ALSO PRESENT: S. Cooper, Augusta Chronicle, S. Eidson, Metro Spirit. Clerk: We have a request to add one item to our agenda: 1. Discussion: Consider a request by the Richmond County Sherifrs Department to consider the possible probation, suspension or revocation of the gameroom license held by Larry K. Young for Lotto Cafe located at located at 2658 Barton Chapel Road. District 5. Super District 9. Mr. Brigham: So move to add. Mr. Colclough: Second. Motion carried unanimously. A request to approve LPA Work Authorization #8 for Pavement Mainteuance Study- Augusta Regional Airport in the amount of $99,984. Mr. Brigham: So move. Mr. Colclough: Second. Motion carried unanimously. Delete local amendment to National Electric Code, Augusta-Richmond County Code: Subsection 7-1-18 rigid or thin wall conduit required in certain situations. Mr. Brigham: So move. Mr. Colclough: Second. Motion carried unanimously. A request to approve Amendment to Pendleton King Park Lease substituting Sun Trust Bank, Augusta, NA for all references to NatiousBank of Georgia in the Lease Agreement. Mr. Brigham: So move. I Mr. Colclough: Second. Motion carried unanimously. A request to approve moratorium ou the enforcement of the Historic Preservation Ordinance within the Summervill Historic District for a period of three months, with the exceptiou of enforcement of the Historic Preservatiou Ordinance as it relates to the demolitiou of main structures, auy new coustruction, aud exterior renovation. Mr. Brigham: So move. Mr. Colclough: Second. Motion carried unanimously: Discussion: A request by Augusta-Richmond County's License & Inspections Department (Alcohol Division) to consider the possible probation, suspension or revocation of the Sunday I sales license of Shan nons Food & Spirits located at 300 Shartom Dr. District 7. Super District 10. Ms. Uhl: Linda Uhl 3003 Prickley Court. Mr. Harris: On April 27, Mr. Armando Totka, the internal auditor for the License and Inspection Department did an audit report of Shannon's Food & Spirits for the period of January 97 through February 99. During this period food sales were twenty-one percent, which is below the requirement of the fifty percent food sales required. This is in violation of Section 6-215 of the ARC Alcohol Ordinance. It is the recommendation of the License Department based on these findings that we either suspend or revoke this license. Mr. Berry: The Sheriffs Department recommends that this establishment be put on probation. Mr. Brigham: I would like to make a motion that we put this establishment on a ninety day probation and if you're not up to fifty percent in ninety days, my next motion will be to suspend your license. Mr. Mays: Motion dies for lack of a second. I I I I Mr. Brigham: I'll make a substitute motion to place on probation for Sunday sales license until December 31, 1999 with audit to be performed in early December and license not be renewed until audit is completed for Shannon's Food & Spirits. .Mr. Colclough: Second. Motion carried uminimously. New Application: Consider a request by Michael W. Yonesaki for a consumption on premise liquor, beer & wine license to be used in connection with the Metro Coffeehouse located at 1054 Broad Street. District 1. Super District 9. Mr. Yonesaki: Michael W. Yonesaki 2662 Coventry Road. Mr. Harris: This applicant has met all the requirements of the ARC Alcohol Ordinance except for the Sunday sales and we are recommending that they be approved for everything except Sunday sales. Mr. Brigham: So move with the recommendation. Mr. Colclough: Second. Motion carried unanimously. New Application: Consider a request by Charlie Sturgis for a consumption on premise liquor, beer & wine license to be used in connection with Top of the Hill Lounge located at 2306 Gordon Highway. There will be a dance hall. District 4. Super District 9. Mr. Sturgis: Charlie Sturgis 1512C Wylds Road. Mr. Harris: This applicant has met all the qualifications of the ARC Alcohol Ordinance and we recommend approval. Mr. Brigham: So move. Mr. Colclough: Second. Motion carried unanimously. New Application: Consider a request by Gary Richardson for a retail package beer & wine license to be used in connection with Lee & Sons Convenience Store located at 3995 Old Waynesboro Road. District 8. Super District 10. Mr. Richardson: Gary Richardson, 995 Windmill Lane, Evans, GA. I Mr. Harris: The applicant has met all requirements of the ARC Alcohol Ordinance, has all the necessary signatures and we recommend approval. Clerk: For the record Mr. Chairman, the residents have submitted a petition against this request. There are twenty objectors present today. '. Ms. Carol Miller, Spokesperson, 4001 Goshen Lake Dr. N.: As you can tell by the petitions we have over four hundred and seventy-five names that have been gathered in opposition to the issuing of an alcohol license at the proposed store. There are nine establishments in the area that presently sell alcohol. Besides this being a residential area, you have the Goshen Elementary School and the new Cross Creek High School. I will not mention the problems with traffic, but the fact that both schools are right there is something that we are concerned about. Mr. Badke: According to your zoning department no plans have been submitted for that property yet and why he's applying for a liquor license now is not understandable. The size of the property is probably three or four acres and over three of those acres are in the flood plane. Mr. Brigham: I move we send this to the full Commission with no recommendation to be heard on July 20. The reason for that is that we have a zoning issue wrapped in with a liquor license and I want the full Commission to make a decision on this. Mr. Mays: Second. I Mr. Richardson: There are four acres of property there and I own 1.2 acres of it. [ have already checked with Engineering and of the 1.2 acres one-eighth is not usable land because it is in the flood zone. The reason 1 have not submitted a plan is because I went before the Goshen Homeowners Association and [ requested a car war on the same piece of property. I didn't want an alcohol license myself. When I was denied the license for a self car wash I had no choice. Motion carried unanimously. Motion to approve correcting the job title for the Maintenance Superintendent at Diamond Lakes (South Augusta) Regional Park from Maintenance Worker 1 (grade 38) to Property and Maintenance Supervisor I (grade 43). Mr. Beck: When we prepared our budget for the South Augusta Regional Park this was an incorrect job title that we placed in the budget. The funding was put in the budget for the grade 43. This is a $7.5 million dollar investment, maintaining ten athletic fields as well as many other facilities, so it will take this job title and description to get someone qualified for this position. Mr. Colclough: So move. Mr. Brigham: Second. I I I I Motion carried unanimously. A request to discuss a change order to Blair Construction, Inc. for the installation of irrigation weUs at Diamond Lakes (South Augusta) Regional Park. Mr. Colclough: So move. Mr. Brigham: Second. Motion carried unanimously. Ratify acceptance of $8,000 in grant funds from the Georgia Board of Natural Resources for paving the Blythe Community Center parking area. Mr. Brigham: So move. Mr. Colclough: Second. Motion carried unanimously. Discussion: Consider a request by the Richmond County SherifPs Department to consider the possible probation, suspension or revocation of the gameroom license held by Larry K. Young for Lotto Cafe located at 2658 Barton Chapel Road. District 5. Super District 9. Mr. Harris: Doing some research we found out that this license has never actually been changed into his name, but he does have a bill of sale and when he was charged he had the lottery license in his name. Once he was charged he in turn sold the business to another person. According to the Attorney it looks more like a lease than a sale, therefore he stil! owns it. What we would like to know is if we can revoke the license? Mr. Wall: In the past where there has been a bona fide transfer and the new applicant after it came in we have allowed that new purchaser to come in and have a license and not be tagged with the prior violations. Mr. Brigham: I would like to make a motion that we revoke the license. Mr. Colclough: Second. Motion carried unanimously. With no further business to discuss, the meeting was adjourned. Lena J.
