An Ordinance To Amend the Augusta, GA Code Relating To License To Operate Arcades and Amusement Game

Background:Augusta-Richmond County desires to update and amend the Code as it
relates to license to operate arcades and amusement game permits.
Analysis:This Ordinance would amend the Augusta, GA. Code Sections 6-6-45 and
6-6-46 by repealing them in their entirety, and inserting in lieu thereof
"Exhibit A" and "Exhibit B" attached hereto. These ordinances more clearly
set forth spacing requirements for coin operated amusement machines.
Financial Impact:No immediate financial impact is anticipated.

AN ORDINANCE TO AMEND THE AUGUSTA, GA CODE TITLE SIX
SECTIONS 6-6-45 AND 6-6-46 RELATING TO LICENSE TO OPERATE
ARCADES AND AMUSEMENT GAME PERMIT; TO REPEAL ALL
CODE SECTIONS AND ORDINANCES AND PARTS OF CODE
SECTIONS AND ORDINANCES IN CONFLICT HEREWITH; TO
PROVIDE AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, Augusta-Richmond County desires to update and amend the Code as
related to license to operate arcades and amusement game permit;
THE AUGUSTA-RICHMOND COUNTY COMMISSION, ordains as follows:
SECTION 1. Augusta, Ga. Code Section 6-6-45 as set forth in the Augusta, Ga.
Code, re-adopted July 10, 2007, is hereby amended by striking this section in its
entirety and inserting in lieu thereof new Code Section 6-6-45, restated as set forth
in “Exhibit A” hereto.
SECTION 2. Augusta, Ga. Code Section 6-6-46 as set forth in the Augusta, Ga.
Code, re-adopted July 10, 2007, is hereby amended by striking this section in its
entirety and inserting in lieu thereof new Code Section 6-6-46, restated as set forth
in “Exhibit B” hereto.
SECTION 3. This ordinance shall become effective upon its adoption in
accordance with applicable laws.
SECTION 4. All ordinances or parts of ordinances and Department of License
and Inspections Policies and Procedures in conflict herewith are hereby repealed.

Exhibit A
Sec. 6-6-45. License to operate arcades.
(a) Definitions.
(1) Bona fide coin-operated amusement machine means the same as this term is
defined in O.C.G.A. § 48-17-1(2) and any applicable state regulations;
(2) Location. A business in Augusta-Richmond County which has been issued a
valid business tax certificate;
(3) Arcade. “Arcade” means any location where three or more bona fide coin-
operated amusement machines are operated which permit non-cash redemption
as provided in O.C.G.A. §16-12-35, or a location where ten or more bona fide
coin-operated amusement machines are located, whether or not non-cash
redemption for any machine is allowed.
(4) License. A license issued by the city of Augusta, Richmond County or
Augusta-Richmond County to operate an arcade.
(b) Distance requirements - Plat required. Every application for a license to
operate an arcade in Augusta shall be verified by a plat prepared by a licensed
Georgia surveyor or civil engineer, showing the distance for the proposed
business, as hereafter provided.
(1) No license for the operation of an arcade shall be issued for any location:
i. Within one thousand two hundred fifty (1,250) feet of the property
line of a private residential dwelling;
ii. Within one thousand (1,000) feet of the property line of any public
library or branch of any public library;
iii. Within one thousand (1,000) feet from the property line of any
church, shrine, chapel of a mortuary or other place used exclusively
for religious purposes;
iv. Within one thousand two hundred fifty (1,250) feet of the property
line of any school or college campus. The schools and colleges
referred to herein shall include only such public, private, or church-
supported schools which teach the subjects commonly taught in the
common schools and colleges of this state, and shall not include
private schools or colleges wherein a specialized subject such as law,

