ORDINANCE ______
An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the
Augusta-Richmond County Commission effective September 16, 1997 by
amending 27-7 (e)
THE AUGUSTA COMMISSION HEREBY ORDAINS:
SECTION I. That the Comprehensive Zoning Ordinance is amended by amending the
following language in Section 27-7 (e)
(e) Any manufactured home located on an individual lot, parcel, or tract shall be
placed on a foundation and shall be provided with a curtain wall enclosure so
constructed as to prevent passage of persons, animals, or debris into space beneath
the manufactured home.
SECTION II. That the Comprehensive Zoning Ordinance is amended by adding the
following language in Section 27-7 (e)
(e) Any manufactured home located on an individual lot, parcel, or tract shall be
installed in accordance with O.C.G.A. Title 8, Chapter 2, Article 2, Part 3, and
shall be provided with a solid skirting / curtain wall enclosure constructed of
masonry to include stone, faux stone, brick, faced block, or stucco with the
required vents.
SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby
repealed.

Augusta Public Transit Bus Purchase

Background:Augusta Public Transit has already purchased three (3) buses through the
ARRA Funds from Daimler Buses, North America through PART
(Piedmont Authority for Regional Transportation) Contract 1320A. We will
be usingGrant GA-90-X300Funds to purchase additional buses from the
same contract.
Analysis:The purchase of the vehicles will upgrade the fleet and allow for the
retirement of older vehicles.
Financial Impact:The Federal Transit Administration grant will pay 80% ($934,183.20)
Augusta-Richmond County will only be responsible for 20% ($233545.80)
of the total cost.
Alternatives:None.
Recommendation:Approve the purchases from Grant GA-90-X300-00 Funds so that Transit
can move forward with the upgrades in the fleet.

Caption:Motion to approve Augusta Public Transit’s purchase of two (2) paratransit
vehicles and two (2) small fixed route transit vehicles from National Bus
Sales and Leasing, Incorporated for $305,566. (Approved by Public

Background:The vehicles will be purchased using State of Georgia Contract Number EQ-
48400-819. The cost per vehicle is $74,718 for the paratransit vehicles and
$78,065 for the small fixed route transit vehicles.
Analysis:The purchase of the vehicles will upgrade the fleet and allow for the
retirement of older model paratransit vehicles. FTA pays 80% of the cost,
and Augusta-Richmond County the remaining 20%. Attached are the quotes
for the vehicles.
Financial Impact:The impact of approving this purchase will be minimal on operations.
Alternatives:None.

Caption:Motion to approve an amendment to Augusta-Richmond County Code,

Background:The Georgia State Licensing Boards under O.C.G.A. Title 43 provide that
each person, firm or corporation desiring a contractor’s license as a
residential contractor, residential-light commercial contractor, general
contractor, electrician, plumber, or HVAC contractor shall have a person
regularly employed who has been certified by the Georgia State
Construction Industry Board (O.C.G.A. Title 43).
Analysis:The approval of the proposed amendment will correct the Augusta code so
that it reflects the State of Georgia licensing requirements.

REQUIRE THAT BUILDING CONTRACTORS EMPLOY STATE CERTIFIED
PERSONNEL; TO PROVIDE AN EFFECTIVE DATE; TO REPEAL CONFLICTING
ORDINANCES AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION AND IT IS
HEREBY ORDAINED BY THE AUTHORITY OF SAME AS FOLLOWS:
Section 1. The Augusta-Richmond County Code Section 7-1-117 is hereby amended by deleting
said Section in its entirety and substituting therefore the following to wit:
Sec. 7-1-117. Performing Building, Electrical, Plumbing, and HVAC Work.
Building, Electrical, Plumbing, and HVAC contractors are required to employ State certified
personnel. Before being licensed to perform Building (Residential, Residential-Light
Commercial, General Contracting), Electrical, Plumbing, and HVAC contracting and
construction in Augusta-Richmond County, each person, firm or corporation desiring such
license shall have a person regularly employed who has been certified by the Georgia State
Licensing Boards (O.C.G.A. Title 43).
Section 2. This ordinance shall become effective upon adoption.
Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Rural Transit Grant Application

