(Requested by Commissioner Johnson) Finance Committee Meeting 3/11/2013 12:55 PM 2013 - Sheriff Sales Tax Department:Finance - Fleet Management Caption:Approve the replacement of 41 Public Safety Vehicles for the Sheriff’s Office for 2013. Background:In December of 2008, Fleet Management submitted a request to replace public safety vehicles as part of the 2011 Sales Tax Referendum. This referendum was passed which will provide 1.5 million dollars for replacement vehicles for Public Safety each year for 5 years. The items listed below are from funds available for Phase VI of the Sales Tax – third year. The initial plan of 2008 called for the replacement of approximately 42 patrol/pursuit vehicles per year, however with the production curtailment of the Crown Victoria coupled with the increase in pricing the number of vehicles being requested has been adjusted/reduced to meet the funds available through the Sales Tax. The following vehicles are being requested for 2013; 1). Road Patrol Division – 30 pursuit type vehicles (Dodge Chargers) at $ 1,011,196.00 2). Criminal Investigation Division (CID) – 10 vehicles (Chevy Impala) at $217,060.00 3). Civil Division – 2 vehicles for inter & intra-state transport(Chevy Tahoe) -$59,242.00 An additional 2 motorcycles will be requested at a later date. Fleet Management is in the process of submitting a request for bids to obtain pricing. Vehicles will be replaced on a one for one basis. Analysis:The Procurement Department published a competitive bid using the Demand Star application for the police pursuit vehicles (Dodge Chargers) , Bid 13-120. Bids were received from four venders; Akins Ford Corp, Butler Dodge, Thomson Chrysler and Carl Gregory Dodge (incomplete bid). Akins Ford Corp was the low bidder and in fact, has the State Contract. See attached documents. The pricing for the Chevrolet Tahoe and Chevrolet Impala is from the State Contract (SWC90796) from Hardy Fleet Group of Dallas, Georgia (see attachments). Financial Impact:: 1). Road Patrol Division – 30 pursuit type vehicles (Dodge Chargers) at $ 866,896; (2). Criminal Investigation Division (CID) – 10 vehicles (Chevy Impala) at $217,060.00; (3). Civil Division – Cover Memo Item # 1 2 vehicles for inter & intra-state transport (Chevy Tahoe) - $59,242.00 for a total of $1,114,198.00. The planned allocation of the 1.5 million approved in the Sales Tax for the Sheriff’s Office (per year) is $1.2 million with the remaining $300,000 for Animal Services, ARCCI, Coroner, Marshal and District Attorney. Background:Current coverage has a $2,000,000 liability limit with an SIR (self insured retention) of $250,000 for each claim Public Officials and $250,000 each claim Employment Practices Liability. Public Official Liability provides coverage for "wrongful acts" of the public entity and wrongful acts of individuals who act on behalf of the entity. A wrongful act means any actual or alleged breach of duty, neglect, errors, misstatements, misleading statements, omissions or employment practices violation by an insured solely in the performance of duties for the public entity. Augusta- Richmond County has maintained continuous coverage since 1997. Acceptance of coverage gives additional protection to the assets of public officials. Public Official Liability (POL) coverage is claims made coverage which means any claim which may be covered would need to be filed during the policy period. J. Smith Lanier & Company secured four quotes for this coverage. These quotes provide $2,000,000 in coverage with a $250,000 SIR (self insured retention). Quotes were received from the following companies: Landmark American, an A XII rated carrier for a premium of $64,948; AIG Insurance Co., an A-XV rated carrier for a premium quote of $78,265; Crum & Forester, an A-XI rated carrier for a premium quote of $93,783; Allied World Assurance Co., an A-XV rated carrier for a premium quote of $ 127,642. Our role in any particular insurance transaction typically involves one or more of these activities. Except in cases where J. Smith Lanier & Co. has a specific fee agreement to receive compensation from a client, we customarily receive compensation from insurers for our professional services in the form of a commission, which normally consists of a percentage of the premium collected by the insurers. Smith Lanier & Co. based in whole or in part on the sale of insurance to you and (if applicable) compensation expected to be received by us based in whole or in part on any alternative quotes presented to you by J. Smith Lanier & Co. Collection Disclosure If this proposal results in your commitment to purchase one or more of the insurance products described in this proposal, J. Smith Lanier & Co. will submit to you, or caused to be submitted to you, an invoice for the insurance premiums associated with such insurance products. You are responsible for payment in full of the premium amounts set forth on our invoices within the payment terms set forth on the invoices. In the event that J. Smith Lanier & Co. or its designee commences legal action to collect amounts due under outstanding invoices or to enforce its rights under any insurance contracts, you will be responsible for payment of all reasonable attorneys’ fees, court costs and expenses incurred by J.