stenography, business, music, art, vocational occupations, and other
special subjects are taught;
v. within one thousand (1,000) feet of a regular stop where a school bus
for the transportation of school children in the public schools of
Richmond County shall board or discharge passengers;
vi. Within one thousand two hundred fifty (1,250) feet of any other use
regulated under the Comprehensive Zoning Ordinance of Richmond
County or the Augusta-Richmond County Code; or
vii. Where the proposed location is one and one-half (1½) miles or less
from an existing location for which the Augusta-Richmond County
Commission has issued an arcade license.
(2) The distance requirements set out about shall apply in any and all directions
from the property lines of the proposed location, as measured in a straight line.
The plat shall accompany and be made a part of the application for such license.
(3) In determining whether or not a license applied for hereunder shall be granted,
renewed, transferred or issued to a new location, in addition to all the provisions of
this section, the following shall be considered in the public interest and welfare:
(i) Reputation, character. The applicant’s reputation, character, trade and
business associations or past business ventures, mental and physical
capacity to conduct this business.
(ii) Previous violations of Augusta-Richmond County Code. If the
applicant is a previous holder of an arcade license, whether or not he
has violated any law, regulation or ordinance relating to such
business.
(iii) Manner of conducting prior arcade business. If the applicant is a
previous holder of an arcade license, the manner in which he
conducted the business there under, especially as to the necessity for
unusual policy observation and inspection in order to prevent the
violation of any law, regulation or ordinance relating to such business.
(iv) Location. The location for which the license is sought, as to traffic
congestion, general character of neighborhood, and the effect such an
establishment would have on the adjacent and surrounding property
values.
(v) Number of licenses in trading area. The number of license already
granted for similar business in the trading area of the place for which
the license is sought.

(vi) Previous revocation of license. If the applicant is a person whose
license issued under the police powers of any governing authority has
been previously suspended or revoked or who has previously had an
arcade license suspended or revoked.
(vii) Payment of taxes and other charges. If the applicant and business are
not delinquent in the payment of any local taxes or other fees or
charges.
(viii) Congregation of minors. Any circumstances which may cause minors
to congregate in the vicinity of the proposed location even if the
location meets the distance requirement under section 6-6-45(b)
herein.
(ix) Prior incidents. Evidence that a substantial number of incidents
requiring police intervention have occurred within the immediate area
during the twelve (12) months immediately preceding the date of
application.
(x) Previous denial or revocation. The denial of an application, or the
revocation of a license, occurring within the preceding twelve (12)
months, which was based on the qualifications of the proposed
location.
(xi) Renewal. 1. All licenses granted hereunder are privilege licenses and
shall expire on December 31 of each year. Licensees who desire to
renew their licenses shall file an application therefor, together with the
requisite fee with the License and Inspection Department for
such renewal upon forms approved by the Director of License and
Inspection, on or before December 1 of each year.
(2) All licenses to be renewed for the subsequent calendar year shall be
submitted by the License and Inspection Department to the Commission for
approval no later than December 15 of each year. Any licenses that have
been placed on probation, suspension or have been revoked by the
commission during the year shall be submitted on a separate list by the
License and Inspection Department for review and consideration for
approval.
(3) No license shall be grandfathered as to any provision of this section.

(c) Individuals not eligible for license. The following individuals are not eligible
for an arcade license.
(1) A person or persons or any of the officers and directors who have been
convicted of a felony in any jurisdiction. A conviction, for purposes of this
paragraph, includes a guilty plea or plea of nolo contendere.
(2) A person or persons or any of the officers and directors who have been
convicted of a non-felonious crime of moral turpitude, lottery, or illegal
possession and sale of narcotics or liquors within the five (5) years
preceding the filing of the application. A conviction, for purposes of this
paragraph, includes a guilty plea or a plea of nolo contendere.
(3) A person whose license to operate an arcade has been revoked for cause in
any state or territory of the United States within the ten (10) years preceding
the filing of the application.
(4) A person who has knowingly falsified information or made any material
misrepresentation on the application for a license under this Ordinance or
any application under the predecessor Ordinance for Richmond County or
the City of Augusta submitted within the ten (10) years preceding the filing
of the application.
(5) Should any such applicant, partner or officer or director of any applicant
entity, after a license has been granted, by convicted or plead guilty or nolo
contendere to a crime involving moral turpitude, or to the violation of any
laws of the State of Georgia regulating gambling or the lottery laws, said
license shall be subject after hearing to immediate suspension or revocation.
(d) Proper zoning required. No license shall be issued for the operation of an
arcade unless the license holder’s place of business is located in an area within
Augusta-Richmond County that is properly zoned.
(e) Business Tax Certificate required. Any person, firm or corporation who
owns, operates or does business in the unincorporated area of the county as an
arcade is required to obtain a business tax certificate in accordance with the
Augusta-Richmond County Code.
(f) Regulatory fee. Any person, firm or corporation who owns bona fide coin-
operated amusement machines and place the machines in a arcade operating in the
unincorporated area of Augusta-Richmond County is required to pay such

