Johnson, Transit Director; 1. Beard, Mayor Pro Tem; F. Handy, Commissioner. ALSO PRESENT: S. Cooper, Augusta Chronicle; S, Eidson, Metro Spirit; G. Eskola, Channel 6; 1. Bonner, Clerk of Commission; B. Brown of the Clerks Office. Clerk: We have some corrections and addition to the agenda: 1. Items 8 and 9 should read Transfer Application and not New Application. 2. Postpone approval to post Marketing Director position at Bush Field and hire up to midpoint of salary range. Mr. Kuhlke: I move that we add items 8 and 9 and postpone the Marketing Director position. Mr. Brigham: Second. I Motion carried unanimously. Transfer Application: Consider a request by Myong Tul Chu for a retail package beer & wine license to be used in connection with Pine Hill Food Store located at 1680 Brown Road. District 8. Super District 10. Ms. Chu: Myong Tul Chu 1811 Harcourt Drive, Hephzibah, Georgia. Mr. Walker: This application for transfer has been approved by the License Department and the Sheriffs Department and we recommend approval (17 objectors). Mr. Brigham: I would like to make a motion that we send this to the full Commission without a recommendation. Mr. Kuhlke: Second. Mr. Colclough: I would like to make a substitute motion that we deny this. I Mr. Kuhlke: Mr. Walker, is not this the same one that came up about a year ago and it was denied by the Commission, subsequently went to court. The courts upheld our decision and they are now coming back and they have waited the required year to come back. Mr. Walker: It is my understanding that they have a contract on the property where the old store is located and they are going to close that out on November 15. So they'll own both properties. I Mr. Brigham: From what I understand this is a transfer of an existing license, this is not a new license. Mr. Jimmy Smith: Let me say that we have nothing against these people, we have no problems with them personally. But our agenda is different from theirs. Our agenda is community, family children, grandchildren and recreation. And they have one agenda, dollars. The community is ours and we want to keep it the way we feel it should be. There is plenty of alcohol and beer on Hwy 25 and Hwy 56 and it is real accessible. We are here today to ask that you deny this petition again. Mr. Daniel Chun: I would like to thank you for giving us the opportunity to achieve the American dream. Weare hard working citizens of this community and all we want is the same opportunity as anyone else. We would appreciate your reconsideration on this matter. Mr. Mays: I think that there needs to be some type not necessarily legal, but a realistic compromise. If they owned both locations couldn't they, Jim legitimately, put somebody across the street and sell from that location where they do have a license and operate on both sides of the street and keep both locations open? I think that there needs I to be some discussion between the property owners and the neighborhood about what could be done with the other property that's there, so that they would not be at a total loss and you would wipe it out totally, in terms of that being that type of commercial establishment. It may not go anywhere, but if they decide that they are going to hold on to where they are in the old location, and we deny in the new location. While I think Jim, the court prevail and what we do with the new location I think we will be hard pressed, in a non-nuisance situation, with no complaints, to walk in and take a license. After further discussion; Motion carries 3-1 with Mr. Colclough voting no. Discussion: A request by Kum Yon Parker to add Sunday sales to her current liquor, beer & wine license used in connection with Golden Gate Lounge located at 1924 Barton Chapel Rd. District 3. Super District 10. Mr. Kuhlke: I move to deny. wlr. Brigham: Second. Motion carried unanimously. I - I Transfer Application: Consider a request by Rebecca L. King for a consnmption on premise Uqnor, beer & wine license to be used in connection with The Comedy House Theatre located at 2701 Washington Road. District 7. Super District 9. Ms. King: Rebecca King 5407 Ridgedale Court, Hephzibah, Georgia. Mr. Walker: This application meets all requirements and has been approved by the License Department and the Sheriffs Department and we recommend approval (no objectors). Mr. Brigham: So move. Mr. Kuhlke: Second. Motion carried unanimonsly. A request from the Transit Director to acquire property known as 620 and 624 Chafee Avenue from Nora Pascarella for the sum of 549,200.00. I Mr. Johnson: This is to revisit the issue of purchasing the land on Chafee Ave. We followed the federal guidelines and we have a legal opinion from Mr. Revell. The federal guidelines stated that if it