Caption:Motion to renew the Sec. 5311 Rural Transit grant application between the
Georgia Department of Transportation (GDOT) and Augusta, Georgia from
July, 2011 to June, 2012. (Approved by Public Services Committee
March 7, 2011)
Background:The Augusta-Richmond County Commission annually approves Augusta
Public Transit’s Sec. 5311 Rural Transit grant application to providing rural
transportation service to the citizens of Augusta-Richmond County.
Analysis:The renewal of this contract will allow Augusta Public Transit to continue
providing rural transportation service to the citizens of rural Augusta-
Richmond County.
Financial Impact:The Augusta-Richmond County share of the budget for 2011 and ½ 2012
should be approximately $95,713.
Alternatives:None. By not approving this application, citizens of rural Augusta-
Richmond County will lose the only public transportation available to them.
Recommendation:Approve the submission of the grant.

Allocate funding ($194,000.00) for RCSO to implement Buffer Zone Protection Program

Background:In March of 2010 the Richmond County Sheriff's Office was awarded a
grant in the amount of $194,000.00, from the Department of Homeland
Security (DHS) to implement a Buffer Zone Protection Plan (BZPP) at DSM
Chemicals North America Inc. located on Columbia Nitrogen Rd. in
Augusta/Richmond County Georgia. The grant is administered through the
Georgia Emergency Management Agency. RCSO will use the funding to
build and enhance the capabilities to prevent, protect against, respond to,
and recover from terrorist attacks, major disasters and other emergencies
located at DSM Chemicals.
Analysis:This grant allows RCSO to purchase specialized equipment to implement
the BZPP plan at DSM Chemicals.
Financial Impact:This is a 100% reimbursable grant. Upon purchasing equipment RCSO will
submit request for reimbursement to GEMA.

Recommendation:Allocate funding for RCSO in the amount of $194,000.00 to implement the

Background:In December of 2009 the Richmond County Sheriff's Office (RCSO was
awarded a grant through Department Of Homeland Security (DHS). in the
amount of $42,145.00. This grant is administered by the Georgia Emergency
Management Agency. This funding will allow RCSO to purchase
specialized equipment for the Explosive Ordnance Disposal (EOD) Unit of
RCSO to respond to bomb emergencies.
Analysis:RCSO will purchase specialized equipment for the EOD Unit.
Financial Impact:This is a 100% reimbursable grant, when expenditures are made, RCSO will
submit request for reimbusements to GEMA for payment.

Approve Fiber Cabling for Marshal's Substation

Caption:Motion to approve the installation of fiber optic cabling to provide network
and telecommunications services to the new Marshal's substation at 3050
Deans Bridge Road. (Approved by Public Safety Committee March 7,
2011)
Background:The Marshal's substation is under construction and the new building will
require high-speed connectivity to the City of Augusta network. This
connectivity is needed to support telecommunications services and desktop
computers. Fiber optic communications is the most cost-effective and secure
means to achieve this level of service.
Analysis:Under section 1-10-46 of the Procurement Code, Authority to Contract for
Special Services. IT submitted a form letter, mailing list, and bid
specifications to the Procurement department to send out a bit item. Bid item
#11-088 was mailed to the vendors on the mailing list. The low bid was
from Southeast Utilities of Georgia, Inc.
Financial Impact:The total estimated cost to provide fiber optic cabling to 3050 Deans Bridge
Road is $33,095.00.
Alternatives:There are no viable alternatives to provide the required speed, security and
redundancy.
Recommendation:Approve the installation of this fiber project in order to ensure that high
speed connectivity is available to the Marshal's substation.

Contract Amendment for TFCCi Emergency Notification System

Caption:Motion to approve amendment to existing contract with Twenty-First
Century Communications, Inc. (TFCCI) for Emergency Management.