regulatory fee as provided in section 2-1-3(c) of the Augusta-Richmond County
Code.
(g) Application for license. All applicants for a license to operate an arcade
shall give notice of their intention to make such application by advertisement in the
form prescribed by the county license inspector. Advertising as referred to in this
section means there shall be a sign posted thirty (30) days prior to the hearing of
the application in a prominent position on the property (front window where it can
be read from the road); also, all new business tax certificate applicants shall be
required to advertise three (3) times in the legal gazette (Augusta Chronicle) before
applications are heard by the county commission. Advertising in the newspaper
shall be during the thirty-day period prior to the hearing of the application by the
Augusta-Richmond County Commission. Before the application is presented to
the Commission Counsel, the applicant shall furnish proof that the advertisement
has been completed as required hereinabove.
(h) Right of suspension by License & Inspection Department. The License &
Inspection Department shall have the right to suspend any license issued under this
article whenever a person, firm or corporation doing business shall deviate from
the normal operation for which the business tax certificate was obtained or fails in
performance to meet the required regulations and code set forth by the License &
Inspection Department, sheriff’s department or health department; or violates any
law or ordinance of the United States, or the state or Augusta-Richmond County, in
pursuance of such business conducted under such license; or when it shall be
proven before the License & Inspection Department that there is a violation of a
nuisance law; or when the health, morals, interests and convenience of the public
demand the suspension of such license. The License & Inspection Department
shall report the suspension of such license to the next regular or called meeting of
the Augusta-Richmond County Commission; then the license shall be suspended,
placed on probation or permanently revoked, or otherwise it shall be restored and
remain in full force.
(i) Cost of arcade license. The cost of the arcade license is one hundred dollars
($100.00) and must be submitted at the time that the application and other
documentation is submitted to the local government officials.
(j) Penalty for violation of article. All persons, firms or corporations failing to
comply with the mandatory provisions of this article or doing any act prohibited in
this article shall be guilty of an offense, and, upon trial as a misdemeanor and
conviction, shall be as provided in section 1-6-1 of this Code.

Sec. 6-6-45 License to operate arcades.
(a) Definitions.
(1) Bona fide coin-operated amusement machine means the same as this
term is defined in O.C.G.A. § 48-17-1(2) and any applicable state
regulations and of this code.
(2) Location. The physical location of a business in Augusta-Richmond
County which has been issued a valid business tax certificate;
(3) Arcade. “Arcade” means any location where three (3) or more bona
fide coin-operated amusement machines are operated which permit non-cash
redemption as provided in O.C.G.A. § 16-12-35, or a location where ten (10) or
more bona fide coin-operated amusement machines are located, whether or not
non-cash redemption for any machine is allowed. Coin operated amusement
machines shall be placed at least two (2) feet apart and have four (4) feet of free
space in front of the machine separate and apart from walking aisles.
(4) License. A license issued by Augusta-Richmond County to operate an
arcade.
(5) Hours of Operation: All amusement devices within the premises shall
be visible to and supervised by an adult attendant who shall be present at all times
when any amusement device is being operated. During the normal school year,
persons under the age of eighteen (18) shall not be allowed to operate amusement
devices Monday through Friday, except legal school holidays, between the hours
of 8:00 a.m. and 3:00 p.m., unless accompanied by an authorized agent of the
school district or such person’s parent or guardian. It shall be the responsibility of
the adult attendant to enforce this regulation. The operator shall prominently
display the hours of permitted operation.
(b) Distance requirements – Plat required. Every application for a license to
operate an arcade in Augusta-Richmond County shall be verified by a plat
prepared by a licensed Georgia surveyor or civil engineer, showing the distance for
the proposed business, as hereafter provided.
(1) No license for the operation of an arcade shall be issued for any location:

i. Within one thousand two hundred fifty (1,250) feet of the property
line of any school or college campus. The schools and colleges
referred to herein shall include only such public, private, or church-
supported schools which teach the subjects commonly taught in the
common schools and colleges of this state, and shall not include
private schools or colleges wherein a specialized subject such as law,
stenography, business, music, art, vocational occupations, and other
special subjects are taught; or
ii. Within one thousand two hundred fifty (1,250) feet of any similar
use regulated under the Comprehensive Zoning Ordinance of
Richmond County or the Augusta-Richmond County Code.
(2) The distance requirements set out above shall apply in any and all directions
from the property lines of the proposed location, as measured in a straight line.
The plat shall accompany and be made a part of the application for such license.
(3) In determining whether or not a license applied for hereunder shall be granted,
renewed, transferred or issued to a new location, in addition to all the provisions of
this section, the following shall be considered in the public interest and welfare:
(i) Reputation, character. The applicant’s reputation, character, trade and
business associations or past business ventures, mental and physical
capacity to conduct this business.
(ii) Previous violations of Augusta-Richmond County Code. If the
applicant is a previous holder of an arcade license, whether or not he
has violated any law, regulation or ordinance relating to such
business.
(iii) Manner of conducting prior arcade business. If the applicant is a
previous holder of an arcade license, the manner in which he
conducted the business there under, especially as to the necessity for
unusual policy observation and inspection in order to prevent the
violation of any law, regulation or ordinance relating to such business.
(iv) Location. The location for which the license is sought, as to traffic
congestion, general character of neighborhood, and the effect such an
establishment would have on the adjacent and surrounding property
values.

(v) Number of licenses in trading area. The number of license already
granted for similar business in the trading area of the place for which
the license is sought.
(vi) Previous revocation of license. If the applicant is a person whose
license issued under the police powers of any governing authority has
been previously suspended or revoked or who has previously had an
arcade license suspended or revoked.
(vii) Payment of taxes and other charges. If the applicant and business are
not delinquent in the payment of any local taxes or other fees or
charges.
(viii) Congregation of minors. Any circumstances which may cause minors
to congregate in the vicinity of the proposed location even if the
location meets the distance requirements under section 6-6-45(b)
herein.
(ix) Prior incidents. Evidence that a substantial number of incidents
requiring police intervention have occurred within the immediate area
during the twelve (12) months immediately preceding the date of
application.
(x) Previous denial or revocation. The denial of an application, or the

location.
(c) Purpose of servicing a permit. The purpose of securing a permit is to provide a
record of machine owners who owe bona fide coin-operated amusement machines
and have placed those machines in a business in Augusta-Richmond County.
(d) Failure to apply for permit. The failure of a machine owner to apply for a
permit under this article shall result in a fine of fifty dollar ($50.00).
(e) Affect on machine owner’s other statutory duties. This article applies
independently from and has no affect on other statutory obligations of an
amusement machine owner within this Code.
Sec. 6-6-46. Amusement game permit.
(a) Definitions.
(1) Bona fide coin-operated amusement machine means the same as this term is

Background:The Mayor's Masters Reception Committee is a non-profit group that
manages and operates the annual city reception for visitors every April., and
the Recreation and Parks Dept. supports the event with in-kind services that

dept. were eliminated in the 2009 budget, leaving a void in this important
area of professional development.

Analysis:Seven firms participated in a mandatory pre-bid conference with four firms
submitting bids. Of the four submittals, two were deemed non-compliant
leaving two valid bids.Upon review of the bids and upon a recommendation
of award from our consultants, a recommendation to proceed with Hebbard
Electric is being forwarded to the Augusta Commission for approval.(See
Attachments)
Financial Impact:Funds are in place to make an award of bid to the low responsive buidder,
meeting all of the requirements requested in the amount of $65,721.00

Caption:Motion to approve Augusta Public Transit’s purchase of six (6) paratransit
vehicles from National Bus Sales and Leasing, Incorporated for $554,412.
Background:The vehicles will be purchased using State of Georgia Contract Number
48400-0000003154. The cost per vehicle is $92,402.
Analysis:The purchase of the vehicles will upgrade the fleet and allow for the
retirement of older model paratransit vehicles. FTA pays 80% of the cost;
GDOT pays 10%, and Augusta-Richmond County the remaining 10%.

