Clerk: We have a request for one addendum item:
Motion to approve tender agreement and replacement contract naming Team Four
Contracting, Inc. as replacement contractor.
Mr. Brigham: So move.
Mr. Kuhlke: Second.
Motion carried unanimously.
New Application: A.N. 00-01: A request by Jay Jahn for an on premise consumption beer
license to be used in connection with Pizza Central located at 1858 Central Ave. District 3.
Super District 10.

Mr. Jahn: Jay Jahn, 284 Highland Lane, Augusta.
Clerk: We have petitions that have been submitted to the Clerk's Office against this
particular establishment.
Mr. Walker: This applicant meets all requirements of the License and Inspection
Department and the Sheriff s Department and meets the distance requirements from the church.
This was turned down before because of parking and not enough seating. (3 objectors present)
Mr. Payne: Trav Payne, I represent the neighbors and we oppose this license. We have
petitions signed by many homeowners in the area that are opposed to this bar license. We have
petitions from the Bethlehem Advent Christian church, Macedonia Baptist church and a letter
from the director of Friendship Community Center. We question the 300-foot distance from the
church. The residents have long time homeownership in this neighborhood and we feel that on
site beer consumption would be a real disappointment at a place like this.
Mr. Kuhlke: Why do you say the Red Lion crowd will come from Walton Way?
Mr. Payne: We feel that this will attract the eighteen to twenty-five year old crowd that
likes to drink beer and frequent a place like this late at night.

Mr. Jahn: There are other businesses on Central Avenue that sell beer. In two and a half
years, per Mr. Harris, we have never had a complaint. The people in the neighborhood have
never come into the store. We close at IOp.m.
Mr. Kuhlke: Move approval.
Motion carries 3-1 with Mr. Mays voting present.

& wine license to be used in connection with M&C Spirits located at 3334 Washington
Road. District 7. Super District 10.
Mr. Dudley: Tommy Dudley, 1025 Dudley Dr, Augusta.
Mr. Walker: This application meets all requirements of the License & Inspection
Department and the Sheriffs Department and we recommend approval. (No objectors)
Mr. Brigham: So move.
Mr. Kuhlke: Second.
Motion carried unanimously.
New Applicant: A..i"l. 00-03: A request by Johnny Glasker for an on premise consumption liquor
& beer license to be used in connection with Johnny's Supper Club located at 1669 Olive Road.
There will be Sunday sales. District 5. Super District 9.

Mr. Walker: This application has been approved by the License and Inspection and the
Sheriff 5 Department and we recommend approval of the consumption on premise beer license
we recommend disapproval of Sunday sales at this time because he has no records of food sales.
Both departments recommend not to issue the Sunday sales license. (No objectors)
Mr. Glasker: I have been in this location for over ten years and I have had a Sunday sales
license and sold food.
Mr. Mays: Just for the record because the Committee has changed somewhat since Mr.
Glasker was here last. I think that he is correct from the standpoint of the license. I think we
need to look at what was said in the Committee meeting, whatever the wording was in the
original agreement and it might be that we will have to look at was said in the original meeting.
It was mentioned that you did not have legal counsel when you came here, I'm don't know on
which occasion that might have been. I do know that on one occasion Mr. Findley represented
. you. At that point, because of the questioning that was tnere in reference to the amount of food
sales on Sunday, there was somewhat of a compromise. Because you had been through the
different hardships, the Commission did not want to place you totally out of business in granting
the alcohol license. But the agreement was to go ahead and give you the regular license in opt of
not dealing with the Sunday sales. That vote had you probably pressed on the Sunday sales and if
we had done a strict enforcement of it both licenses because you had been out and at that time the
establishment of the church and where it was you may not have gotten either. I think that helped
to lead to the fact that you got one and didn't get to the other one. That was also in agreement
with you and your lawyer at that time.

Mr. Kuhlke: So move with the recommendation of the License Department with no
Sunday sales and a review in six months.

liquor, beer & wine license to be used in connection with The Modjeska Theatre located
at813-817 Broad Street. District 1. Super District 9.
Mr. Schepis: Michael Schepis, 307 10'" Street.
Mr. Walker: This application meets all requirements of the License Department and the
Sheriffs Deparnnent and we recommend approval. (No objectors)
Mr. Kuhlke: So move.
Mr. Mays: Second.
Motion carried unanimously.

Mr. Walker: This application meets all requirements of the License Department and the
Sheriff's Department, has been advertised and we recommend approval. (No objectors)

Discussion: Consider a request by Scott Levine for a gameroom license to be used in
connection with The Playground Lounge located at 873 Broad Street. District 1. Super
District 9.

Mr. Walker: This application meets all requirements of the License Department and the
Sheriffs Deparnnent, has been advertised and we recommend approval. He also has an alcohol
license in the same location and has been approved. (No objectors)

Motion to issue a hold harmless waiver for gymnasium at schools and cburches used for
youth and adult basketball leagues.
Mr. Brigham: So move.
