Bob Young, Mayor; Mays, Chairman; Bridges, Co-Chairman; Kuhlke and Colclough, members; Jim Wall, Attorney; George Kolb, Administrator; Rob Sherman, License & Inspections Director; Lena Bonner, Clerk of Commission. Also Present: Stacey Eidson of the Metro Spirit, Sylvia Cooper of the Augusta Chronicle, George Eskola ofWJBF Television, other members of the news media and Hons. Williams, Commissioner and Smith, Commissioner-Elect. The Clerk: We have a request to add two items as per our addendum agenda. ADDENDUM AGENDA: 1. Motion to approve a proposed Operating Agreement with the Augusta Museum of Natural History for the Ezekiel Harris House. 2. Consider a recommendation from the Masters Alcohol Sub-Committee. Mr. Bridges: I so move that we add. Mr. Colclough: Second. I Motion adopted unanimously. 3. New Ownership: A.N.03-60: A request by Brent M. Lefevre for an on premise consumption Liquor, Beer & Wine license to be used in connection with Volume Services d/b/a Centerplate located at 601 Seventh Street and 712 Telfair Street. There will be Sunday sales. District 1. Super District 9. The Clerk: This was taken care of in the Commission. Mr. Bridges: I so move to delete Item 3. Mr. Colclough: Second. Motion adopted unanimously. 2. Discussion: A request by Stephen W. Fortunato for a Sunday Sales license to be used in connection with S. E. Wings Two, LLC, d/b/a Wingstop located at 2803 Wrightsboro Road, Suite 31. District 3. Super District 10. I Mr. Fortunato: My name is Steve Fortunato and home address is 3572 Stevens Way, Martinez, Ga. 1 Mr. Sherman: There are no objectors present. The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. Mr. Kuhlke: So move. Mr. Bridges: Second. Motion adopted unanimously. 4. New Ownership: A.N. 03-61: A request by Niranjana Patel for a retail package Beer & Wine license to be used in connection with SHREE MAA, Inc. d/b/a Discount Food & Beverage located at 1342 Gordon Hwy. District 1. Super District 9. Ms. Patel: Niranjana Patel, 1342 Gordon Highway, Augusta, Ga. Mr. Sherman: There are no objectors present. The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. Mr. Colclough: So move. Mr. Bridges: Second. Motion adopted unanimously. 5. New Application: A.N.03-62: A request by Richard H. Crawford, Jr. for a retail package Beer & Wine license to be used in connection with Eckerd Drug Corporation d/b/a Eckerd Drugs #6613 located at 3650 Wheeler Rd. District 3. Super District 10. Mr. Crawford: My name is Richard H. Crawford, Jr. and my address is 2025 Clarkston Drive, Augusta, Ga. Mr. Sherman: There are no objectors present. The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. Mr. Kuhlke: So move. Mr. Bridges: Second. Motion adopted unanimously. 6. Mr. Sherman: There are no objectors present. The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. Mr. Colclough: So move. Mr. Bridges: Second it. Motion adopted unanimously. 7. New Ownership: A.N. 03-64: A request by Michael Strauss for an on premise consumption Liquor, Beer & Wine license to be used in connection with Tony Roma's America's Rib Grill located at 203 Robert C. Daniel Parkway. There will be Sunday sales. District 3. Super District 10. Mr. Sherman: The applicant, Mr. Strauss, could not be here because he was detained in California. Mrs. Russo is here and she is the vice president of operations. Ms. Russo: My name is Dina Russo and my address is 9763 Bay Vista Estates Blvd., Orlando, Florida. I Mr. Sherman: There are no objectors present. The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. Mr. Kuhlke: So move. Mr. Bridges: Second it. Motion adopted unanimously. 8. New Ownership: A.N. 03-65: A request by Gregory L. Kent for a retail package Liquor, Beer & Wine license to be used in connection with Stevens Creek Wine & Spirits located at 1061 Stevens Creek Road. District 7. Super District 10. Mr. Kent: Gregory L. Kent, 958 Hunting Horn Way, Evans, Ga. Mr. Sherman: There are no objectors present. The Sheriff's Department and License Department have reviewed the application and recommend that it be approved. Mr. Colclough: So move. I Mr. Kuhlke: Second. 3 Motion adopted unanimously. Addendum Item 1. Motion to approve a proposed Operating Agreement with the Augusta Museum of Natural History for the Ezekiel Harris House. Mr. Kolb: The renovations of the house have been completed and they would operate the house, do interpretations of it and give tours, and be responsible for the maintenance of the building and surrounding grounds. They have requested that whatever we appropriate on an annual basis to the Ezekiel Harris House for operations be turned over to them to offset their costs of this project management and we would recommend the same. We have appropriated about $35,000 each year and there is about $20,000 presently left in that account and I would recommend to you that we turn over that amount in this year's budget and also make available to them whatever was appropriated for the house in the 2004 budget. Mr. Bridges: I'd so move. Mr. Kuhlke: Second. Mr. Colclough: How much was appropriated to them this year? Mr. Kolb: It would be somewhere in the neighborhood of $50,000 to $55,000 out of both budgets. Mr. Scott Loehr: We would keep the house clean on a daily basis and take care of the utilities and the phone. The city would take care of a major event and the cutting of the grass. Mr. Mayor: What about the revenue they generate? Mr. Kolb: That revenue would be their income and would help offset the operation of the facility. Mr. Mayor: I'd recommend that we clarify some of these issues in the agreement before our final approval on Tuesday. Mr. Kuhlke: I'd like to make a substitute motion that this be brought back to committee after review by our attorney in clearing up some of the unclear issues that might be in here. Mr. Bridges: I'll second it. Mr. Kolb: My only concern was the fiscal year ending. You can't make decisions on the budget after the fiscal year ends. 4 I I I Mr. Kuhlke: Can we incorporate that into the motion that they bring it back but we dedicate the $20,000 from this year's budget going to that appropriation? Mr. Chairman: I don't see any problem with that. (Vote on substitute motion) Motion adopted unanimously. Addendum Item 2. Consider a recommendation from the Masters Alcohol Sub- Committee. Mr. Wall: It was a recommendation of the committee that an ordinance be proposed and presented which would allow a special license for the Sunday immediately preceding the Masters Tournament as well as the Sunday of the Masters Tournament. My understanding was that the fee was to be $100 which would encompass both days and that the other rules that apply to Sunday sales would otherwise apply. Mr. Bridges: I'd just make the motion that we approve as per the recommendation of the sub-committee. Mr. Kuhlke: I'll second it. I know of one restaurant that was involved with the group that came in and made this request and out of the fear that nothing may happen, they bought a Sunday sales license for the whole year and they are only interested in those two Sundays. If that is the case and they have already paid for the license, is there a way for them to apply for a refund if they only apply for these two Sundays? Mr. Sherman: Yes, there is, since they haven't actually used the license for 2004. Mr. Kuhlke: Then I wonder if the maker of the motion might include an amendment that anybody that's in that particular situation, that a refund would be available to them. Mr. Bridges: That's fine. I don't have any trouble with that. Motion adopted unanimously. 1. Accept bid proposal from Johnson Controls, Inc. for the Terminal Security Improvement Project at Augusta Regional Airport, Bid Item #03-148. Mr. Kuhlke: I so move. Mr. Bridges: Second.