Background:The Universal Communications System (also known locally as the EMA
Notification System) provides EMA with the ability to create standardized
and custom calling groups to provide notification of emergency events. The
system has been used for various callouts by multiple departments since it
was implemented. Augusta has been a customer with TFCCI since 2007,
and the EMA is satisfied with the level of services that TFCCI has provided.
Analysis:TFCCI has changed its business model and has recommended that Augusta
change to a category that will result in an annual maintenance fee of $9,000
instead of our existing cost of over $13,000. The change also includes a one-
time fee of $1,000 for the creation of a public sign-up page that will enable
citizens to go to the web site and enter their contact information if they wish
to receive emergency notifications. This change is small, but it is being
forwarded for Commission approval since the change is occuring to a
contract that was originally approved by the Commission and signed by the
Mayor in 2007.
Financial Impact:The new agreement saves $3,000 in Operating Budget funds in FY 2011 and
$4,000 per year thereafter.

AMENDMENT NUMBER ONE
TO
UNIVERSAL COMMUNICATIONS SYSTEM AGREEMENT
This Amendment made this day of February 1, 2011 by and between Augusta, Georgia
(hereinafter referred to as “Client”) and Twenty First Century Communications, Inc. (hereinafter
referred to as “Provider”).
WHEREAS, Client and Provider entered into that certain Universal Communication
System Agreement dated October 31, 2007 (the “Agreement”):
WHEREAS, the parties desire to extend the term of the Agreement and replace in its
entirety the Universal Communications System Purchase Order Form attached to the
Agreement; and
WHEREAS, the parties wish to amend certain terms of the Agreement in furtherance of
the foregoing:
THEREFORE, the parties agree as follows:
1. The term for the Agreement shall be extended from February 1, 2011 through January
31, 2014.
2. To delete the “UNIVERSAL COMMUNICATIONS SYSTEM PURCHASE ORDER
FORM” in its entirety and replace with the attached “ALERT SYSTEM PURCHASE
ORDER FORM”.
This Amendment together with the Agreement constitutes the final, complete, and
exclusive statement of agreement between the parties pertaining to the subject matter contained
therein, and supersedes all prior and contemporaneous understandings, conversations, or
agreements between the parties.
This Amendment may be supplemented, amended, or modified only by the mutual
agreement of the parties. No supplement, amendment, or modification of this Amendment shall
be binding unless it is in writing and signed by both parties.

COST.
The cost for TFCC's Alert System is $9,000 annually. A one-time fee of $1,000 will be charged for a Public Sign Up
Page. Annual fee is comprised of $9,000 of system usage applicable to outbound/inbound phone usage, paging, text
messaging and facsimile notification, which shall be deducted at the following rates:
Both inbound and outbound minutes shall be deducted at the rate of $0.25 per minute.
Paging and/or SMS texting shall be deducted at the rate of $.05 per attempt.
E-mails transmitted using the Alert System are free.
Facsimiles shall be deducted at the rate of $0.25 per page.
ADDITIONAL COSTS:
Additional on-site training in excess of initial training shall be billed at the rate of $100 per hour.
Custom programming charges are $180 per hour.
Out-of-pocket travel expenses, after the initial training, related to the installation and maintenance of the TFCC's Alert
System program are billed as incurred and invoiced at actual cost.
The Annual Fee shall be billed on the Effective Date set forth under Section 1 of this Agreement and shall be billed on
that date each year thereafter for the term of this Agreement. Unused system usage may not be aggregated or
carried over to subsequent years.
USAGE AND NOTIFICATION CHARGES:
Usage and notification charges in excess of the initial system usage purchased shall be billed at the following rates:
The basic usage charge for inbound and outbound call will be $0.25 per minute, including carrier long distance
charges. Per call minute pricing is billed on a second-by-second basis with a 30-second minimum. Unless specified
otherwise, all LEC or carrier advanced network features will be passed through at cost, if applicable.
Paging and/or SMS texting shall be billed at the rate of $.05 per attempt.
E-mails transmitted using the Alert System are free.
Facsimiles shall be billed at the rate of $0.25 per page.

Payments later than 30 days, will be assessed a penalty of 1.5% per month.
Client must notify Provider of any disputed charges within nine (9) months from the date of invoice, otherwise Client
will be deemed to agree to such charges, will be precluded from disputing such charges, and Provider will not be
subject to making any adjustments to such charges or invoices.