Resurfacing of Tennis Courts

Caption:Motion to approve Bid Item #09-092, Resurfacing of Tennis Courts, to Court
Makers, Inc., for $85,453.33. (Approved by Public Services Committee July
13, 2009)
Background:In an effort to keep the City's tennis courts safe and playable for the general
public, court resurfacing needs to take place on a regular basis. Through the
SPLOST program, funds have been approved for improvements to our parks to
include this service.
Analysis:A total of seven (7) vendors submitted bids on this project. Four (4) of the
submittals wrere deemed non-compliant by the Procurement Department. Of the
three (3) remaining bids, CourtMakers, Inc., had the lowest responsive bid that
met all the requirements as requested through the sealed bid.(See Attached)
Financial Impact:The low responsive bid price for this work is $85,543.33. Funds have been
identified through the SPLOST program to cover the cost incurred to resurface
the tennis courts.

The local bidder preference program is applicable to this project. To be approved as a

Background:BlueCross BlueShield of Georgia has offered Augusta-Richmond County a
0% renewal for fully insured Health Insurance coverage in 2010. · Augusta
has more than 2,400 employees eligible for the medical plan. · Premiums
are split 77.5% Employer/22.5% Employee. · The total cost for this year will
be approximately $18.5 million. · The plan is currently funded using a fully-
insured arrangement with BCBSGA. · Most groups of Augusta’s size are
self-funded since this size group is a predictable risk. · Augusta questioned
what would have likely been the outcome had it been self-funded over the
past 3 years
Analysis:Highlights of a Fully-insured funding arrangement • Predictable monthly
cash flow • All administrative issues are BCBSGA responsibility and
Augusta is not involved outside of eligibility and premium payment • All
appeals and special requests must go through and be approved by
BCBSGA • BCBSGA takes all risk for the medical plan • Augusta has no
ability to modify the plan outside of BCBSGA’s plans that have been filed
with the State and has no authority regarding special requests • Augusta
saves when claims costs exceed premiums but it loses when premiums
exceed claim costs Highlights of a Self-funded arrangement • Unpredictable
monthly cash flow • Administrative and plan related decisions become
Augusta’s responsibility • All appeals and special requests must go through
Augusta • Augusta takes all risk for the medical plan, but the risk may be
reinsured through stoploss insurance • Augusta has full flexibility to design
its plan as long as the claims administrator’s systems can accommodate it •
Augusta must protect itself though reinsurance for years where claims costs
exceed premiums and it will benefit when funding rates (premium
equivalents) exceed claim costs Benalytics Consulting Group analyzed the
past 3 years’ claims experience • Fully-insured premiums paid during 2006,
2007 and 2008 were compare to the actual claim cost and estimated fixed
cost for the same period • It was determined that there would have been

even with the overall plan costs • Claims projections for 2010 would suggest
an increase of approximately no more than 7%, BCBS initially proposed a
2.1% (approximately $400,000) increase for 2010. After negations this was

Suggested strategy • Look to move forward on a self-funded basis in the
near future • Make sure all processes and procedures are in place to

accommodate the additional responsibility • Remain with BCBSGA on a
fully-insured basis for an additional year as long as their renewal is below

this year would not be advised • Augusta did a medical RFP in 2008 and if it
continues to go to the market with such frequency, the market will begin to
lose interest due to a lack of long term commitment • Even if the decision to
go self-funded is immediate, remaining with BCBSGA would be advised in
order to maintain program continuity during the transition • Transitional cost
of approximately $500,000 (training, publication, overtime, plan disruption,
coordination of current care benefits, etc.)

2008 Congressional Earmarked Funds (COPS 2009 Technology Grant)

Earmarked Funding (COPS 2009 Technology Grant) to reflect increased
revenue in the amount of $350,000 which will be utilized to continue
funding the Mobile Data Terminal (MDT) Program. (Approved by Public
Safety Committee July 13, 2009)
Background:The RCSO MDT program began in 1998. The goal of the Sheriff's Office is
to have MDT's active in all Uniformed and Criminal Investigation Division
field vehicles. Although new MDT's are still being installed in vehicles that
had not been previously equipped, some earlier MDT units are being
replaced due to age and outdating. MDT's allow for warrant checks on
suspects, stolen inquiries on property (vehicles, weapons, electronics, etc.),
and the ability to enter and file police reports electronically. Previous
LLEBG and JAG funding programs have provided the RCSO the
opportunity to install, operate, and maintain the MDT's.
Analysis:
Financial Impact:Funding Source: 2008 Congressionally Earmarked Funds (designated for
FY2009 COPS Technology). Federal Funding = $350,000. Local Funding =
$0 (No local match required)
Alternatives:Permit the loss of the present opportunity to continue to implement and
upgrade MDT technology with minimal cost to the taxpayer. Failure to
continue to purchase and implement a proven tool in law enforcement which
permits: 1) A safety factor for front-line personnel with direct, quick access
to criminal histories, photographs, and other pertinent data; 2) A higher
arrest rate for criminal offenders with outstanding warrants; 3) A higher
recovery rate for stolen property; and 4) Less "out of service" time for
Sheriff's Office personnel allowing more time for their primary duties.
Recommendation:Approve the 2009 budget amendment for the continued purchase of Mobile
Data Terminals for the Richmond County Sheriff's Office utilizing funding
from the 2008 Congressionally Earmarked Funds (for FY2009 COPS
Technology).

