REGULAR MEETING COMMITTEE ROOM – February 13, 2006
(Reconvened from February 8, 2006) 11:30 A. M.
PRESENT: Hons. Deke Copenhaver, Mayor; Williams, Holland, Smith, Colclough,
Grantham, Hatney, Beard, Bowles and Brigham, members of Augusta Richmond County
Commission.
ABSENT: Hon. Cheek, member of Augusta Richmond County Commission.
Also Present: Steve Shepard, Attorney; Fred Russell, Administrator; Lena Bonner, Clerk
of Commission and Nancy Morawski, Deputy Clerk of Commission.
The meeting was called to order by Mayor Pro Tem Williams.

Mr. Shepard: I would ask that we close the session at this point to complete the legal
session that will be pending and potential litigation, real estate and personnel.
Mr. Colclough: I so move.
Mr. Hatney: Second.
Motion carries 9-0.
Mr. Shepard: Can we note for the record that the media was here?

At the close of the legal meeting, the meeting was reopened to the public.
Mr. Mayor: I would declare that we are back in the regular session.
Motion to authorize the Mayor and the Mayor Pro Tem to execute the affidavit of
compliance with Georgia’s Open Meeting Act.
Mr. Brigham: So move.
Mr. Colclough: Second.
Motion carries 9-0.
Mr. Shepard: I would ask that you add and approve execution of a formal letter of
engagement with McKenna, Long and Alrich to defend the city in the case that has been
filed in the Northern District of Georgia Federal Court regarding the GEFA loans known
as McElmurray and Boyce versus Augusta. The terms of their engagement will be set forth
on the record of this body as contained in their letter. Their representation will be also be
subject to the execution of a waiver letter that waives any conflicts with their
representation of the Atlanta Gas Light Company and a possible waiver letter for their
representation of AMR in the (inaudible) contract amount.
Mr. Brigham: I’ll make a motion we add and approve.
Mr. Bowles: Second.
Motion carries 9-0.
Mr. Shepard: To clarify the record from the last legal session, I would ask that the
body authorize condemnation proceedings against two pieces of property in the – one being
940 Fenwick Street, the property of Fannie Jefferson, and the second being 944 Fenwick
Street, the property of Charles Walker. We had previously approved the purchase of those
properties and we ask that the body now give its approval adding and approving today the
actions of condemnations against the owners of those two properties.
Mr. Bowles: I make a motion.
Mr. Smith: Second.
Motion carries 9-0.
Mr. Shepard: One last real estate matter. I’d ask that the body add and approve
the auction sale by sealed bid of property adjacent to the Sue Reynolds Community Center
and that the proceeds be placed in an escrow account and that the escrow account be later
subject to the recommendation of uses by the Park and Recreation Director and
Department and that the ultimate expenditure be determined by this commission, that the
city would have the right to reject any and all bids if they thought it was insufficient and
the minimum bid would be $5,000 an acre.
Mr. Grantham: So move.
Mr. Smith: Second.
Motion carries 9-0.
