CALLED COMMISSION COMMISSION CHAMBER
July 19, 2011
Augusta Richmond County Commission convened at 4:45 p.m., Tuesday, July 19, 2011,
the Honorable Deke Copenhaver, Mayor, presiding.
PRESENT: Hons. Lockett, Guilfoyle, Mason, Smith, Aitken, Johnson, Jackson, Bowles
and Brigham, members of Augusta Richmond County Commission.
ABSENT: Hon. Hatney, member of Augusta Richmond County Commission.
Mr. Mayor: We’ll call the legal meeting to order. Mr. MacKenzie.
1.LEGAL MEETING
A.Pending and potential litigation
Mr. MacKenzie: I would entertain a motion to go into legal to discuss pending and
potential litigation.
Mr. Mayor: Can I get a motion to that effect?
Mr. Brigham: So move.
Mr. Johnson: Second.
Mr. Mayor: We have a motion and a second. If there’s no further discussion,
Commissioners will now vote by the usual sign of voting.
Mr. Aitken out.
Motion carries 8-0.
Mr. Mayor: We are in legal.
[LEGAL MEETING]
Mr. Mayor: We’ll call the meeting back to order. Mr. MacKenzie.
2.Motion to authorize execution by the Mayor of the affidavit of compliance with
Georgia’s Open Meeting Act.
Mr. MacKenzie: I would entertain a motion to execute the closed meeting affidavit.
Mr. Lockett: Move to approve.
Mr. Mayor: We have a motion. Is there a second?
Mr. Johnson: Second.
Mr. Mayor: We have a motion and a second. If there’s no further discussion,
Commissioners will now vote by the usual sign of voting.
Motion carries 9-0.
Mr. Mayor: Mr. MacKenzie.
Mr. MacKenzie: I would entertain a motion to add and approve a settlement
resolution for the case captioned “Thompson Building and Wrecking Company, Inc. vs.
Augusta, Georgia in the aggregate amount of $225,000 authorizing the Administrator to
disburse this amount and waiving the Augusta, Georgia Code of Ordinances in conflict for
this instance only.”
Mr. Mayor: Can I get a motion to that effect?
(No response)
Mr. Mayor: Can we get a motion to that effect?
Mr. Bowles: So move.
Mr. Mayor: So move from Commissioner Bowles. Is there a second?
Mr. Lockett: Second.
Mr. Mayor: We have a motion and a second. If there’s no further discussion,
Commissioners will now vote by the usual sign of voting.
Mr. Mason votes No.
Motion carries 8-1.
Mr. Mayor: If there’s no further business to come before the body, we stand adjourned
on the legal meeting.
