HomeMy WebLinkAboutCalled Commission Meeting November 29, 2010 CALLED MEETING COMMISSION CHAMBER November 29, 2010 Augusta Richmond County Commission convened at 12:00 Noon, Monday, November 29, 2010, the Honorable Deke Copenhaver, Mayor, presiding. PRESENT: Hons. Lockett, Smith, Mason, Grantham, Aitken, Johnson, Jackson, Bowles and Brigham, members of Augusta Richmond County Commission. ABSENT: Hon. Hatney, member of Augusta Richmond County Commission. The Mayor called the meeting to order. LEGAL MEETING A.Pending and potential litigation B.Real estate C.Personnel Mr. MacKenzie: I would entertain a motion to go into a legal meeting for the purpose of discussing pending and potential litigation. Mr. Brigham: I’d like to discuss a personnel item. Mr. Lockett: I so move. Mr. Johnson: Second. Motion carries 9-0. [LEGAL MEETING] The Mayor called the meeting back to order. Mr. MacKenzie: I would entertain a motion to authorize and approve the Tenders, Substitution and Settlement Agreement and the Completion Agreement to complete the contracted work on the D’Antignac Street Drainage Project which is covered under the Principal Contractor’s Performance Bond and to authorize the Mayor to execute both agreements. Mr. Lockett: So move. Mr. Grantham: Second. Motion carries 9-0. Mr. MacKenzie: I’ll entertain a motion to add and approve a Resolution authorizing the settlement of all claims by Fred and Sallie Rueggeberg in the aggregate 1 amount of $7,500, authorizing the County Administrator to disburse funds in the amount of $7,500 and to execute any necessary settlement documents waiving Augusta, Georgia Code of Ordinances Sections in conflict for this instance only. Mr. Mayor: Can I get a motion to that effect? Mr. Grantham: So move. Mr. Jackson: Second. Mr. Mayor: We have a motion and a second. If there’s no further discussion, Commissioners will now vote by the usual sign. Motion carries 9-0. Mr. MacKenzie: We also have one other motion that another attorney will provide us, Dan Hamilton, relating to a condemnation matter. Mr. Mayor: Madam Clerk, you want to call that one unanimous. The Clerk: Magnanimous. Mr. Mayor: Mr. Hamilton. Can you move the mike down, please? Mr. Hamilton: Yes. Through General Counsel I’m here to submit a proposed motion concerning litigation in Richmond County Superior Court, Civil Action Number 2010-RCCV-803 involving Augusta, Georgia, Keisha Martin and other parties in the total sum of $42,500 less any due and unpaid property taxes. Mr. Mayor: Can I get a motion to that effect? Mr. Grantham: Motion to deny. Mr. Jackson: Second. Mr. Mayor: Mr. MacKenzie. Mr. MacKenzie: First, we need to do a motion just to add it to the agenda and then we’ll do a separate motion on the approval. Mr. Mayor: Okay. Do we have a motion to add it to the agenda? Mr. Lockett: So move. Mr. Johnson: Second. 2 Mr. Mayor: We have a motion and a second. Commissioners will now vote by the usual sign of voting. Just adding it to the agenda. Mr. Jackson votes No. Motion carries 8-1. Mr. Mayor: Okay. Now, Commissioner Grantham. Mr. Grantham: I’ll put my motion to deny that we make a settlement of $42,500. Mr. Mayor: Is there a second? Mr. Smith: Second. Mr. Mayor: We have a motion and second. Commissioner Johnson. Mr. Johnson: I’d like to make a substitute motion that we move forward on it due to the timeliness in this project. The Clerk: To approve the settlement, is that what you’re saying? Mr. Johnson: Yes. The Clerk: Okay, and that’s Mr. Johnson and Mr. Lockett. Mr. Mayor: We have a substitute motion and a second. Mr. Mason: What’s the . . . The Clerk: The substitute motion was to approve the settlement amount of $42,500 for Keisha Martin with subtraction of property taxes due. Mr. Mayor: Okay. If there’s no further discussion, Commissioners will now vote on the substitute motion by the substitute sign of voting. Mr. Mason, Mr. Jackson, Mr. Smith and Mr. Grantham vote No. Motion fails 5-4. Mr. Mayor: Okay. Commissioners will now vote on the primary motion by Mr. Grantham to deny. Mr. Lockett, Mr. Aitken and Mr. Johnson vote No. Motion carries 6-3. Mr. Mayor: Okay, thank you, sir. Mr. MacKenzie. 3 Mr. MacKenzie: I’d entertain a motion to approve the Closed Meeting Affidavit. Mr. Mayor: Can I get a motion to that effect? Mr. Mason: So move. Mr. Mayor: Do we have a second? Mr. Lockett: Second. Mr. Mayor: If there’s no further discussion, Commissioners will now vote by the usual sign of voting. The Clerk: The affidavit. Motion carries 9-0.