2009 General Fund Vehicles

Caption:Motion to approve the replacement of 8 vehicles of the general fund
departments through the Georgia State Vehicle Contract program from the
General Fund Capital Outlay. (Approved by Finance Committee July 13,

Background:Fleet Management submits yearly bids to the various vehicle vendors in
order to replace older inefficient vehicles in the fleet. The manufacturers
will allow governmental reduced pricing for a delegated amount of time
until those particular vehicles are sold out. This year the bid cutoffs were
enacted before the final budget for Capital Outlay was determined, thereby
eliminating replacement purchases for the proposed vehicles. The only
other alternative is to utilize the Georgia State Contract program whereby
most vehicles have been bidded by the state from various vendors. This
assures competative bidding and the best pricing for each type of vehicle
state wide. Evaluations of vehicles to be replaced and order sheets are
included as attachments.

Powder Works Chimney
Department:Augusta Canal Authority
Caption:Motion to approve transfer of ownership of Powder Works Chimney to the
Augusta Canal Authority and $52,000 for renovations. (Approved by
Finance Committee July 13, 2009)
Background:The Confederate States Powder Works Chimney is all that remains of an
immense facility consisting of 26 buildings on a tract of 140 acres that
extended two miles along the Augusta Canal. At the beginning of the war
not a single pound of gunpowder was being made in the South. The facility
between April 1862 and April 1865 manufactured almost all of the
gunpowder for the Confederacy- a total of almost 3 million pounds of the
highest grade available. The facility was designed by C. Shaler Smith and
built by Col. George Washington Rains for $385,000. On October 31, 1872
at the conclusion of the war, the buildings and property was purchased by
the City of Augusta for $32,000 and the buildings demolished except for the
great chimney. In a speech before the Augusta City Council in 1872 Col.
Rains urged the preservation “of the noble obelisk (chimney) to remain
forever as a fitting monument to the dead heroes who sleep on the
battlefields of the South”. The towering brick chimney with a base of 19
feet and 168 feet in height stands out against the Augusta skyline as a
monument to those who gave their lives during the War Between the
States. It remains intact today as the only remaining structure built by the
Confederacy . Since the demolition of the adjacent buildings in 1872
minimum maintenance has been performed on the chimney-a testament to
the excellent design and workmanship. On June 2, 1897, the City Council of
Augusta granted custody of the Chimney to The Confederate Survivors
Association for its continued preservation. This custodial responsibility has
now been transferred to Camp #158, Brig. Gen. E. Porter Alexander of the
Sons of the Confederate Veterans Inc. There is evidence of vegetation
growing from the bricks at the top of the chimney. Roots from this growth
weakens the mortar and has caused the bricks to start falling. This of course
is both a safety and a structural concern. There are no threats to the historic
property from development but its current physical condition and structural
integrity is of grave concern
Analysis:The Augusta Canal Authority received a grant from the GA Department of
Natural Resources in 2003 to prepare a structural assessment of the
chimney. This report, completed in July 2003, found the following
conditions: • Several small areas of loose brick that present a falling hazard.
• The lightning protection system is improperly anchored and is not
anchored. • There are areas of significant mortar erosion that are several
inches deep-more significant towards the top of the chimney. • There is one
vertical crack ¾” inches wide on the west face that is approximately 40’

long. • Significant plant growth at top of the chimney. • The remains of the
upper part of the interior liner had collapsed and had been removed from the
base. The current cost of these repairs is $192,000. The Sons of the
Confederate Veterans have raised $140,000 toward the cost of these repairs
and the Canal Authority has requested that the balance be provided by the
City. The Authority will administer the construction contract. The Sons of
the Confederate Veterans, appearing before the Commission on March 24th,
requested that the ownership of the chimney be transferred to them. It is our
recommendation that ownership of the chimney more appropriately should
be with the Canal Authority. The chimney is located within the boundary of
the historic Augusta Canal National Heritage Area.
Financial Impact:Funds are in 2009 capital budget allocation

expose the public to the safety hazard of falling bricks

Rate adjustment for opening and closing of graves

Caption:Motion to approve request to raise the Interment rates to reflect the actual
cost of the service and approve budget amendment for $10,000 for Acct.

