Kuhlke, members, Commissioners B. Hankerson, T. Boyles, A. Cheek, M. Williams, T. Beck, Recreation, R. Sherman, L&I, L. Bonner, Clerk of Commission. MEDIA: H. Williams, Augusta Chronicle, S. Eidson, Metro Spirit, R. Jones, Augusta Focus. 1. Motion to enter into real estate sales contract with the Estate of Janie Johnson Hampton to acquire property located at 2138 Grand Boulevard for $44,000.00. Mr. Kuhlke: So move for approval. Mr. Colclough: Second. Motion carried unanimously. I 2. Discuss Memorandum of Understanding for the U.S. Department of Transportation Unified Certification Program. Ms. Byrd-Pelaez: The U.S. Department of Transportation has mandated that all recipients of Federal Aviation Admirristration (FAA) funds, Federal Transit Administration (FTA) funds, and Federal Highway Administration (FHW A) funds submit an annual Disadvantaged Business Enterprise (DBE) plan outlining its goals and objectives for increasing DBE participation on its projects. Since 1997, a required component of the program was to indicate an intention to participate in Unified Certification Program should a program be developed. The U.S. DOT has issued a date that this program is to begin, March 4, 2002. As a result, each recipient is required to submit a signed Memorandum of Understanding indicating his or her intent to participate in the program. If we do not participate in the program we could risk suspension or termination of funding for proj ects, grants and contracts. Mr. Kuhlke: So move for approval. Mr. Colclough: Second. Motion carried unanimously. I 3. Discussion: A request by Sandra M. Maule for a massage therapist license to be used in connection with Walton Pain Center at Walton Rehabilitation Hospital located at 1355 Independence Dr. District 1. Super District 9. I Ms. Maule: Sandra Maule, 4484 Persimmon St, Evans, GA. Mr. Sherman: This applicant meets all requirements of the L&I Dept., and the Sheriffs Office and we recommend approval. (No objectors) Mr. Colclough: So move for approval. Mr. Kuhlke: Second. Motion carried unanimously. 4. New Ownership: A.N. 02-06: A request by Gregory Tennin for a retail package Liquor, Beer & Wine license to be used in connection with Mr. K's Party Center located at 1061 Stevens Creek Rd. District 7. Super District 10. Mr. Tennin: Gregory Tennin, 1503 Wooten Road, Augusta. Mr. Sherman: This applicant meets all requirements of the L&I Dept., and the Sheriffs Office and we recommend approval. (No objectors) I Mr. Kuhlke: So move for approval. Mr. Colclough: Second. Motion carried unanimously. 5. New Ownership: A.N. 02-07: A request by James Bowdon for a consumption on premise Beer & Wine license to be used in connection with the Hide Away located at 3165 Gordon Highway. District 3. Super District 10. Mr. Bowdon: James Bowdon 2942 Shelby Dr. Augusta. Mr. Sherman: The L&I Dept. and the Sheriffs Office have reviewed this and we're recommending that this not be approved that it be denied. (No objectors) Sgt. Greg Smith, Vice Division: We're requesting that this application be denied because as part of the application process the applicant is required to list all arrest regardless of the outcome or disposition and he failed to do that. He did list two DUI's and two previous simple possessions of marijuana. He failed to list I a felony drug arrest .from last year as well as a previous DUI arrest and a I misdeamnor family violence simple battery. To be fair to him the drug arrest charge was dropped due to a technicality with the search warrant. There was never any dispute about the fact that the drugs were found in his residence. For those reasons we're requesting that this application be denied. Mr. Bowdon: The drugs belonged to my teenage son and the simple battery that occurred was between him and I. He is a child out of control. He was on probation for these charges. For the charges in the past, I was a young man and I am guilty of that. Other than the two charges that he mentioned it's probably been fifteen to twenty years since I've had anything on my record. I wish you'd at least give me a chance. Mr. Wall: Because of failure to report all arrest regardless of the outcome as required by the applicant I recommend this be denied. Mr. Kuhlke: On the recommendation of the Sheriff's Office and the County Attorney I m.ove we deny. Mr. Colclough: Second. Motion carried unanimously I 6. New Ownership: A.N. 02-08: A request by Cindy Kim for a retail package Beer & Wine license to be used in connection with Short Stop #5 located at 902 Walton Way. District 1. Super District 9. Ms. Kim: Cindy Kim 3701 EI Cordero Ranch Spring Rd, Martinez Mr. Sherman: This applicant meets all requirements of the L&I Dept., and the Sheriffs Office and we recommend approval. (No objectors) Mr. Kuhlke: So move for approval. Mr. Colclough: Second. Motion carried unanimously. 7. (No objectors) Mr. Kublke: So move for approval. Mr. Colclough: Second. Motion carried unanimously. 9. Discussion of the purchase of property relative to the Greenspace Program. (Requested by Commissioner Boyles) Mr. Boyles: I requested this be placed on the agenda because Mr. Davidson would like this to be settled. I Mr. Jack Long; Attomey: Mr. Davidson is trying to sell this property for a substantial amount more than the appraised value of $120,000. We believe this is coming up now because this property has been identified as property to be acquired by Greenspace. We would ask that the Commission purchase the property at the appraised value of $120,000. I would like to point out that for a number of years the county got the use of the property while working on Raes Creek it basically became a parking lot for county vehicles or contract vehicles. In essence it was used for a number of years any way. We're now at the stage that if the county is going to buy the property we would ask the county to buy it now. Mr. Wall: The Committee has already looked at this property and Rocky Creek is now priority for spending Greenspace monies. This property met four out of the nine criteria. . Mr. Kuhlke: I move we forward this on to the full Commission with no recommendation. Mr. Colclough: Second. I I Motion carried unanimously.
