Bob YOWlg, Mayor; Colclough, Chairman; Smith, Co- Chairman; Hankerson and Sims, members; Rob Sherman, License & Inspections Director; Harry James, Attorney; Fred Russell, Administrator; Lena Bonner, Clerk of Commission. Also Present: Hon. Cheek, Commissioner. 1. Approve forfeiture of Surety Bond for Mr. Eddie Trimble, d/b/a Trimble Construction. Mr. Sherman: These are the Riveras and they own the property where the work was to be done. They hired Mr. Trimble to pour a slab for a garage to be added later to their home. Mr. Trimble started the work and did not complete it due to some work that did not comply with codes. He removed some concrete from the footings and then left the job and did not come back. They tried to get him to come back and complete the work, but later decided to sever the relationship and he said he would give them back their money. By early March he had not returned the money and they asked us that the surety bond be forfeited. The claim was for $3,700.00. Mr. Richard Ingram: I am here on behalf of Mr. Trimble and he would like to give some testimony. Mr. Trimble: He never gave me that amount of money. The job was for $4,000 and he didn't have the money to pay me except through a credit card. He gave me about $300 or $400 in cash and he paid for the concrete. He also paid for the rental of the bobcat and some blocks which were to be laid in the footing. I told him to save some money he could cut out the footing. Ifhe poured the driveway now he would have to come back and cut the footing out and then support the load for the garage that he would build later on. I went ahead and got that approval. They got a variance to build the garage, but I was just going to pour the driveway at this time. I poured the driveway but he said he wasn't satisfied with it because it was a rough finish. It was some time before he complained about the finish and they went out of town for a while. When they came back, they wanted me to pay for the whole thing. If I had had the right amoWlt of money to do the job, it would have been done right. Mr. Sherman: Mr. Trimble had another job going on down the street from this one and he had his men working on that job also. He didn't get to come back and finish this job off the way it needed to be. The reason he didn't actually receive the cash in his hand was because he used some of the money through the credit card to buy additional concrete for another job. Based on the itemized list you have, they're saying that they paid him approximately $3,300 out of a $4,000 contract. Trying to figure out the payments is a nightmare because it involved both credit card and cash payments. 1 Mr. Rivera: He worked on the job from September through November. We went on vacation in December, and he had told us the job would be finished when we came back. It was never finished and we decided not to continue with him. I After further discussion, Mr. Sherman: I recommend that you approve forfeiture of the bond so that they can correct their project and Mr. Trimble can renew his $5,000 bond. Mr. Smith: I so move. Ms. Sims: Second. After additional discussion, Mr. Hankerson: We need something in place with receipts saying that this is the amount that the individuals are in debt in the project. I would like to offer a substitute motion that we approve it upon the receipts being provided with the amount of money that they paid and that they have this by the full Commission meeting on Tuesday. Mr. Smith: Second. Motion adopted unanimously. 2. Approve an amendment to Augusta Richmond County Code Title 4, Chapter 2, Section 74 to prohibit the outside storage of tires where water could accumulate in such stored tires. (Referred from May 3 Commission meeting) I Mr. Boyles: I had mentioned in the last Commission about Ms. Turner coming from the Board of Health to talk about this, and she will not be available until next Tuesday at the Commission meeting. Mr. Cheek: We had also asked for information about departments that are spreading larvacide and the quantity that has been consumed. Mr. Russell: They are still gathering that data and it should be available by the end of the week. Ms. Sims: I make a motion that we bring this forward to the full Commission meeting. Mr. Smith: Second. Mr. Hankerson noted that that there was a business on Molly Pond Road that had many tires stored there. Motion adopted Wlanimously.
