Bob Young, Mayor; Smith, Co-Chairman and Acting Chairman; Colclough, Chairman; Hankerson and Sims, members; George Kolb, Administrator; Daniel Hamilton, City Attorney's Office; Steve Shepard, Attorney; Rob Sherman, License & Inspections Director; Larry Harris, License & Inspections Dept.; Richard Elim, Sheriff's Dept.; Peggy Seigler, Asst. Administrtor; Lena Bonner, Clerk of Commission. Also Present: Hons. Williams, Beard, Grantham, Mays, Commissioners. 2. New Application: A.N.04-06: A request by William H. Islar for an on premise consumption Liquor, Beer & Wine license to be used in connection with Utopia Enterprises, Inc. located at 2508 Peach Orchard Rd. There will be Sunday sales. District 2. Super District 9. Mr. Islar: My name is William Islar and my address is 3429 McAlpine Drive, Augusta, Ga. Mr. Sherman: The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. There are no objectors present. I Mr. Hankerson: I move for approval. Ms. Sims: Second. Motion adopted unanimously with the Chairman out. 3. Discussion: A request by Lee Holtman for a Therapeutic Massage license to be used in connection witb Augusta Center 4 Massage located at 211 Pleasant Home Road, Suite B-3. District 7. Super District 10. Mr. Holtman: My name is Lee Holtman and my address is 2506 Castlewood Drive, Augusta, Ga. Mr. Sherman: The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. Mr. Hankerson: I move for approval. Ms. Sims: Second. I Motion adopted unanimously with the Chairman out. I 4. Discussion: A request by Laurie L. Pratt for a Therapeutic Massage Operators license to be used in connection with Serenity Day Spa located at 504 Sharlom Drive. District 7. Super District 10. I Ms. Pratt: My name is Laurie Pratt and my address is 6682 Ridge Road, Appling, Ga. Mr. Sherman: The Sheriffs Department and License Department have reviewed the application and recommend that it be approved. Mr. Hankerson: Do you have copies of the licenses of the massage operators who work there? Mr. Sherman: She is applying for the operator's license. We can confirm that the employees are still working there and are licensed and add them to this file. Mr. Colclough: Shouldn't those be a part of our package? Mr. Sherman: We can include that in the future. After further discussion, Mr. Colclough: I'd like to make a motion that we pass this contingent on her providing us with her business license people by Tuesday. Mr. Hankerson: I second that. I Motion adopted unanimously. 5. Discuss tbe non-compliance of Get-it-to-Go Junkyard located on Glass Factory Ave. and Savannah Road. (Requested by Commissioner Williams) Mr. Williams: I talked with Rob Sherman and he has talked with the manager. They were supposed to have done some things out there. Mr. Sherman: A few months ago the owners of the property signed petitions with the Planning Commission approving the rezoning of the property in order to expand the business. The rezoning was approved subject to five conditions. Those conditions are tied to the business closing on the properties on Glass Factory. They have closed on four of those properties and there are two they are still trying to close on. Once he closes on all the properties, he is going to come into compliance with the conditions of the rezoning. He understands that he has to comply with the conditions and will do so when the final purchases are made. Mr. Williams: I don't mind giving them some more time if they are trying to work it out. Mr. Colclough: I make a motion that we accept this as information. I 2 I I I Ms. Sims: Second. Motion adopted unanimously. 1. Discussion: A request by the Richmond County Sheriff's Department for a hearing to consider the possible probation, suspension or revocation of the Alcohol license held by Brenda Johnson for Club Malibu located at 1511 North Leg Road for the following violation: excessive noise. District 3. Super District 10. (Referred from January 12 Public Services) Mr. Elim: We recommend that he be placed on probation. Mr. Chairman: This man has done a lot of work on this place and I move that we not place him on probation. Mr. Hankerson: Second. Mr. Grantham expressed his concerns about the recent citations issued to the business in light of the complaints from the neighbors that have been received. After further discussion of the matter, Ms. Sims: What is the time of probation that you're recommending? Mr. Elim: Six months. Mr. Harris: Could I make a suggestion? Whatever happens, the next time that there is a complaint, could we make a stipulation that Mr. Elim and myselfbe called and that we go out to the location, go with the deputy and Mr. Johnson to the location, see ~hat the decibel level is like, what the noise level is like, then we know all sides of it and we can come back and make a report here to this committee. Mr. Hankerson: I make that as a substitute motion. Ms. Sims: Second. (Vote on substitute motion) Motion adopted unanimously. ADJOURNMENT: There being no further business, the meeting was adjourned.