Motion to Mutual Aid Agreement with the Department of the Army for fire protection services

Caption:Motion to approve Mutual Aid Memorandum of Understanding between
the Department of the Army and the Augusta, GA Fire Department for fire

Background:This is an annual agreement entered into with the Department of the Army
that states that the parties will work in cooperation with one another for fire
protection services. This agreement is consistent with the mutual aid

2011 Swainsboro

Caption:Motion to approve request from Chief Randy Ellison of Swainsboro for the
donation of one 2000 Crown Victoria to be used by Swainsboro Public
Safety. (Approved by Finance Committee March 7, 2011)
Background:Chief Randy Ellison of the Swainsboro Police Department is requesting the
donation of one 2000 Ford Crown Victoria that was assigned to the
Marshal’s Office and was turned in as excess in 2010. His letter of request
is attached for review. In fact it was replaced last year with a newer model
vehicle. The vehicle was held by Fleet Management until the 2011 cars
came in case the Marshal’s Office had a car totaled and a spare car had to be
reactivated. The new cars have arrived and this vehicle is surplus. Augusta
has sold 11 Crown Victoria’s of this year model since January 2010 and the
average for the sale has been $2056.00. The GovDeals auction service fee
would be $154.00 (taken from the sale) which would bring the total revenue
to Augusta at $1,902.00 Swainsboro (Emaual County) has a population of
approximately 7,000 people. The request was made in November of 2010
but for the reason stated above Fleet Management has not processed this
request. I was notified by Chief Ellison that he has lost one of his patrol
vehicles due to mechanical failure of an engine and his need is now
urgent.
Analysis:Donating this vehicle to Swainsboro would result in a loss of revenue of
approximately $2,000, the average sale price of the vehicle at GovDeals.
The Commission has, at times, assisted smaller community Public Safety
offices with donations and in some cases offered vehicles a much reduced
prices. This vehicle was acquired on December 7, 2000 for $24,474.02. It’s
life expectancy is 6 years or 125,000 miles, whichever comes first. Augusta
has no further use for this car.
Financial Impact:Donation of the car will result in an approximate loss of revenue of
approximately $1,900.00 through auction.
Alternatives:1.) Approve the request and donate the vehicle to the City of Swainsboro. 2.)
Deny the request and offer the vehicle to the City of Swainsboro for $2,000
or an amount as determined by the Commission. 3.)Do not approve the
request and sell the vehicle at auction.
Recommendation:Approve the request to donate the vehicle.

Set up Tree Commission Budget

Caption:Motion to approve setting up revenue and expense budgets to record tree
mitigation fees. (Approved by Finance Committee March 7, 2011)
Background:Developers are assessed Tree Mitigation Fees as a result of damages and/or
tree removal brought about by their projects. These funds are intended to be
used for the purchase of trees that will restore and promote beautification
throughout the city, as well as shade and energy conservation and
provide the screening of certain sights and sounds.
Analysis:
Financial Impact:The city currently is receiving funds designated to the Tree Commission for
the purchase of trees. A revenue and an expense budget needs to be put in
place for these funds to be properly recorded.

Recommendation:Approve budgets to record the receipt of these funds and their use as they

