the subject property off the common driveway to
assist emergency personnel should they be called to the facility.
4. Any changes in the definition of the use, nature of the
clientele or increase in numbers of occupants shall require
another Special Exception. 5. The applicant must receive and
maintain a City of Augusta business license and a license with
the State of Georgia. Proof of compliance with the minimum
requirements of Chapter 111.8-62.01 of the O.C.G.A must be
provided, and the applicant must provide annual fire department
inspection reports. 6. All requirements must be met within six
(6) months of approval of the Special Exception, or the Special
Exception is void. 7. If wheelchair bound persons reside in the
residence all 2010 ADA Standards for Accessible Design
requirements must be met, including but not limited to: · All
doorways must be at least 3 feet wide. · At least one bathroom
that permits a wheelchair dependent person to use all bathroom
facilities unimpeded. (Deferred from the August 20, 2019
regular meeting)

petition by Progressive Consultants LLC requesting a change of
zoning from Zone LI (Light Industry) to Zone R-3C
(Multiple-family Residential) affecting property containing
approximately 25.61 acres and known as 1812 Slaton Street.
Tax Map 045-3-419-00-0 DISTRICT 1 1. A Traffic Impact
Assessment shall be commissioned at the cost of the applicant to
determine which, if any, roadway improvements must be made to
mitigate the impact of additional traffic to and from the site.
Roadway improvements, if required, by the Traffic Study or the
Augusta Traffic Engineer, will be performed at the cost of the
applicant. 2. Removal of building sections on Slaton Street to
allow for proper site clearances near the driveway entrances,
which currently pose a traffic safety concern. 3. Improve the
existing sidewalks adjacent to the affected property to current
ADA standards. 4. Coordinate with CSX to create access at
the intersection of Jordon Road and Arch Drive, a formal
statement of their final decision must be provided to staff. 5.
The conceptual site plan submitted and evaluated is for the
purpose of the current zoning action only. Issuance of
development permits shall be contingent upon the submission
and approval of development plans meeting all applicable
development regulations. Infill residential development at
densities compatible with the surrounding area. In this case,
maintain a maximum density of 7.6 units per acre.Proposed
internal drives shall meet all standards of the Augusta Traffic
Engineering and Fire Departments.Issuance of development
permits shall be contingent upon the submission and approval of
plans meeting all applicable development regulations. (Deferred

RESOLUTION
RESOLUTION ADOPTED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION
ESTABLISHING THE TAX MILLAGE RATES FOR CALENDAR YEAR 2019
RESOLVED BY THE AUGUSTA-RICHMOND COMMISSION, that the rates as set forth
on Schedule “A” hereto, for the calendar year 2019, are hereby levied against the
taxable property of said County within the County for its County-Wide General Fund
Maintenance and Operations, the Urban Services District, the Capital Outlay Fund, the
Fire Protection Fund, and the Blythe Fire District Maintenance and Operations Fund,
respectively.
BE IT FURTHER RESOLVED THAT Steven Kendrick, Tax Commissioner, or his
successor in office, is hereby directed to collect said tax on the taxable property within
said districts, except exempted real property as provided by law, and except exempted
personal property as provided by law, for the calendar year 2019.

916 GREENE STREET PARKING FACILITY ENCROACHMENT AGREEMENT
PARMNG FACILITY AGREEMENT (this "Agreement"), made this 3 day of ,
2019 by and ("Grantee") and AUGUSTA-RICHMOND COUNTY, GEORGIA,
a politica subdivision of the State of Georgia ("Grantor").
is the owner f certain real property located in Augusta, Georgia, b_g.gúj_!
referenced as Parcel Number 047-1-194-00-0, a portion of which is depicted on Exhibit A
attached hereto and incorporated herein by reference (the "City Property");
WHEREAS, Grantee is the owner of Parking Facility located near the City Property at Parcel
Number 047-1-195-00-0:
WHEREAS, the Grantee's has Parking Facility to be located across the City Property that will
encroach on the City Property approximately 2,786 sq.ft as depicted on Exhibit A.
WHEREAS, the Grantee's has striped three spaces as the "Area for Utility Closet Access" and in
turn the Grantor has provided three spaces and agrees to provide signs exhibiting "For Shared
Space Only" for an additional 486 square feet.
WHEREAS, Grantee agrees to take all responsibility for the maintenance of the Parking Facility
and will not relocate or expand the dimension of the encroached area.
WHEREAS, Grantor has agreed to grant for the benefit of the Grantee Property Parking Facility
encroachment, together with a construction and maintenance right, over, under and across the
portion of the City Property, as more fully set forth herein.
NOW, THEREFORE, in consideration of Ten Dollars ($10.00) in hand paid, and other good and
valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Grantor
and Grantee agree as follows:
1. Grant of Encroachment. Grantor hereby grants to Grantee, its successors and assigns,
for the benefit of the Grantee's Property, a non-exclusive, perpetual encroachment thr ough the
2,786 sq.ft area shown on the parcel TM. 047-1-194-00-0 Encroachment Exhibit A prepared by
G.F. Slaughter, James G. Swift & Associates and attached hereto as Exhibit A and incorporated
herein by reference (the "Encroachment Area"), for the purpose of constructing & maintaining
a Parking Facility.

2. Relocation. This herein grant of encroachment is made with the stipulation by Grantor
and Grantee that Grantor may require the relocation of the parking area or improvements
authorized under this Agreement, if, in sole determination of Grantor, any future drainage,
utilities or other improvements or maintenance activities are needed on or in Encroachment
Area and / or this ROW for a public purpose. In any such event, the parking lot or
improvements will be relocated at Grantee's sole expense and Grantor shall have no liability for
the relocation of such parking lot or improvements.
3. Release. The Grantee, his/her/its administrators, executors, successors, heirs and assigns
hereby indemnifies and holds harmless the Grantor and its authorized agents and employees for
any and all damages, accidents, casualties, occurrences or claims which may arise or be
asserted against the City from the construction, presence, existence or maintenance of the
parking lot by the Grantee, except to the extent caused by the willful misconduct of the City or
its authorized agents and employees.
4. Governing Law. This Agreement shall be governed by and construed in accordance
with the laws of the State of Georgia
5. Binding Effect. The rights and obligations created herein shall run with title to City
Property and shall be binding upon the Grantor, its successors and/or assigns, and shall inure to
the benefit of Grantee, its successors and/or assigns.
6. Amendments. This Agreement, along with the exhibits attached hereto, may not be
amended, waived or discharged, except by instrument in writing, executed by both Grantor and
Grantee, or their respective successors, heirs or assigns, as applicable.
