Bonner, Clerk ofCornmission. Motion to approve Agreement with CSX and Norfolk Southern for installation of four (4) Hydra Switches in an amount not to exceed $103,931. Mr. Cheek: So move for approval. Mr. Colclough: Second~ Motion carried unanimously. Consider paving agreement for Scott Street from Orange Avenue to northern boundary of the property. I Mr. Shepard: This is a road in the Belair Hills Estates subdivision. Mr. Hayes has been contacting me for quite a while now to have this road paved. A developer recently developed his property in complete disregard for the city rules and regulations for property development. His lawyer has communicated an offer to settle some of his problems in connection with that development by paying us half the cost of paving Scott Street down to Mr. Hayes property. So this is an opportunity to leverage our dollars by a factor of 50 percent. Mr. Oliver: This would pave to the far property corner of Mr. Hayes property. At that point, this person would be responsible for installing pressure line and creating a cul- de-sac at the end which he has indicated would only serve two parcels. He has represented to us that he does not intend to further subdivide that property. And this is based upon that intention. iYIr. Shepard: So it's an opportunity to leverage our money which we ordinarily don't have and it's a way of accepting this particular road in question from the priority list. Mr. Bridges: We do have a policy that we have established that the city pays one- third and we don't care for the other two-thirds and we will move somebody's road up and pave it. I don't have a problem with this issue but the only thing is we'll have to change our policy to do. I Mr. Cheek: Will this create any drainage problems or problems with storm water runo ff? iVlr. Oliver: This will be constructed with county forces and done according to our standards. Drainage is not a problem in this area Mr. Colclough: This gentleman has been coming in here for quite a while. How difficult would it be to change the policy? I Mr. Bridges: I don't have any trouble with changing the policy too fifty-fifty. I think it ought to be a policy as opposed to picking a road out and doing it outside the policy. This way any other road that came up if they paid 50 percent of the cost then we pay 50 percent it would work the same for everybody. !vIr. Shepard: I think this is a way that we can go ahead and serve this citizens need and have the olIending party pay some regress to this county for not appropriately . developing his property. Mr. Williams: I think if we change the policy to accommodate the people that have the money the people without the money will be left out. There are too many streets that need to be paved and the people don't have the money to pay half of the cost to have the work done. Those people will still be paying taxes. After further discussion, Mr. Shepard: I saw this as opportunity, in this case, to not change the existing policy but to serve this need because of the accommodation factor that presents itself in this case. So we're looking to get $4,200 or $5,000 from a third party source to help us get an unpaved road paved. I don't think it would really destroy the present policy 1 think it's presented as an exception, a justified exception policy because we can leverage our funds. The roads will be paved with SPLOST funds so this will make the SPLOST go a little further by paving this road partly with private funds. The funds will become public funds when they're transferred to us. I Mr, Beard: Why can't we just waive this for this particular aspect of what we're doing so that it will not affect the policy or make an exception. Because I think from what I've in the past there have been health problems in Mr. Hayes family because of this road not being paved. You could look at it as some possible litigation coming from this. I think this is a different situation to me just waiving or making an exception for this particular road. Mr. Bridges: The one-third, one-third policy came as a result of Scott Street. It was to provide an avenue so the citizens would liave a way that were down at the bottom of the list that the money had not reached yet if they could provide a portion of the funds for their road to be paved. Mr. Mays: I was hoping by this time that we would have looked back at the unpaved road list again. Because there were some gross inequities in terms of how parts of that list or maybe all of that list was even put together in the very beginning in terms of I I a ranking system particularly if we're talking about years and whose been without for a long period of time, what areas were neglected, who has been promised in sales tax, who had done development a lot of that could occur. Mr. Oliver: I would note that if the sales ta.'{ and the GO Bonds pass the drainage and roads in Belair Hills would be addressed. Mr. Cheek: So move to send it on to the full Commission with no recommendation. Mr. Colclough: Second. Motion carried unanimously. With no further business to discuss. the meeting was adjourned.