was over $10,000.00 the variance between the appraised value and the actual settlement price was that we had to have an opinion. Mr. Revell's opinion is that we would be hard pressed to try to not purchase it at the settlement price when we are actually charging them on the records for the property taxes at the higher rate. Mr. Wall: I agree with that. We tax them on a value ofa higher rate. Mr. Brigham: We're not trying to condemo these properties, we're trying to negotiate a purchase. Mr. Wall: I understand that. The practice has been whether it's on condemnation or on acquiring, that at a minimum that we offer the tax value. We have offered the appraised value, but the appraised value in most instances is greater than the tax value. And we have offered the tax value. Savannah Place is an example. It's a policy decision as far as what you offer. But can we justify purchasing it at the tax value and the answer to that question is yes. Mr. Kuhlke: If it appraised at that amount and you went back and identified how long he had been paying taxes higher than the appraised amount and paid additional funds over and above the appraised amount based on the amount of additional taxes he's paid for that number of years. I =t- Mr. Mays: The only difference is regardless of what they are appraised at you don't pay at that. But if they are on the tax books for that, then you pay according to what's there. I Mr. Kuhlke: I move for approval. Mr. Colclough: Second. Motion carried unanimously. A request from the Director of Daniel Field to accept the bid of Wall Asphalt Services in the amount of $32,930.00 to seal cracks in the runways. Mr. Boshears: This is accepting a bid to do a crack seal project on the runways. It's a State Department of Transportation Grant of seventy-five twenty-five split. Mr. Kuhlke: So move. Mr. Brigham: Second. Motion carried unanimously. A request from the Director of Bush Field for approval of Work Authorization for Tasks IV and VI with Newton & Associates, Ioc. (NAI) at a cost not to exceed $25,000 for services related to the financial feasibility of terminal area improvements at Bush Field Airport. I Mr. McDill: This has to do with the continuation of the financial feasibility study that we are doing with the guard and terminal area improvements at Bush Field. We entered into an agreement in June 1998 with Newton and Associates to do the financial feasibility and we have already approved three task, Task IV and Task VI. Task IV has to do with evaluating the adequacy of the concession for the new terminal facility and the sizing of those facilities. Task VI has to do with the preparation of various agreements, airline use agreements, concession contracts and request for proposals for these types of contracts. The work will be coordinated with the city attorney. An upset fee of$25,000 is involved. Mr. Kuhlke: So move. Mr. Brigham: Second. Motion carried unanimously. I 1i. I New Ownership: Consider a request by Hwa Yeong Lee for a retail package liquor, beer & wine license to be used in connection with Kissingbower Package Shop located at 1773 Kissingbower Rd. District 2. Super District 9. Ms. Lee: Hwa Yeong Lee 2985 Abbotts Pointe Drive, Duluth, Georgia 30097. Mr. Walker: This applicant has met all the requirements and has been approved by the License Department and the Sheriffs Department and we recommend approval. (No objectors) Mr. Knhlke: So move. Mr. Brigham: Second. Motion carried unanimously. New Ownership: Consider a request by William L. Mantlow for consumption on premise beer license to be used in connection with Rack Boys Bar located at 2900 Deans Bridge Rd. District 2. Super District 9. Mr. Mantlow: William 1. Mantlow 2130 Sibley Road, August, Georgia. I Mr. Walker: This applicant meets all requirements of the License Department and has been approved by the Sheriffs Department and we recommend approval. (No objectors) New Application: Consider a request by Loyce S. Manuel for a consumption on premise liquor, beer & wine license to be used in connection with Ron's Tavern located at 548 Broad Street. District 1. Super District 9. Mr. Manuel: Loyce S. Manuel 3702 Creek Court, Hephzibah, Georgia, 30815. Mr. Walker: This applicant has met all requirements of the License Department and the Sheriffs Department and we recommend approval. (No objectors) New Ownership: Consider a request by Kyong Ok Seo for a package beer & wine license to be used in connection with A K Convenience Store located at 2301 Lumpkin Road. District 2. Super District 9. Ms. Seo: Kyong Ok Seo 283 Myrtle Road, Augusta, Georgia. I Mr. Walker: This application has met all requirements of the License Department and has been approved by the Sheriff s Department and we recommend approval.
