CALLED MEETING COMMISSION CHAMBER
February 7, 2011
Augusta Richmond County Commission convened at 12:00 Noon, Monday, February 7,
2011, the Honorable Deke Copenhaver, Mayor, presiding.
PRESENT: Hons. Lockett, Guilfoyle, Mason, Smith, Johnson, Jackson, Bowles and
Brigham, members of Augusta Richmond County Commission.
ABSENT: Hons. Hatney and Aitken, members of Augusta Richmond County
Commission.
Mayor Copenhaver called the meeting to order.

Mr. Smith: So move.
Mr. Lockett: Second.
Mr. Johnson out.
Motion carries 7-0.

Mr. Mayor: Okay, if everybody’s ready to go, I’m going to go ahead and call the
meeting back to order. Mr. MacKenzie.
Mr. MacKenzie: I would entertain a motion to execute the Closed Meeting
Affidavit.
Mr. Mayor: Can I get a motion to that effect?
Mr. Lockett: So move.
Mr. Johnson: Second.
Mr. Mayor: We have a motion and a second. Commissioners will now vote by the usual
sign.
Motion carries 8-0.
Mr. Mayor: Mr. MacKenzie.

Mr. MacKenzie: I’ll turn it over to Dan Hamilton with regard to two settlements.
Mr. Hamilton: I have two settlement resolutions to summarize for our record prior
to submitting them in written form for execution and attestation and with the unanimous
consent of this body. The first in the case of Augusta, Georgia vs. Ms. Keisha Martin, Civil
Action File No. 2010-RCCV-803 for the payment of $7,500 in addition to the initial
payment of $30,000 made into the registry of the court on or about October 19, 2010, also
authorizing the County Administrator to disburse the amount of $7,500 to the Clerk of
Court to satisfy the consent final judgment to be entered in the case and waiving any
applicable Augusta Richmond County Code Ordinances and Sections in conflict for this
instance only and secondly, a similar resolution authorizing the settlement of an appeal
filed by condemnee, James L. Hamrick, Jr., in the pending condemnation lawsuit styled
Augusta, Georgia vs. James L. Hamrick, Jr. et al, Civil Action File No. 2009-RCCV-13 for
the payment of $77,280 in addition to the initial payment of $52,720 made into the registry
of the court on or about January 5, 2009 authorizing the County Administrator to disburse
the amount of $77,280 to the Clerk of Court to satisfy the consent final judgment to be
entered in this case waiving Augusta Richmond County Code of Ordinances and Sections
in conflict for this instance only and for other purposes. Through General Counsel I’ll
submit the written resolutions for their appropriate execution and attestation.
Mr. Mayor: Do we have unanimous consent to add these items? Okay, can I get a
motion to approve?
Mr. Johnson: So move.
Mr. Smith: Second.
Mr. Mayor: We have a motion and a second. If there’s no further discussion –
Mr. Brigham: Mr. Mayor.
Mr. Mayor: Commissioner Brigham.
Mr. Brigham: On that first settlement, where’s that at, Dan? You gave us an address on
the second one but you didn’t on the first one.
Mr. Hamilton: This particular address is not listed in this written version but it’s located
in the Belair Hills Subdivision.
Mr. Brigham: Thank you.
Mr. Mayor: Okay, if there’s no further discussion, Commissioners will vote by the usual
sign of voting.
Motion carries 8-0.

Mr. Mayor: Mr. MacKenzie.
Mr. MacKenzie: Our next item would be a motion to add to the agenda a motion to
waive attorney/client privilege to release part of General Counsel’s opinion relative to the
Commission’s authority to reorganize Augusta, Georgia departments.
Mr. Lockett: Move to approve.
Mr. Johnson: Second.
Mr. Mayor: And we had unanimous consent to add?
Mr. Brigham: I don’t think we ought to be voting on this in public. I think we either
ought to do it or ought not to.
Mr. MacKenzie: First you need unanimous consent to add it on. Is there a question with
regard to actually voting on the item?
Mr. Mayor: We did have unanimous consent to add, correct?
Mr. Brigham: No, sir.
Mr. Mayor: Okay.
The Clerk: Mr. Brigham’s objecting to adding that.
Mr. Mayor: Okay. We don’t have unanimous consent. Mr. MacKenzie, is there
anything else?
Mr. MacKenzie: That’s all I have. Thank you.
Mr. Mayor: Okay, if there’s no further business to come before the body, we stand
adjourned.