Background:The current budget was created to reflect 2008 prices. The bids we received
in January 2009 for these services, however, were much higher than our
approved budget. Therefore, we are experiencing a financial deficit. The
current cost for this service is: $250.00, $75.00 for persons under 12
years of age and $50.00 for cremation or stillborn. We have not had a rate
increase for this service since 1990. We have completed an analysis of city-
maintained cemeteries in Rome, Macon, and Savannah, Georgia, along with
several local cemeteries, to ensure that the proposed rate increase is in line
with the geographical area.
Analysis:The budget was set for $200.00 per burial, whereas it costs $500.00 per
burial, leaving us in a deficit per burial of $300.00. Please see the attached
strategy to eliminate this shortcoming.
Financial Impact:January-June 2009 we had an approximate $5,000.00 budget deficit. We
managed to do budget transfers to make up this deficit however, we won't be
able to do this for the second half of the year.
Alternatives:1. Approve request to raise the Interment rates to reflect the actual cost of
the service and approve budget amendment for $10,000 for Acct.

closing in-house; start-up cost approximately $75-100,000, increase operator
salary by 15 percent. 3. Do not approve rate increase and continue budget
deficit.

Caption:Motion to approve Co-Location Lease Terminations for Wireless
Communications Facilities on Utilities Jake Ellis Road, Kipling Road and
Fairington Road Water Storage Tanks. (Approved by Engineering
Servcies Committee July 13, 2009)
Background:Under agreements approved by the Commission, Utility Service
Communications Company (USCC) provides AUD the service of managing
wireless communications facilities on some of its water tanks. This
agreement calls for a sharing of new and renegotiated revenues and provides
for complete management including marketing, application processing,
contract negotiation, contract preparation and liability, and payment
collection. USCC keeps 30% of the revenues collected and pays 70% of
total revenue to Augusta.
Analysis:AT&T, formerly Cingular, approached AUD to renegotiate its agreements in
order to add additional antennas to the tanks noted above. Per our
agreement, USCC renegotiated the contracts and will supervise the changes
to the tanks. Finalizing these new agreements requires termination of the
existing leases. The new leases are agreements between USCC and AT&T.
Financial Impact:The previous leases provided for total annual rent for the next year of
$53,988, with a 1.2% increase thereafter, collected and administered by
AUD. The new leases provide for total revenue to AUD over the next twelve
months of $57,960 that will increase at the rate of 3% per year thereafter,
and gives complete administrative duties to USCC.
Alternatives:1) Approve this item and provide for increased revenue and the best
management of wireless communications facilities on the water tanks. 2) Do
not approve this item. Due to lack of expertise by AUD in this area, this
action would leave AUD in a difficult position as we continue our revenue
opportunities in the wireless market when current customers want to add
equipment.
Recommendation:We recommend the Commission approve the co-location lease terminations
for wireless communications facilities on Utilities Jake Ellis Road, Kipling
Road and Fairington Road water storage tanks.

Caption:Motion to approve a resolution creating street lighting districts. (Approved
by Engineering Services Committee July 13, 2009)
Background:The Engineering Department has been petitioned by the citizens requesting
street lighting in their neighborhood pursuant to a 1971 Commission
Resolution authorizing the creating of Street Lighting Districts. The
petitioners agree to pay for all costs associated with the installation, ongoing
maintenance and energy.
Analysis:Currently, street lighting is non-existing in these areas. Street lighting has
been an effective measure to increase pedestrian and vehicular safety, assist
in crime prevention, and to promote businesses and community pride.
Financial Impact:Street Lighting Districts are funded by a self supporting fund. Street
Lighting charges vary based on the type lighting requested or required,
billable front footage, and light wattage and spacing. Costs for the subject
districts follow: Lighting District No. 343 $1.15