Transportation Investment Act of 2010
Department:Planning Commission
Caption:Motion to approve a list of example transportation projects to be submitted
to the GDOT Director of Planning and to the Augusta Metropolitan
Planning Organization. (Approved by Finance Committee March 7, 2011)
Background:The Transportation Investment Act of 2010 (HB 277) authorizes the
imposition of a 1% sales tax, on a regional basis and for 10 years, to pay for
a specified list of transportation projects. The sales tax would be imposed if
a majority of voters in the 13-county CSRA approve the tax in a referendum
on August 21, 2012. As defined in HB 277 " project" means, without
limitation, any new or existing airports, bike lanes, bridges, bus and rail
mass transit systems, freight and passenger rail, pedestrian facilities, ports,
roads, terminal s , and all activities and s tructures useful and incident to
providing, operating, and maintaining the same. The term shall also include
direct appropriations to a l ocal government for the purpose of serving as a
local match for state or federal funding.
Analysis:As an initial step in developing the list of projects, HB 277 specifies that
local governments submit projects to the GDOT Planning Director and the
Augusta Metropolitan Planning Organization for the GDOT Planning
Director to use to assemble a list of "example investments" for the 13-
county region. The "example investments" should meet the investment
criteria established by the CSRA Transportation Roundtable, align with the
Statewide Strategic Transportation Plan and be deliverable within the
timeframe of the regional sales tax period. The list of "example investments"
does not need to be fiscally constrained within the budget of expected
revenue to be generated by the tax. Projects to include on the "Example
Investment List" for Augusta-Richmond County were solicited from the
Engineering Department, Augusta Public Transit, the Augusta MPO, the
Parks and Recreation Department, Augusta Regional Airport and Daniel
Field Airport. The project list is attached. Projects on the Augusta-
Richmond County's "Example Investment List" must be submitted to the
GDOT Director of Planning and the Augusta MPO no later than
Wednesday, March 30, 2011. Projects cannot be added to the list after that
date. Following submission, the Executive Committee of the CSRA
Regional Transportation Roundtable, in collaboration with the GDOT
Planning Director, shall choose from the list of "example investments" to
create a financially-constrained "draft investment list" for the 13-county
CSRA. Once approved by the Executive Coommittee, the "draft investment
list" will then be considered by the CSRA Regional TRansportation
Roundtable. The GDOT Planning Director will deliver the "draft investment
list" to local governments, MPOs' and members of the General Assembly no

the region an opportunity to vote on the transportation sales tax. Should the
CSRA Regional Transportaion Roundtable not approve an investment list to
present to voters, then all local governments in the region shall be required
to provide a 50% match for any local maintenance and improvement grants
(LMIG) provided by the Georgia Department of Transportation.
Financial Impact:No financial commitment necessary at this time. Example Investment List is
not subject to fiscal constraint. If voters approve the 1% transportation sales
tax, collection would begin in 2013 and continue for a period of 10 years.

Caption:Motion to accept as information the agreement between Augusta and Dixie
Riverside (dba A&A Vending) of Augusta, GA to operate the vending
services for the new Judicial Center. Augusta will receive $100 per month

Background:RFP 10-191 was issued in October of 2010. Responses were received in
November. None were compliant. The RFP was reissued as RFP 10-191A.
Two responsive proposals were received.
Analysis:The bid packages were reviewed and ranked in Procurement Conference
Room on February 10, 2011. Preliminary qualification based scoring on the
RFP favored A&A Vending of Augusta. When the pricing component was
opened, A&A had also submitted the highest guaranteed payment to the
owner for privilege of providing service. There is no cost to Augusta. The
vendor has guaranteed a minimum monthly payment of $100 plus 15% of
net sales after sales tax.
Financial Impact:There is no cost to Augusta. The vendor has guaranteed a minimum monthly
payment of $100 plus 15% of net sales after sales tax. This will be
additional revenue source for the general fund (101-00-0000/3419614)
Alternatives:1. Accept as information the agreement between Augusta and Dixie

Parkway, as shown on the attached plat and consisting of 0.058 acres
(2,483.0 square feet), and find that it has ceased to be used by the public to
the extent that no substantial public purpose is served by it or that its
removal from the county road system is otherwise in the best public interest,
which reflects results of a public hearing held March 3, 2011, regarding the
issue of abandonment, pursuant to O.C.G.A. Section 32-7-2, with the
abandoned property to be deeded to K.P. Management, Inc. for the
appraised value, per an appraisal performed by Maxwell Appraisal Group
dated January 31, 2011, upon the approval of site development plans for said
property by Augusta, Georgia, and authorize the Mayor and Clerk of
Commission to execute deed and closing documents as approved by
Augusta Law Department. (Approved by Engineering Services
Committee March 7, 2011)
Background:The Engineering Department has been requested to abandon a portion of
Robert C. Daniel, Jr. Parkway. This portion of Robert C. Daniel, Jr.
Parkway was taken in condemnation by the Georgia Department of
Transportation as part of right-of-way work for Robert C. Daniel, Jr.
Parkway. The Georgia Department of Transportation has recently re-
conveyed the property back to Augusta, Georgia by deed dated November
22, 2010. This property does not serve any parcels with residences or
structures. The abandonment request has been reviewed by all essential
county departments and administrators and no objections were made to this
abandonment request. A public hearing was held March 3, 2011, with no
objectors present. An appraisal performed January 31, 2011 by Maxwell
Appraisal Group deemed the market value of the property as $16,910. The
Engineering Department recommends that, with the deed, a binding
agreement be executed by all parties to ensure the drainage on Parcel C be
kept in place until the site’s proposed system plan is approved by the
Engineering Department and constructed in accordance with the proposed
approved plan, at which time the existing parcel and storm water system will
no longer be required or needed by Augusta, Georgia.
Analysis:In addition to the information provided in the above Background section,
publication notices were made for a public hearing, which was held March
3, 2011. Notice to the property owners located thereon was made, pursuant
to O.C.G.A. §32-7-2(b)(1). There were no objectors present, and these
results are hereby presented to the Commission for their final decision.
Financial Impact:
Cost of publication and advertisement of public hearing. There will be

