Mays, members; Commissioner A. Cheek, G. Kolb, Administrator; J. Wall, Attorney; R. Sherman, S. Walker, L&I; L. Bonner, Clerk of Commission. ABSENT: W. Mays, member. MEDIA: G. Eskola, Channel 6; R. Jones, Augusta Focus; H. Williams, Augusta Chronicle. Clerk: Mr. Chairman we have a request for one addendum item: A request by Subhash C. Sethi for an on premise consumption Liquor, Beer & Wine License to be used in connection with Bhoomer's Restaurant & Lounge located at 3023 Washington Road. There will be Sunday Sales and a Dance Hall. Mr. Sethi: Subhash Sethi, 3590 Evans-to-Locke Road. I Mr. Sherman: The L&I Dept has reviewed this and the Sheriff's Office and we recommend approval. (No objectors) Mr. Kuhlke: So move for approval. Mr. Brigham: Second. Motion carried unanimously. Presentation from Manuel Padron and Associates on Completed Transit System Analysis. Mr. Boyd makes a presentation to the Committee on the Completed Transit System Analysis. Mr. Brigham: I move we receive this report as information. Mr. Kuhlke: Second. Motion carried unanimously. I Motion to amend Augusta Richmond County Code Section 6-7-26 so as to delete the requirement for taxicab companies to maintain a central place of business open twenty-four hours a day for the purpose of receiving calls and dispatching cabs. Mr. Sherman: The only part that we are deleting is the portion that they are required to have a central place of business but they will be required to have a dispatcher and be on call 24-hours a day for the purpose of receiving and dispatching cabs. We have fourteen one car taxi cab companies. We've been working with them to get them in compliance with the taxi cab ordinance. We told them that if they would get a listing in the phone book so that when the public called that number the call would be forwarded to their cell phone, they being the driver, they would be their own dispatcher as well. We would allow the section that says a place of business and a 24-hour dispatch to be in compliance if they had that listing in the phone book. The Commission asked us to review the entire ordinance and come back with recommendations. We reviewed the entire ordinance, compared it to other cities as well as GMAs model ordinance there were only two sections that other cities and us differ on and that was on the 24-hour dispatch. None of the ordinances require a place of business, only 24-hour dispatch. I Mr. Kuhlke: What are we going to do when Mr. Fields ask about this. Mr. Brigham: On business licenses, don't we require them to have a place of business? Mr. Sherman: For mobile licenses, say a contractor as well, we do not. Nothing occurs at their home. Mr. Brigham: How do we get in touch with these people with mobile licenses? I Mr. Sherman: That's why we want them to be in compliance with the phone listing. As far as the License Dept. we have a phone number and mailing address on the business license application. Mr. Brigham: I thought everybody that had a business license had to have an office somewhcre. Mr. Sherman: They receive mail at either their home or post office box. Ifwe're saying that their home is their office, they can not have any business activity at their home. It's listed on the license as a mobile license. Mr. Walker: For anyone new coming in now, we've had one this year that I have required that if is going to operate he needs to get a permission from Planning and Zoning first for in home occupancy before I approved it. The majority of these that we're talking have had licenses for years. Mr. Colclough: So these people are grandfathered in. Mr. Walker: Basically, yes. Mr. Wall: I know we have mobile licenses. I I Mr. Brigham: That's what I'm trying to establish is we're going to do mobile licenses for cabs or not? And if we're not, if we require them to have an office, they need to go through Planning & Zoning to receive a Home Occupation License. Mr. Colclough: Will this change of code eleviate or give us permission to be doing mobile licenses or is it just deleting that section that you don't have to have a residence or an office Mr. Wall: The Business License is in a different section and this does not address the business license requirement. They would still be required to have a business license. Mr. Young: Is it possible to create a business category somewhere between a limousine company and a taxi cab company and clearly define the perimeters ofthe business that you could conduct and make that available? I Mr. Wall: The business tax ordinance provides that any company or person engaged in a business that has a location in the county has to display the certificate. You can get a business tax certificate if you have another location but it does appear that this requires the location of an office as a part of the business tax. We have issued licenses in the past for mobile businesses so long as they showed an address that you could get in touch with them. If they are in fact operating a business out of their home then they are supposed to have a special use permit in order to operate that business out of the home. With regard to these cab companies, as I understand how the single operators work. They would have a telephone that would track them down wherever they are. Whether it be in the car or wherever and they are required to be available 24-hours a day under the amendment. But, they would not be required to have a storefront. And that is consistent with what we do with other businesses. Mr. Brigham: I would like to make a motion that we postpone this until the next Committee meeting on November 13. Mr. Kuhlke: Second. Motion carried unanimously. Discussion: A request by Nancy Leishman for a Massage Therapist License to be used in connection with Rainforest Retreat located at 1867 Central Avenue. District 3. Super District 10. Ms. Leishman: Nancy Leishman, 1867 Central Avenue, Augusta. Mr. Sherman: This application has been reviewed by the L&I Dept. and the Sheriff's Office and we recommend approval. I Mr. Kuhlke: So move for approval. Mr. Brigham: Second. Motion carried unanimously. I Discussion: A request by Sharon Fairbrother for a Massage Therapist License to be used in connection with Shaper's located at 1064 Alexander Drive. District 7. Super District 10. Ms. Fairbrother: Sharon Fairbrother 788 Riggs Road, No. Augusta, SC. Mr. Sherman: The L&I Dept and the Sheriffs Office have reviewed the application and we recommend approval. Mr. Brigham: So move for approval. Mr. Kuhlke: Second. Motion carried unanimously. Transfer Application: A.T. 01-107: A request by Dan Troutman to transfer the on premise consumption Liquor, Beer & Wine license to be used in connection with Treybon Restaurant located at 520 Reynolds Street to 1285 Broad Street. There will be a Dance Hall. District 1. Super District 9. Mr. Troutman: Dan Troutman 381 Crown Mill, Augusta. I Mr. Sherman: The L&I Dept and the Sheriffs Office have reviewed the application and recommend approval. Mr. Brigham: So move for approval. Mr. Kuhlke: Second. Motion carried unanimously.