Transportation Investment Act of 2010

Caption:Motion to approve a list of example transportation projects to be submitted
to the GDOT Director of Planning and to the Augusta Metropolitan
Planning Organization. (Approved by Engineering Services Committee
March 7, 2011)
Background:The Transportation Investment Act of 2010 (HB 277) authorizes the
imposition of a 1% sales tax, on a regional basis and for 10 years, to pay for
a specified list of transportation projects. The sales tax would be imposed if
a majority of voters in the 13-county CSRA approve the tax in a referendum
on August 21, 2012. As defined in HB 277 " project" means, without
limitation, any new or existing airports, bike lanes, bridges, bus and rail
mass transit systems, freight and passenger rail, pedestrian facilities, ports,
roads, terminals , and all activities and structures useful and incident to
providing, operating, and maintaining the same. The term shall also include
direct appropriations to a local government for the purpose of serving as a
local match for state or federal funding.
Analysis:As an initial step in developing the list of projects, HB 277 specifies that
local governments submit projects to the GDOT Planning Director and the
Augusta Metropolitan Planning Organization for the GDOT Planning
Director to use to assemble a list of "example investments" for the 13-
county region. The "example investments" should meet the investment
criteria established by the CSRA Transportation Roundtable, align with the
Statewide Strategic Transportation Plan and be deliverable within the
timeframe of the regional sales tax period. The list of "example investments"
does not need to be fiscally constrained within the budget of expected
revenue to be generated by the tax. Projects to include on the "Example
Investment List" for Augusta-Richmond County were solicited from the
Engineering Department, Augusta Public Transit, the Augusta MPO, the
Parks and Recreation Department, Augusta Regional Airport and Daniel
Field Airport. The project list is attached. Projects on the Augusta-
Richmond County's "Example Investment List" must be submitted to the
GDOT Director of Planning and the Augusta MPO no later than
Wednesday, March 30, 2011. Projects cannot be added to the list after that
date. Following submission, the Executive Committee of the CSRA
Regional Transportation Roundtable, in collaboration with the GDOT
Planning Director, shall choose from the list of "example investments" to
create a financially-constrained "draft investment list" for the 13-county
CSRA. Once approved by the Executive Coommittee, the "draft investment
list" will then be considered by the CSRA Regional TRansportation
Roundtable. The GDOT Planning Director will deliver the "draft investment
list" to local governments, MPOs' and members of the General Assembly no

later than August 15, 2011. Submission of an "example investment list" and
participation in the entire process is advisable in order to give residents of
the region an opportunity to vote on the transportation sales tax. Should the
CSRA Regional Transportaion Roundtable not approve an investment list to
present to voters, then all local governments in the region shall be required
to provide a 50% match for any local maintenance and improvement grants
(LMIG) provided by the Georgia Department of Transportation.
Financial Impact:No financial commitment necessary at this time. Example Investment List is
not subject to fiscal constraint. If voters approve the 1% transportation sales
tax, collection would begin in 2013 and continue for a period of 10 years.
Alternatives:Alternatives Include - 1. Approve the Example Investment List as submitted
2. Approve an Example Investment List with amendments (i.e. additions or
